PRESENT: Planning Commissioners present were: James W. Golladay, Jr., Chairman; Beverly Sherwood, Vice Chairman; S. Blaine Wilson, Shawnee District; John Marker, Back Creek District; Carl M. McDonald, Gainesboro District; Marjorie H. Copenhaver, Citizen at Large; Todd D. Shenk, Citizen at Large; Roger L. Thomas, Citizen at Large; and Joseph Kalbach, City Liaison. Planning Staff present were: Kris C. Tierney, Deputy Planning Director; W. Wayne Miller, Zoning Administrator; Evan A. Wyatt, Planner II; and Lanny C. Bise, II, Planner I. ABSENT: Manuel C. DeHaven, Stonewall District; George L. Routine, Citizen at Large; and Kenneth Y. Stiles, Board Liaison. CALL TO ORDER Chairman Golladay called the meeting to order at 7:00 p.m. MINUTES Upon motion made by Mr. McDonald and seconded by Mr. Thomas, the minutes of September 18, 1991 were unanimously approved as presented. BIMONTHLY REPORT Chairman Golladay accepted the Bimonthly Report for the Commission's information. COMMITTEE REPORTS Rural Issues Subcommittee - 10/14/91 Mtg. Mr. Tierney reported that changes were made to the proposed Rural Area 3406 Regulations at the subcommittee's meeting and have been presented to the Planning Commission for public hearing at the November 6 meeting. Sanitation Authority - 10114/91 Mt, Mrs. Copenhaver reported that the Route 277 water line is in service; the Stephens Run Northern Loop water line is under construction; and the water treatment plant for the quarry is under design. The plans for expansion of Parkins Mill are with the State Water Control Board and financing has been applied for. Lots under construction were up after seven quarters of decline, however, the market is still down as compared to last year at this time. Historic Resources Advisory Board - 10/15/91 Mtg. Mr. Tierney reported that the committee discussed language for the Zoning Ordinance -- specifically, how historic sites should be handled if they are located on properties that come in for master development plan approval. He said that the committee agreed to have the staff resume work on creating a list of sites that might be designated by the Board of Supervisors as being locally significant as opposed to state or national designation. The Committee also discussed recommendations that were in the second phase of the architectural survey. Mr. Tierney said that the committee wants to endorse those recommendations and incorporate them into the Comprehensive Plan. Comprehensive Plan - 10/07/91 Mtg Mrs. Copenhaver said that discussion mainly centered around the Route 11 South business corridor. Subdivision Application of Forrest Brown, for E & R Enterprises, to divide 3.62 acres into two lots. This property, zoned B -2 (Business General), is located on the south side of Route 50, west of the 37 bypass, Back Creek District. Action - Approved Mr. Miller stated that the master development plan has been waived on this 3407 subdivision since the B2 property has less than ten acres, there are no new streets, and no changes will be made to any existing streets. He said that the staff recommends approval based on the condition that all review agency comments are addressed. Mr. Forrest Brown, the applicant, was present to answer questions. Upon motion made by Mr. Marker and seconded by Mrs. Copenhaver, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve the subdivision application for Forrest Brown /E & R Enterprises to divide 3.62 acres, zoned B2, into two lots. This property is identified as GPIN 52000OA000092B and is located on the south side of Route 50 in the Back Creek Magisterial District. Subdivision Application for Fredericktowne Estates, Sections 5, 6, and 7. This property, zoned RP (Residential Performance) is located east of Stephens City in the Opequon District. Action - Approved Mr. Miller said that the requested subdivision is in conformance with the master plan with the exception of the change in design of Sussex Circle. He said that this revision was made to reduce the number of driveways accessing Golladay Road. Mr. Miller said that the staff recommends approval with the condition that the comments of the Fire Marshal and the Consulting Engineer be adequately addressed. Mr. Duane Brown, Chief Land Surveyor, and Charles C. Maddox, Jr., Engineer, both from G. W. Clifford & Associates, were representing this subdivision application. Regarding the engineer's comments on the road structure, Mr. Maddox said that Golladay Road is a minor collector roadway and its structure and design are adequate for the present time and the foreseeable future. There next ensued a discussion on potential sedimentation and drainage problems in the open area northeast of Lots 5, 6, and 7 resulting from the development of future sections to the north. Mr. Maddox said that he does not foresee any drainage problems in that area. He said that they plan to leave the open area in its existing natural state, improve grading and drainage channels and install