PLEDGE OF ALLEGIANCE Supervisor Wells led the Pledge of Allegiance. ADOPTION OF AGENDA-APPROVED The proposed agenda was adopted on a voice vote with the removal of the item titled Rezoning#08- 22 Metromont following a motion by Supervisor Slaughter, seconded by Supervisor Wells. CITIZEN COMMENTS David Licklider of Pennsylvania Avenue spoke in opposition to Rezoning #08-22. Dave Cobb of Pennsylvania Avenue spoke in opposition to Rezoning #08-22. Minute Book 48 Board of Supervisors Regular Meeting of October 26, 2022 County of Frederick, Virginia 96 Micah Jacobs, Back Creek District, said he had applied multiple times for the vacancy on the Shawneeland Sanitary District Advisory Committee and that his application had not been voted on by the Board. Supervisors Ludwig and Graber discussed the types of audits presented, the possibilities for reorganizing operations to combine some county services, and the desire to know how allocated school dollars have been spent. APPOINTMENTS TO BOARDS, COMMITTEES, AND COMMISSIONS KAREN SWECKER APPOINTED TO ECONOMIC DEVELOPMENT AUTHORITY—APPROVED On motion of Supervisor Slaughter, seconded by Supervisor Wells, Karen Swecker was appointed to a four-year term ending 10-26-2026 on the Economic Development Authority on a voice vote. JEFF STEVENS REAPPOINTED TO THE SHAWNEELAND SANITARY DISTRICT ADVISORY COMMITTEE—APPROVED On motion of Supervisor Graber, seconded by Supervisor Wells, Jeff Stevens was reappointed to a two-year term ending 11-9-2024 on the Shawneeland Sanitary District Advisory Committee on a voice vote. SHAWNEELAND SANITARY DISTRICT ADVISORY COMMITTEE APPOINTMENT— MOTION FAILED Supervisor Graber moved to appoint Brian Schmitt to a two-year term on the Shawneeland Sanitary District Advisory Committee. Supervisor Ludwig seconded the motion which failed on a voice vote. + + + + + + + + + + + + + + COMMITTEE BUSINESS—FINANCE COMMITTEE Supervisor Slaughter moved for approval of the following: The County Attorney requests a General Fund supplemental appropriation in the amount of$250.This amount represents reimbursement for time and materials for a response to a subpoena. DeHaven, Jr. Aye Judith McCann-Slaughter Aye Supervisor Slaughter moved for approval of the following: The Finance Director requests discussion and direction on FY 2023 funding for Laurel Ridge Community College. While no signed MOU exists, Board of Supervisors' minutes indicate that Frederick County and other localities agreed to fund the college. LRCC provides the County an updated contract annually. The FY 2022 contribution was $81,308. The FY 2023 requested amount is $92,094. Supervisor Wells seconded the motion. Supervisor Graber discussed the use of County funds for the name change from Lord Fairfax Community College to Laurel Ridge Community College. Craig Short, Vice President for Financial and Administrative Services at Laurel Ridge, said that no County funds were used for the name change expenses. Supervisor Ludwig said he would like to see an accounting of how the College Board budget funds were spent. Supervisor Graber offered a motion to table the request until details can be brought forward in a work session for discussion about how funds were spent regarding the Community College's name change. DeHaven, Jr. Aye Judith McCann-Slaughter Aye Minute Book 48 Board of Supervisors Regular Meeting of October 26, 2022 County of Frederick, Virginia 99 County Attorney Williams confirmed a point of order regarding votes on financial items of more than $500 requiring a majority vote of the elected body rather than a majority of only those present, noting that the preceding vote did not carry. Supervisor Wells moved to postpone the request until the next meeting. Supervisor Slaughter seconded the motion which carried on a voice vote. Supervisor Slaughter moved for approval of the following: The FCPS Executive Director of Finance requests a School Operating Fund and General Fund supplemental appropriations in the amount of $1,023,546. This amount represents FY 2022 unspent and unobligated School Operating Fund funds. Funds will be used to provide support for the FY 2023 Capital Asset Plan. Supervisor Wells seconded the motion. Supervisor Slaughter moved to approve Amendment to the FY 2022-2023 Fiscal Year Budget to Reflect: General Fund Supplemental Appropriation In The Amount of $4,637,218 with these funds being Minute Book 48 Board of Supervisors Regular Meeting of October 26, 2022 County of Frederick, Virginia 101 appropriated for personal property rebates. Supervisor Graber seconded the motion. Supervisor Wells said he supported the motion but noted that proceeding with changing the due date for local taxes may affect federal or state taxes owed by County residents. He added that the typical credit will be about$40 or$50. Supervisor Graber said he hoped the refund would help the citizens. The motion carried on a recorded vote as follows: Blaine P. Steve Brannon, Back Creek District, spoke