TOURISM UPDATE -JUSTIN KERNS, EXECUTIVE DIRECTOR, WINCHESTER-FREDERICK

Mr. Kerns provided an update on current and future activities at the Tourism bureau.
ORDINANCE TO AMEND THE FREDERICK COUNTY CODE, CHAPTER 48 ANIMALS AND
FOWL, ARTICLE I DOG LICENSING; RABIES CONTROL. —SENT FORWARD TO PUBLIC
HEARING
The County Attorney explained the purpose of the proposed amendment was to update provisions
to comport with State enabling legislation should the Board desire to send the matter forward to a public
hearing. On motion of Supervisor Dunn, seconded by Supervisor Wells and carrying on a voice vote, the
proposed amendment was sent forward to a public hearing.

THE COUNTY'S PARTICIPATION IN THE PROPOSED SETTLEMENT OF OPIOID-RELATED

Supervisor Wells moved for the adoption of A Resolution Of The Frederick County Board Of
Supervisors Approving Of The County's Participation In The Proposed Settlement Of Opioid-Related Claims
Against Teva,Allergan, Walmart, Walgreens, CVS,And Their Related Corporate Entities,And Directing The
County Attorney and/or The County's Outside Counsel To Execute The Documents Necessary To Effectuate
The County's Participation In The Settlements. Supervisor Dunn seconded the motion.
Supervisor Graber noted that he would vote for the resolution but had concerns about how the matter
had been addressed. The motion carried on a recorded vote as follows:

ENTITIES,AND
DIRECTING THE COUNTY ATTORNEY AND/OR THE COUNTY'S OUTSIDE COUNSEL TO EXECUTE
THE DOCUMENTS NECESSARY TO EFFECTUATE THE COUNTY'S PARTICIPATION IN THE
SETTLEMENTS
WHEREAS, the opioid epidemic that has cost thousands of human lives across the country also impacts
Frederick County by adversely impacting the delivery of emergency medical, law enforcement, criminal justice,
mental health and substance abuse services, and other services by Frederick County's various departments and
agencies;and
WHEREAS, Frederick County has been required and will continue to be required to allocate substantial
taxpayer dollars,resources,staff energy and time to address the damage the opioid epidemic has caused and continues
to cause the citizens of Frederick County;and
WHEREAS,Frederick County has filed suit against Teva,Allergan,Walmart,Walgreens,CVS,and certain
of their related corporate entities for their role in the distribution,manufacture,and sale of the pharmaceutical opioid
products that have fueled the opioid epidemic that has harmed Frederick County;and
WHEREAS,the County's suit seeks recovery of the public funds previously expended and to be expended
in the future to abate the consequences and harms of the opioid epidemic;and
WHEREAS,settlement proposals have been negotiated that will cause Teva,Allergan,Walmart,Walgreens,
and CVS to pay billions of dollars nationwide to resolve opioid-related claims against them;and
WHEREAS, the County has approved and adopted the Virginia Opioid Abatement Fund and Settlement
Allocation Memorandum of Understanding (the"Virginia MOU"), and affirms that these pending settlements with
Teva, Allergan, Walmart, CVS, and Walgreens shall be considered "Settlements" that are subject to the Virginia
MOU,and shall be administered and allocated in the same manner as the opioid settlements entered into previously
with the Distributors and Janssen;and
WHEREAS,the County's outside opioid litigation counsel has recommended that the County participate in
the settlements in order to recover its share of the funds that the settlement would provide;and
WHEREAS,the County Attorney has reviewed the available information about the proposed settlements and
concurs with the recommendation of outside counsel;
NOW THEREFORE BE IT RESOLVED that the Frederick County Board of Supervisors, this 22nd day of
February, 2023, approves of the County's participation in the proposed settlement of opioid-related claims against
Teva,Allergan,Walmart,Walgreens,CVS,and their related corporate entities,and directs the County Attorney and/or
the County's outside counsel to execute the documents necessary to effectuate the County's participation in the
settlements,including the required release of claims against settling entities.

COMMITTEE—APPROVED
Supervisor Graber moved that George Bishop be reappointed to the Shawneeland Sanitary District
Advisory Committee for a two-year term ending February 27, 2025. Supervisor Wells seconded the motion
which carried on a voice vote.

PUBLIC HEARINGS (NON PLANNING ISSUES)
PROPOSED AMENDMENT TO THE LEASE AGREEMENT BETWEEN THE COUNTY OF
FREDERICK, VIRGINIA AND BRIAN KEITH MATHESON -APPROVED
The Deputy County Administrator explained the existing lease agreement between the County of
Frederick, Virginia and Brian Keith Matheson for space located at 239 Sunnyside Plaza Circle, described as
certain real property containing approximately 1,200 square feet and being part of that parcel identified as
Parcel Number 53-A-52-E in the Stonewall Magisterial District. He said the proposed amendment would
extend the existing lease for an additional 3 years commencing on July 1, 2023, and expiring June 30, 2026.
Chairman DeHaven opened the public comment period.
There were no speakers.

