REMOVAL OF PARCEL FROM THE
DOUBLE CHURCH AGRICULTURAL& FORESTAL DISTRICT
WHEREAS, a proposal to remove parcel from the Double Church Agricultural & Forestal District by
100.35+/- acres, was considered, said property located in the Opequon Magisterial District West of Grim
Road (Route 640), and South of Wise Mill Lane (Route 737) and identified by Property Identification
Number 86-A-35.
WHEREAS,The Agricultural District Advisory Committee(ADAC)recommended approval of this proposal
on March 14, 2023; and
WHEREAS,the Planning Commission held a public hearing and recommended approval of this proposal on
April 5, 2023; and
WHEREAS,the Board of Supervisors held a public hearing on this proposal on April 12, 2023; and
WHEREAS, the Frederick County Board of Supervisors finds the removal of this parcel from the Double
Church Agricultural &Forestal District is justified by good and reasonable cause;
NOW, THEREFORE,BE IT ORDAINED by the Frederick County Board of Supervisors as follows:
The Frederick County Board of Supervisors hereby decreases the 2020.2025 Double Church Agricultural&
Forestal District by 100.35+/-acres in the Opequon Magisterial District,Property Identification Number 86-A-
35.
This ordinance shall be in effect on the day of adoption.

RE: Request to Remove Parcel 86-A-35, owned by Thomas Stelzl from the
Double Church Agricultural and Forestal District.

Please rind attached a letter from Thomas Stelzl, (Fairview-Spring Hill Farms, Hog Group,
LLC.) dated February 22, 2023. Mr. Stelzl has requested the removal of one parcel from the
Double Church Agricultural and Forestal District. The Double Church Agricultural and
Forestal District was established in 1995 and has been renewed rive times. The most recent
renewal of this district occurred in September 2020 for a period of five years. Currently,
954.90 acres are contained in this district.
Mr. Stelzl desire to remove one parcel totaling 100.35+/- acres from the Double Church
Agricultural and Forestal District. Section 15.2-4314 of the Code of Virginia, 1950, as
amended, provides property owners with the ability to request removal of land from an
agricultural and forestal district through a public process via the local governing body. This
removal is to allow for a subdivision of the land.
The Agricultural District Advisory Committee (ADAC) considered this request during their
meeting of March 14, 2023. The ADAC unanimously recommended that this 100.35-acre
parcel be removed from the Double Church Agricultural and Forestal District. A total of
854.55-acres will remain in the Double Church Agricultural and Forestal District. The
Planning Commission unanimously recommended that this 100.35-acre parcel be removed
from the Double Church Agricultural and Forestal District. A total of 854.55-acres will
remain in the Double Church Agricultural and Forestal District.
Staff will present mapping during the Board of Supervisors meeting which delineates the
location of this acreage and its proximity to other land within the Double Church Agricultural
and Forestal District.
Following a public hearing,Board of Supervisors action on this application would be appropriate.

Dear Mr.Cheran,
I am writing you to request permission to subdivide my family's farm (approximately
100 acres)located at 560 Grim Road,Stephens City,VA 22655.The tax map number
is 86-A-35.
My grandmother has severe dementia and we had to place her in a nursing home to
give her the care she needs.We need to subdivide the family farm to afford to pay for
her care.Attached, please find a comprehensive plan of the subdivision for your review
and records. I have already paid rollback land-use taxes on December 13,2022.
1 was unaware this process was required and was under the impression paying roll-
back land-use taxes was sufficient to proceed forward with the subdivision process.
Unfortunately,my ignorance has created a major delay in an already-long process.
Given the financial strain my grandmother's care places on my family,I greatly
appreciate any and all expediency you can give this matter.Thank you for your time!