in favor of the ordinance and asked the Board to plan for a revenue neutral tax rate next year. Chairman DeHaven closed the public comment period. Supervisor Graber moved to adopt an Ordinance Returning Surplus Personal Property Tax Revenues to Taxpayers and Extending the Due Date for Payment of Second Half 2022 Real Property and Personal Property Taxes. DeHaven, Jr. Aye Judith McCann-Slaughter Aye ORDINANCE Returning Surplus Personal Property Tax Revenues to Taxpayers and Extending the Due Date for Payment of Second Half 2022 Real Property and Personal Property Taxes October 26,2022 WHEREAS, Section 15.2-2511.1 of the Code of Virginia,as amended effective July 1,2022,authorizes the Board of Supervisors to enact an ordinance to"develop a method for returning surplus real or personal property tax revenues,or both,to taxpayers who are assessed such taxes in any fiscal year in which the locality reports a surplus;"and, WHEREAS,for Fiscal Year 2022,that Frederick County collected surplus personal property tax revenues that exceeded budgeted amounts for Fiscal Year 2022 by$4,637,218.00;and, WHEREAS,due to unanticipated market conditions and other unanticipated economic factors,the value of personal property in categories 1 (personal use cars eligible for Personal Property Tax Relief Act),2(personal use trucks,weighing not more than 7,500 pounds,eligible for Personal Property Tax Relief Act),21 (business use cars not eligible for Personal Property Tax Relief Act),22(business use trucks not eligible for Personal Property Tax Relief Act),and 45 (personal use trucks,weighing more than 7,500 pounds but not more than 10,000 pounds, eligible for Personal Property Tax Relief Act)was significantly higher than anticipated and,as a result,the personal property tax assessments on such property were likewise higher than anticipated,with the same contributing significantly to Frederick County's surplus revenues for Fiscal Year 2022;and, WHEREAS,personal property in Frederick County,including the foregoing personal property,has been assessed for taxation as of January 1,2022,and personal property taxes will be collected this year based upon that assessment;and WHEREAS,the Board of Supervisors wishes to provide a method for returning surplus personal property tax revenues to Qualified Taxpayers of Frederick County who were assessed personal property taxes for tax year 2022. NOW,THEREFORE,be it ordained by the Board of Supervisors of Frederick County,Virginia: 1. Taxpayers entitled to return of surplus personal property tax revenues. For purposes of this ordinance,"Qualified Property"is any property assessed with personal property tax by Frederick County on January 1,2022,for property in categories 1 (personal use cars eligible for Personal Property Tax Relief Act),2(personal use trucks,weighing not more than 7,500 pounds,eligible for Personal Property Tax Relief Act),21 (business use cars not eligible for Personal Property Tax Relief Act),22(business use trucks not eligible for Personal Property Tax Relief Act),and 45 (personal use trucks,weighing more than 7,500 pounds but not more than 10,000 pounds,eligible for Personal Property Tax Relief Act),and for which property Frederick County issued a first half 2022 tax bill,due June 6,2022. 2. Amount of return of surplus personal property tax revenues for Qualified Property. For each item of Qualified Property,Frederick County will return an amount equal to a pro rata share of $4,637,218.00 relative to the total amount of personal property tax assessed for the first half of tax year 2022 on all items of Qualified Property,the amount of personal property tax assessed for the first half of tax year 2022 for such Qualified Property,for purposes of this ordinance,being the amount that is net after application of Personal Property Tax Relief Act credit and less any abatements issued as of the date of adoption of this ordinance,for the Qualified Property. 3. Method of return of surplus. For each item of Qualified Property,the total amount authorized under this ordinance will be applied first to any delinquent personal property taxes,according to the provisions of§ 58.1-3913 of the Code of Virginia,due Minute Book 48 Board of Supervisors Regular Meeting of October 26, 2022 County of Frederick, Virginia 103 from the owner of such property and then to the installment of the 2022 personal property taxes payable for second half 2022, and that are due on January 18,2023,pursuant to section 5 of this ordinance.The Treasurer shall apply the rebate due under this ordinance as credit against the second half portion of 2022 personal property taxes due from the owner of the Qualified Property. In no case shall the rebate exceed the tax billed,after subsequent abatements, for the Qualified Property for second half 2022, except that any such excess over the tax billed, after subsequent abatements, for the Qualified Property for second half 2022 shall be applied to personal property tax due for personal property owned as of January 1,2023 by the owner of Qualified Property,but in any case,no credit will be applied after June 30,2023. 