041-04 BOARD OF SUPERVISORS RESOLUTION FISCAL YEAR 2003-2004 BUDGET AMENDMENT WHEREAS, the Frederick County Board of Supervisors, meeting in regular session and public hearing held on February II, 2004, took the following action: NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors that the FY 2003- 2004 Budget be Amended to Reflect: Airport Capital Fund Supplemental Appropriation in the Amount of $1,565,000. This Amount Represents the Airport Road Relocation. AiJ;port Fund Supplemental Appropriation in the Amount of $1,850,000. William Orndoff, Jr., Treasurer Renny Manuel, Airport Director BOARD OF SUPERVISORS RESOLUTION OF THE BOARD OF SUPERVISORS OF FREDERICK COUNTY APPROVING THE ISSUANCE OF DEBT BY THE WINCHESTER REGIONAL AIRPORT AUTHORITY AND RELATED MATTERS WHEREAS, the Board of Directors (the "Board") of the Winchester Regional Airport Authority (the "Authority") has authorized the submission of an application to the Virginia Resources Authority ("VRA"), as the Administrator of the Virginia Airports Revolving Fund to participate in the Virginia Airports Revolving Fund Financing Program through the proposed issuance of bonds by the Authority in an amount not to exceed $1,850,000 (the"Bonds") for the financing and construction of a 16 unit hangar building, the expansion of an existing hangar and various other capital improvements to the Winchester Regional Airport, and to refmance the outstanding principal balance of tax exempt bonds issued by the Authority in 1990 and 1996 together with related expenses and costs of issuance (the "Project"). WHEREAS, in accordance with section 7.17.b of the Winchester Regional Airport Authority Act 1987 Session, Virginia Acts of Assembly, Chapter 687 in accordance with Chapter 3, Title 5.1, et.seq., Code of Virginia of 1950, as amended (the "Act") the consent of each of the participating political subdivisions is required for any issuance of debt by the Authority if the total debt shall exceed $500,000, and the participating political subdivisions consist of the City of Winchester, and the Counties of Shenandoah, Frederick, Clarke, and Warren (collectively, the "Member Jurisdictions"); such consent is being requested prior to issuance of the Bonds by the Authority. NOW, THEREFORE, BE IT RESOLVED: 1. The Board of Supervisors of Frederick County hereby consents to the issuance of the Bonds by the Authority for the purpose offmancing the Project. 2. Under no circumstances shall the payment of debt service on the Bonds constitute a general obligation indebtedness or a pledge of the full faith and credit or taxing power of any of the Member Jurisdictions. 3. This amount represents half-year funding needed for nine new positions. Additional local funds are necessary. See attached proposal, p. 17-42. This request was forwarded to the board without a recommendation with the concem by the committee for mid-year supplemental appropriations. 10. The Commissioner of the Revenue requests a General Fund s~PJ>lemental ap,pro.,priation in the amount of $52.000. Blue Ridge Appraisal Company is ahead of schedule and has completed additional field work in FY 2004 that was originally scheduled for FY 2005. If approved, this same amount may be reduced in the FY 200S budget. Additional local funds are necessary. See attached memo, p. 43. The committee recommends approval. 11. The Commissioner of the Revenue requests General Fund budget transfers in the amount of $21.000. This amount is needed to pay an invoice from Blue Ridge Appraisal Company that was submitted sooner than expected.. No additional local funds are needed. See attached memo, p. 43. Neither of these appropriations will require additional funding from Frederick County or the City of Winchester. The Professional Services expense line will need adOmonal money appropriated to cover expenses for the annual audit for which the Airport Authority has yet to be billed. Money was originaDy budgeted for this expense however due to unforeseen expenses for engineering and legal services since July 2003, there is currently not enough money left to cover the anticipated bUl for the annual audit. Revenue to cover this expense will come from increased sales above the anticipated :utg;-1 for fuel and merchandise and will not require local funding. The Airport Authority now has grant money from various State and Federal agencies to fund this project and the Authority is ready to proceed with the construction phase. The design phase for this project was funded and completed during the prior budget year. This capital project is on Frederick County's Comprehensive Plan and was previously approved by the Frederick County Board of Supervisors with a directive to find additional revenues to lessen the funding load on local ju~ictions. The Authoriy has succeeded in securing outside funding and it appears that local funding will not be needed at this time. Should construction bids exceed the appropriation request, the matter wiD be brought back to the Finance Committee to be addressed at that time. The Airport Authority adopted a resolution December 11,2003 (enclosed) approving the process of borrowing funds through the Virginia Resource Authority with a not to exceed of $1,850,000. These funds will be used to fund construction of a new t-hangar building; add four t-hangar units on the end of an existing t-hangar building; refinance current bond with Rural Economic Development Commission; and refinance current loan with Bank of New York. This loan will be repaid from revenues generated by leasing these t..'lldings and will not require local funding. The enclosed resolution (Exhibit A) authorizes the Airport Authority to borrow this money as required by Section 17 of the Act establishing the Airport Authority. It does not obligate any jurisdiction to stand behind the loan. We have forwarded this resolution to the other member jurisdictions for review and adoption at their next regular meeting.
