County, Virginia held in the Supervisors Room over the Clerk's Office, on the I4th day
of August, 1950.

The minutes of the last Regular beeting held on the IOth day of
July, 1950, were read and approved.

WRIGHT AND JANE GROSS.
Reports of Harry L. McCann, Treasurer, E. S. Bailey, Commissioner
of Revenue, Earl Cather, Game Warden, Aghes Shirley, Home Demonstration Agent, John Wolfe,
Assistant County Agent, Mrs. A. W. Wright, Tuberculosis Association and Jane Groos, Welfare
were read and approved.
DELINQUENT TAX
The County Treasurer, Harry L. McCann, presented to the Board the
list of delinquent personal property for the year of 1949 as of June 30, 1950 in-the
amount of $2,187.31 and also the delinquent Real Estate list for the tax year of 1949 as
of June 30, 1950 in the amount of $6,039.96 the total being $8,227.27. Which upon motion
duly seconded was unanimously approved.
COUNTY MARKET COL11TTEE
The Frederick County Farm Market Committee appeared before the
Board and requested that the Board take iur,ediate action on the building of this project.
A general discussion was entered into. No action was taken by the Board.
JANITOR'S SALARY
Upon motion duly seconded it is ordered that beginning September
Ist I950 that the Janitors Salary be increased $I0.00 per calander month.
BILLS APPROVED
Accounts totdding $3,460.20 were approved and ordered to be paid
from the General County Fund by warrants No. I2533 to I2569 inclusive and Livestock claims
and Fowl Claims and Earl Cather's Salary totaling $526.37 were approved and ordered to be
paid from the Dog Fund by warrants numbers II45 to I151. inclusive.

Upon motion duly seconded the City of Winchester and Frederick
Count'Joint Agreement,made on the first day of July, 1950 and fn effect on said date was
anprdved and further the Clerk is ordered to record a copy of said agreement in the
minute book of this Board, which follows:
This Agreement, made and dated this Ist day of July, 1950, by
and between The City of Winchester, Virginia, hereinafter referred to as The City of the
first part,. and The County Board of Supervisors for Frederick County, Virginia, here
referred to as The County, party of the second part;,
Whereas, The City and The County are parties to a certain
agreement bearing date the Ist day of January, 1943; and
Whereas, it is the desire and the intention of The City and
The County to settle their respective claims and differences arising under the aforesaid
agreement and to terminate that agreement as of the date of execution of this new

greement;
Now, Therefore, Witnesseth: That in and for the consideration
the premises and of the mutual obligations herein undertaken:
The City shall pay to The County, at or before the execution of
this agreement, the aggregate sum of Two Thousand Eight Hundred Seventy -five Dollars
($2,875.00), representing the sum of Eleven Hundred Fifty Dollars ($-1-,.150.00) a year for
the period of two and one -half (2�) years from January I, 1948, through June 30, 1950, the
receipt of such aggregate sum being hereby acknowledged by The County's executing this

e, and does hereby release all claims, demands, rights and causes of action whatsoever,
gal or equitable, which it may have against The City under the terms and provisions of
oresaid agreement between The City and The County, bearing date the Ist day of January,

It is mutually understood and hereby expressly agreed by the
parties hereto that the said agreement between The City and The County, bearing date the
Ist day of January, 1943, shall, at and from the date of execution of this agreement, be,
is hereby terminated and declared null and void; and
It is further mutally understood and hereby expressly agreed by
parties hereto that the jail, County Court House, County Clerk's Office and public
onfort station, such facilities either being jointly owned or jointly maintained and
perated by the parties hereto, shall be maintained and operated under the terms and
isions hereinafter set forth:
THE JAIL - The over -all supervision of the jail shall be by a
oint committee, consisting of three (3) members of the City Council and three (3) members
the County Board of Supervisors. The City Manager and the County Clerk are to be
ers of this committee, without vote, for the purpose of maintaining proper records and
understanding of statistical matters.
The operation of the jail shall be under the supervision of the
City, which shall assume control and responsibility for all operation, activities and
expenditures.
The City shall bill The County for one -half (#) of all expenditures
at the jail for which reinbursement cannot be obtained from the Commonwealth of Virginia.

STATIONS - The maintenance and operation of these facilities shall be under the control
and supervision Of The County.
The City shall pay to The County the fixed sum of Eleven Hundred
Fifty Dollars ($1,150.00) per year as its hhare of the costs of the maintenance and
operation of these facilities. One -half (J) of this sum shall be due and payable the Ist
day of July and the balance shall be due and pauable the Ist day of January, each year.
It is mutually understood and hereby expressly agreed by the
parties hereto that the basis for determining the fixed sum in future agreements to be paid
by the City to The County shall be as follows:
(h) One -third (I /3) of the annual cost of fuel and electricity
for the for the County Court House:
(b) One - sixth (I /6) of the annual cost of binding deed books,
providing canvas covers for deed books, cleaning deed books and providing legal pads for
the County Clerk's Office; and one -sixth (I /6) of the annual cost of fuel and electricity