4. All rebates under this ordinance will be made solely from fund balance resulting from surplus revenue and funds in the amount of$4,637,218.00 are appropriated for that purpose. 5. Notwithstanding the provisions of Section 155-2 of the County Code, for all real property taxes, sanitary district taxes, streetlight service district taxes, Star Fort taxes, and personal property taxes, assessed for tax year 2022,the due date for the second half installment for such taxes for tax year 2022 is extended to January 18,2023, but the foregoing extension does not apply to public service company taxes.This ordinance applies for purposes of the indicated taxes and for tax year 2022 only and the due dates provided for in Section 155-2 of the County Code for all other taxes and years are unchanged. 6. That this ordinance will be in full force and effect on and after its passage as provided by law. + + + + + + + + + + + + + + PLANNING COMMISSION BUSINESS—PUBLIC HEARINGS -None + + + + + + + + + + + + + + PLANNING COMMISSION BUSINESS -OTHER PLANNING BUSINESS REZONING #09-22 -THE CANYON LC (MINOR PROFFER AMENDMENT)-APPROVED Senior Planner Tyler Klein explained the application to rezone (minor proffer amendment) +/-174.98 acres from RP (Residential Performance) District with proffers to RP (Residential Performance) District with revised proffers. He said this proposal would amend the previously approved proffer statement for REZ#06- 15, Opequon Crossing, to further specify no "certificate of occupancy" shall be issued for any dwelling unit without completion of improvements to Route 7 and the proposed collector "spine" road (Proffer 9.2) and further clarify the monetary escalation occurs from the original 2015 rezoning (Proffer 13.1). He added that Minute Book 48 Board of Supervisors Regular Meeting of October 26,2022 County of Frederick, Virginia 104 all other provisions in the approved proffer statement (land use, density, other transportation improvements) remain unaltered and the subject properties are located wholly in the Red Bud District. DeHaven, Jr. Aye Judith McCann-Slaughter Aye ORDINANCE AMENDING THE ZONING DISTRICT MAP REZONING#09-22 THE CANYON LC WHEREAS,REZONING#09-22 THE CANYON LC,submitted to amend the proffer statement approved with REZ#06-15(Opequon Crossing).The proposed minor proffer amendment seeks to specify no "Certificate of Occupancy"shall be issued for any dwelling unit without completion of improvements to Route 7 and the proposed collector"spine"road and further clarify the monetary escalation occurs from the original 2015 rezoning; and WHEREAS,the Frederick County Planning Commission held a public meeting on this Rezoning on October 19, 2022 and recommended approval;and WHEREAS,the Frederick County Board of Supervisors held a public meeting on this Rezoning during their regular meeting on October 26,2022;and WHEREAS,the Frederick County Board of Supervisors finds the approval of this Rezoning to be in the best interest of the public health,safety,and welfare. NOW, THEREFORE, BE IT ORDAINED by the Frederick County Board of Supervisors, that in accordance with Chapter 165 of the Frederick County Code, Zoning, the Zoning District Map is amended to revise the proffers associated with Rezoning#06-15 Opequon Crossing to specify no "certificate of occupancy" shall be issued for any dwelling unit without completion of improvements to Route 7 and the proposed collector"spine"road.;and The conditions voluntarily proffered in writing by the Applicant and the Property Owner are attached. + + + + + + + + + + + + + + BOARD LIAISON REPORTS - None CITIZEN COMMENTS - None Minute Book 48 Board of Supervisors Regular Meeting of October 26, 2022 County of Frederick, Virginia 105 BOARD OF SUPERVISORS COMMENTS Supervisor Slaughter announced the Transportation Forum on November 10. She praised the Planning Department staff for the work done on the Northeast Land Use Plan Update. Supervisor Ludwig encouraged residents of the Shawnee District to attend the Transportation Forum. Members present were Guss Morrison, Dennis Grubbs, Gary Longerbeam, Ronald Madagan, Amy Strosnider, Charles Sandy, Jr., and Jennifer Myers. Members absent: Natalie Gerometta ITEMS REQUIRING ACTION BY BOARD OF SUPERVISORS: None ITEMS SUBMITTED FOR INFORMATION ONLY 1. The Committee recommends the Capital Improvement Plan (CIP) as submitted, seconded by Mr. Sandy, carried unanimously (8-0). The CIP will be forwarded to the Frederick County Planning Commission for their review. (Attachment A). The Finance Director requests discussion and direction on FY 2023 funding for Laurel Ridge Community College. While no signed MOU exists, Board of Supervisors' minutes indicate that Frederick County and other localities agreed to fund the college. LRCC provides the County and updated contract annually.
