ADACMinutes2022December6MEETING MINUTES OF THE FREDERICK COUNTY AGRICULTURAL DISTRICT ADVISORY COMMITTEE Held in the first-floor Board of Supervisors Room of the Frederick County Administration Building, 107 N. Kent Street, Winchester, Virginia on December 6, 2022. PRESENT: Jason McDonald, Shawnee District; Cordell Watt, Gainesboro District; John Marker, Back Creek District Alternate; Harman Brumback, Back Creek; Patricia Scheulen- Ferrell, Gainesboro; Seth Thatcher, Commissioner of Revenue; and Mark Sutphin, Virginia Co- Extension ABSENT:; John Stelzl, Opequon District; William Cline, Stonewall District; and Shawn Graber, BOS Liaison STAFF PRESENT: Mark Cheran, Zoning Administrator; Pam Deeter, Secretary. CALL TO ORDER The meeting was called to order by Mr. Cheran at 6:00 p.m. On a motion made by Mr. Marker and seconded by Mr. Thatcher, the minutes for the September 21, 2021 meeting were unanimously approved as presented. Mr. Cheran stated that there are three new districts to be created and one adding additional acreage to the South Timber Ridge District. Staff received a request to create a new District which would be name Long Creek. Long Creek Farm is located in the Back Creek Magisterial District and is generally located ½ mile west of the intersection of Shady Elm Road and Springdale Road. This district would consist of 14 parcels and has 1,077.39 acres. The Comprehensive Plan provides guidance when considering any land use action. The proposed District lies outside of the SWSA and UDA and is not part of any land use plan. Ultimately, the Board of Supervisors approves, approves with modification, or denies the proposal to establish or renew an Agricultural and Forestal District. If approved this District would be up for renewal August 12, 2025. On a motion made by Mr. Marker and seconded by Mr. Brumback, to establish the Long Creek Agricultural & Forestal District were unanimously approved. 3 The second District staff received a request to establish is for North Frederick District which consist of 1,961.86 acres in the Gainesboro Magisterial District. The location of this proposed District is generally located 2.5 miles west of the intersection of North Frederick Pike along North Sleepy Creek Road and Bloomery Pike and would consist of 15 parcels. The proposed District consists of 90 percent forest use and 10 percent open space/pastures. The area is rural in nature. Comprehensive Plan provides guidance when considering land use actions. The parcels are outside the UDA and SWSA and is not in any land use study, so it meets the criteria for the Ag & Forestal District. The land is agricultural and residential and nature. The land should remain as current condition. Staff reiterated the renewal date if approved. On a motion made by Mr. Thatcher and seconded by Mr. Watt, to establish the North Frederick Agricultural & Forestal District were unanimously approved. The third District again staff received a request to create White Hall Agricultural & Forestal District which consist of 974.30 acres and is located in Gainesboro Magisterial District along Wright Road and Apple Pie Ridge Road. This proposed District has 7 parcels consisting of 974.30 acres. The current parcels are in RA District and contain agricultural and residential land use. Parcels around this proposed District is zoned RA. The parcels are out of the UDA and SWSA land use plan and are not in any land use study. If approved, this would renew in August 2025. On a motion made by Mr. Brumback and seconded by Ms. Scheulen-Ferrell, to establish the North Frederick Agricultural & Forestal District were unanimously approved. Staff stated these six parcels consist of 189.86 to be added to the South Timber Ridge District making the total acreage 1,170.94. This is in the Gainesboro Magisterial District and located along Hollow Road to the north, Muse Road and Gold Orchard Road. All the parcels are in the RA District and are 90 percent agriculture, orchard and crop harvesting and 10 percent open space/woodland. The parcels are in no land use study. Ultimately, the Board of Supervisors approves, approves with modification, or denies the proposal to establish or renew an Agricultural and Forestal District. If approved this would renew on the regular cycle of August 2025. On a motion made by Mr. Marker and seconded by Mr. McDonald, to add parcel to the South Timber Ridge Agricultural & Forestal District were unanimously approved. 4