(c) One -half (J) of the annual cost of maintaining and
operating the public comfort stations;
(d) In lieu of The City's sharing the one -sixth (I /6) annual
cost of fuel and electricity for the County Clerk's Office, The City will provide, without
charge to The County, Seven Hundred Thousand gallons (700,000) of water per year for the
public comfort stations. The City shall, however, bill The County for the full cost of
all the water used in the public comfort stations in, excess of Seven Hundred Thousand
gallons (700 ,000,gals. ) per year.
DURATION OF THIS AGREEMENT - IT is mutually understood and,
hereby expressly agreed that this agreement shall be in effect beginning the Ist day of
July, 1950, and continuing thereafter from year to year, unless either party hereto shall
give written notice to the other party on or before the Ist day of March of its desire and
intention to terminate this agreement as of the 30th day of June of the year in which such
written notice is given, and of its desire and intention to negotiate a new agreement.

the respective governing bodies of the City and County, affixed upon duplicate copies
hereof this Ist day of July, 1950:

Reports of I. Fred Stine, County Agent, Earl Cather, Game
Warden, Mrs. A. W. Wright, Tuberculosis Association, Robert L. DeHaven, Sheriff, Harry
L. McCann, Treasurer, Earl S. Bailey, Commissioner of the Revenue and Jane Gross, W
Department, were read and approved.
STATE -LOCAL HOSPITALIZATION
John Bruner, who was requested by Joseph A. Massie, Commonweal
Attorney, to appear before the Board at this meeting to explain the plan of State and
Local Hospitalization, appeared before the Board and explained a number of the paragraphs
in the agreement for care in the State -Local Hospitalization Plan. A general discussion
was also had.

PUBLIC WELFARE
Upon motion duly seconded, it is ordered that an additional
appropriation be made to the Welfare D for the fund A id to the Blind in the
amount of $150.00 and the County Treasurer is ordered to transfer the said amount from
the General County Fund to the Welfare Fund - Aid to the Blind. The Clerk is ordered to
transmit a copy of this minute to Harry L. McCann, County Treasurer.
SCHOOL BOARD
R. E. Aylor, Superintendent of the Frederick County Public
Schools, appeared before the Board and requested that the sum of $3395.00 for the
purchase of an additional school bus be used from the balance of School Funds as of
June 30, 1950.
SCHOOLL BOARD - Application for School Construction Fund
Upon motion duly seconded the following resolutions were
passed:
WHEREAS, The School Board for the County of Frederick, on
the 11th day of September, 1950, presented to this Board, an application addressed to the
State Board of Education of Virginia for the purpose of securing State School Constructic
Funds in the amount of $21,000.00 for the new school building (or for adding to or
improving the present school building) at Gore, Virginia.
RESOLVED, that the application of the County or City School
Board to the State Board of Education of Virginia for $21,000.00 from the School
Construction Fund is hereby approved.
The Board of Supervisors for said County or Council of said
City has, or will provide sufficient funds through cash appropriations and /or levy, to
complete this project. If the School Board has sufficient funds on hand to complete the
project, permission is hereby granted for the use of said funds, for the purpose designat(
in the applica tion.
WHEREAS, the School Board for the County of Frederick, on
the 11th day of September, 1950, presented to this Board or Council, an application
addressed to the State Board of Education of Virginia for the purpose of securing State
School Construction Funds in the amount of $8,000.00 for the new school building (or for

complete this project. If the School Board has sufficient funds on hand to complete the
project, permission is hereby granted for the use of said funds,for the purpose designated
in the application.
WHEREAS, The School Board for the County of Frederick, on the
11th day of S 1950, presented to this Board or Council, an application addresse

tion Fund is hereby approved.
The Board of Supervisors for said County or Council of said
City has, or will provide sufficient funds through cash appropriations and /or levy, to
complete this project. If the School Board has sufficient funds on hand to complete the
project, permission is hereby granted for the use of said funds, for the purpose designate'
in the application.

paid from the General County Fund by warrants numbers 12750 to 12608 inclusive and
livestock, fowl claims and Earl Cather's salary totaling $172.69 were approved and
ordered to be paid from the Dog Fund by warrants numbers 1163 to 1158 inclusive.,
SPECIAL METING
Upon motion duly seconded, it is ordered that a special
meeting be held on the 25th day of S 1950.

umback and passed by the unanimous vote of the Board of Supervisors, it is resolved
that this board go on record requesting that Robert L. DeHaven, Sheriff of Frederick
County, to apply to the StateCompensation Board for an allowance of Ninteen Hundred
($1900.00) Dollars per annum for the employment of an additional Deputy Sheriff for
Frederick County, Virginia.
Accounts totaling $3,532.83 were approved and ordered to be
paid from the General County Fund by warrants numbers I2609 to 12652 inclusive and
Livestock, Fowl Claims and Earl Cather's Salary totaling $150.8I were approved and
ed to be paid from the Dog Fund by warrants numbers I159 to I164 inclusive.
