April 26 2023 Closed Session and Regular Meeting Minutes 296 MINUTES CLOSED SESSION AND REGULAR MEETING FREDERICK COUNTY BOARD OF SUPERVISORS WEDNESDAY, APRIL 26, 2023 6:00 P.M. AND 7:00 P.M. BOARD ROOM, COUNTY ADMINISTRATION BUILDING 107 NORTH KENT STREET, WINCHESTER, VIRGINIA ATTENDEES Board of Supervisors: Charles S. DeHaven, Jr., Chairman; Blaine P. Dunn, Vice Chairman; Robert W. CALL TO ORDER Chairman DeHaven called the meeting to order at 6:00 p.m. CLOSED SESSION Supervisor Slaughter stated that she needed to disclose a conflict of interest,that she has a business relationship with an entity involved in or relevant to one of the items being discussed in the closed session. She said she would recuse herself from the Board's discussion of that item and would leave the closed session room for discussion of that item, in order not to acquire confidential information regarding the matter. Vice Chairman Dunn moved that the Board of Supervisors of Frederick County enter a closed session pursuant to Virginia Code § 2.2-3711(A)(5) for discussion concerning a prospective business or industry and the expansion of an existing business or industry where no previous announcement has been made of the business'or industry's interest in locating or expanding its facilities in the community. Supervisor Graber seconded the motion which carried on a voice vote. Minute Book 48 Board of Supervisors Regular Meeting of April 26, 2023 County of Frederick, Virginia 297 At 6:14 p.m., Supervisor Slaughter left the Closed Session. At 6:20 p.m.,the Board members left the Closed Session room and assembled within the designated meeting place in the presence of members of the public and the media desiring to attend. Supervisor Slaughter stated per the conflict of interest that she disclosed prior to the closed session, she recused herself from the Board's discussion of that item and left the closed session room for discussion of that item in order not to acquire confidential information regarding the matter. She said as a result, she must abstain from voting on the certification of the closed session, but stated that,for the portion of the closed session at which she was present, (i) only public business matters lawfully exempted from open meeting requirements by Virginia law were heard, discussed, or considered by the Board, and (ii) only such public business matters as were identified in the motion convening the closed session were heard, discussed, or considered by the Board. The meeting was reconvened on motion of Vice Chairman Dunn, seconded by Supervisor Wells. Vice Chairman Dunn moved that the Board of Supervisors of Frederick County certifies that, to the best of each member's knowledge, (i) only public business matters lawfully exempted from open meeting requirements by Virginia law and (ii) only such public business matters as were identified in the motion convening the closed meeting were heard, discussed, or considered by the Board in the closed meeting to which this certification applies. Supervisor Wells seconded the motion. Supervisors Ludwig and Graber questioned Mr. Stowe about potential conflicts of interest and current projects he is involved in that would come before the Commission. Mr. Stowe said that he would recuse himself if there should be any conflicts and that he currently has only one project that is making its way to the Commission. The motion to appoint carried on a voice vote. He said Staff was seeking authorization from the Board of Supervisors to schedule a public hearing on May 24, 2023, regarding the 2023-2028 CIP. Supervisor Ludwig and Mr. Pearson discussed the proposed CIP document and Virginia Code sections concerning the CIP. Supervisor Graber made a presentation on funding for school expansion and compared the Sherando High School renovation with a high school addition now occurring in Rockingham County. He said he wished to see amendments to the current CIP before sending it to a public hearing. Supervisor Graber moved to postpone the discussion of sending the CIP to a public hearing until the next Board meeting. DeHaven, Jr. Aye Judith McCann-Slaughter Aye Minute Book 48 Board of Supervisors Regular Meeting of April 26, 2023 County of Frederick, Virginia 304 + + + + + + + + + + + + + + BOARD LIAISON REPORTS - None CITIZEN COMMENTS Rodney Wine, Shawnee District, said he would not have to sue the County over the April 11 Special Election because Supervisor Graber and Brad Pollack encouraged the Electoral Board and the Registrar to follow the Code. BOARD OF SUPERVISORS COMMENTS Supervisor Wells spoke about the reduction in the real estate tax rate from $0.61 per$100 of assessed value to $0.51 per$100 of assessed value. He said that after going through the budget process during the Board work sessions, there was an opportunity to help the taxpayers with a reduced rate this year. He said he is unable to predict whether a tax increase will be needed in the future, but that he would continue to do what is best for the citizens of the County. Vice Chairman Dunn stated that the budget just passed by the Board did not fund all of the requests received by the Board. He reiterated that the Board members never voted to set a real estate tax rate at $0.61 per$100 of assessed value but rather agreed to run the required advertisement regarding the actual and revenue-neutral tax rates for real estate. He discussed the use of$24 million in the capital fund to balance the budget and noted the need to improve the Capital Improvement Plan (CIP). Supervisor Graber said the adopted budget scenario was not the one he preferred. He said he did not want to deplete the capital fund. He questioned why the revenue-neutral tax rate was not advertised as discussed at the first budget work session in January. Supervisor Ludwig said there were amendments that did not pass when the budget was adopted that could have saved money. He said the County was spending too much of its capital funds. He said there were other things going on during the budget process including Vice Chairman Dunn's suggestion of a pay increase for Board Members. Members present were Gary Longerbeam, Natalie Gerometta, Dennis Grubbs, Ronald Madagan, Randy Carter, and Jennifer Myers. Non-voting Board Liaison, Mr. Charles Dehaven. Members absent: Guss Morrison ITEMS REQUIRING ACTION BY BOARD OF SUPERVISORS: 1. Buildings &Grounds Committee-Easement Request. The Buildings and Grounds Committee recommended approval of a request from Robert and Julie Owens to allow a Frederick Water easement from their adjoining property on Brucetown Road to water/sewer lines in the Clearbrook Park maintenance shop parking area. Robert Owens and the committee agreed to a compensation amount of$10,500, seconded by Mr. Carter, carried unanimously(6-0). (Attachment 1). ITEMS SUBMITTED FOR INFORMATION ONLY 1.