Supervisor Graber moved for approval of the amendment to the lease agreement for Brian Keith
Matheson for space located at 239 Sunnyside Plaza Circle. Supervisor Wells seconded the motion which

PLANNING COMMISSION BUSINESS -OTHER PLANNING BUSINESS
2023-2028 CAPITAL IMPROVEMENTS PLAN (CIP)—ACTION POSTPONED FOR 60 DAYS
The Planning & Development Director introduced the 2023-2028 Capital Improvements Plan. He said
if adopted, the CIP will become a component of the Comprehensive Plan, which would satisfy the review

requirement of Section 15.2-2232 of the Code of Virginia, which states that no public facility shall be
constructed unless said facility is a "feature shown" within a jurisdiction's comprehensive plan.
The Board and Mr. Pearson discussed listing the fourth county high school on the CIP as well as
including alternatives to constructing a new high school that could address the crowding problem.
The Board and Wayne Lee of Frederick County Public Schools discussed the possible renovations at
Sherando High School compared to building a new high school.
Supervisor Graber said there was information missing from requests by the schools and fire
and rescue and he moved to postpone sending the CIP forward to a public hearing for 60 days. Supervisor

BOARD LIAISON REPORTS - None
CITIZEN COMMENTS
Christie Scarborough, Stonewall District, commented on Supervisor Dunn's recent votes and social
media activity. She said if he participates in viewpoint discrimination on his social media account again, he
will face a civil rights lawsuit.
Paula Tingle, Opequon District, spoke in opposition to the destruction of property occurring by vendors
such as Shentel and Verizon which are supplying fiber optic and other utilities in her neighborhood.
Kyra Pulliam, Opequon District, cited damage to her property by utility workers and urged the County
to advise citizens of such non-emergency projects before they are started.
Linda Shark, Opequon District, said she agreed with the previous comments.
Julie Dumis, Opequon District, said she agreed with the previous comments.
Allen Shaffer, Shawnee District, referenced comments made by Supervisor Dunn at the previous
meeting saying that he engaged in hearsay gossip making it county business.
Brian Byrd, Shentel Glofiber representative, said that he has heard the complaints of the citizens and
will speak with anyone after the meeting.

David Sforza, Red Bud District, spoke in support of Supervisor Dunn.
Tim Regan, Back Creek District, commented on the new school superintendent and suggested that he
appear before the Board and agree to any audit requested.
BOARD OF SUPERVISORS COMMENTS
Supervisor Dunn commented on the budget process, the growing county population, and the need for
services provided by the county.
Supervisor Graber commented on the budget process saying he is in favor of a revenue-neutral tax
rate for the coming year.
Supervisor Ludwig commented on the budget process saying the County should look at the needs
before looking at a tax increase. He referenced the short-term lodging business and suggested the Board
look at the process to make sure it is not overly regulated and causing the loss of such businesses in the
County.
Supervisor Wells referenced the complaints by citizens against Shentel and Verizon and asked staff to
explore any options to address the issue.

PARKS AND RECREATION COMMISSION REPORT to the BOARD OF SUPERVISORS
Tuesday, February 14,2023
7:00 p.m.

The Parks and Recreation Commission met on February 14, 2023. Members present were
Gary Longerbeam, Natalie Gerometta, Dennis Grubbs, Ronald Madagan, Randy Carter, and
Jennifer Myers. Non-voting Board Liaison, Mr. Charles Dehaven.
Members absent: Guss Morrison, Amy Strosnider
ITEMS REQUIRING ACTION BY BOARD OF SUPERVISORS:
None
ITEMS SUBMITTED FOR INFORMATION ONLY
1. Due to a change in Commission Members, elections were held again for 2023. Mr.
Madagan made a motion to nominate Gary Longerbeam for the position of Chair for
2023, seconded by Mrs. Myers, carried unanimously(6-0).
2. Mr. Madagan made a motion to nominate Dennis Grubbs for the position of Vice-Chair
for 2023, seconded by Mrs. Myers, carried unanimously (7-0).
3. The Buildings and Grounds Committee recommends requesting$29,000 of Parks and
Recreation proffer funds for earthwork to create a rectangular field suitable for
organized team practices at the Sherando Park Warrior Drive entrance, seconded by
Mr. Longerbeam, carried unanimously(6-0). This request will be forwarded to the
Frederick County Finance Committee for their recommendation.
4. The Buildings and Grounds Committee recommends requesting$135,000 of Parks and
Recreation proffer funds to build pickleball courts at Sherando Park, seconded by Mr.
Longerbeam, carried unanimously (6-0). This request will be forwarded to the
Frederick County Finance Committee for their recommendation.