drainage pipe. He said that the roadway is planned for the ridgetop and houses will be constructed well above the existing channel. Mr. Maddox said that the open area is a designated easement and is not to be improved with structures of any type. Upon motion by Mr. Thomas and seconded by Mr. Wilson, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously 3408 4 approve the subdivision application of Fredericktowne Estates for sections 5, 6 and 7, zoned RP (Residential Performance). This property is identified as GRIN 75000OA0000072 in the Opequon Magisterial District. DISCUSSION REGARDING THE SIX -YEAR SECONDARY ROAD PLAN Action - Approval Mr. Wyatt presented the revised 1992 -1993 Six -Year Secondary Road Plan. Mr. Wyatt said that the Transportation Committee held a public meeting on October 7 and after receiving public input, revised the plan accordingly. Mr. Wyatt reviewed the plan with the Commission. Mr. Wilson inquired about Route 644, from 50 East to the Clarke County line. He said that the road is unpaved, has sharp turns and hills, and is becoming increasingly populated and hazardous. Mr. Wilson said that he was not necessarily advocating hard surfacing, but felt that cutting brush, cleaning ditches and putting down gravel would greatly improve the situation. Mr. Wyatt said that this section of road is included under major road improvements which would include not only hard - surfacing, but widening and engineering. He said that unfortunately, it was #25 on last year's plan and is #24 on this year's plan. Mr. Wyatt said that he would send a recommendation to the state to at least get some maintenance accomplished. Mr. McDonald felt that #2, Route 734, from 522N to 1.55 mile south of 522, and #21, Route 734, the addition of one mile, should not be separate items. Mr. Wyatt said that this section was either added on at a later date or there are problems acquiring right -of -way or engineering studies have not yet been finished on that section. Chairman Golladay suggested that for next year's review, the staff add a list of projects that have been dropped and the reasons, so that the Commission can actually see what has been accomplished. There was no public comment. Upon motion made by Mr. McDonald and seconded by Mr. Wilson, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously endorse the revised 1992 -1993 Six -Year Secondary Road Plan as presented by the Transportation Committee. 3409 5 DISCUSSION REGARDING THE PROPOSED REVISIONS TO THE RURAL AREA REGULATIONS Mr. Tierney said that the Rural Issues Committee has been working on a proposal for revisions to the land use regulations in the rural area of the County for the past two years. He said that the Committee has met with a number of local groups, including the Isaac Walton League, Citizens for a Quality Community, and the Top of Virginia Builders Association and an informational meeting was held for the general public. Mr. Tierney said that the purpose of the regulations is an effort to preserve the rural character of the County. Mr. Tierney reviewed the regulations with the Commission. Some of the highlights were: A reduction of the minimum lot size from five acres to two acres; density remains the same at one unit per five acres - -land that is not buildable will not be counted as acreage towards permitted density; family lots of two or more acres are permitted and would not count against density; lots of five acres or more would be permitted on parcels containing 20 acres or less; 40% of the gross acreage of any parcel has to remain in a contiguous, buildable lot for a period of 25 years; if, after the 25 year period, the Comprehensive Plan calls for some use other than open area in the area of the 40% parcel, equivalent acreage must be provided in another location of the county where open space is the goal; setback requirements are variable with the goal being to space homes farther apart and set farther back off the road; establishment of aggressive setbacks on lot perimeters adjacent to agricultural uses. The main issue of discussion among the Commissioners was the section on the 40% parcel remaining as an undividable lot for a 25 -year period. Upon motion by Mrs. Copenhaver and second by Mr. Wilson, the Commission decided by majority vote to advertise the rural area regulations for public hearing on November 6, 1991. Rinker WHEREAS, Douglas C. Rinker served on the Frederick County Planning Commission with dedication, professionalism and insight from February 15, 1989 to October 1, 1991; and, WHEREAS, during his tenure, the Frederick County Planning Commission did make great strides towards building a better future for the people of Frederick County; and, WHEREAS, the members of the Frederick County Planning Commission wish to encourage Douglas C. Rinker to remain active in community affairs and to continue to provide his insight to the Commission; NOW, THEREFORE, BE IT RESOLVED, That on this 16th day of October 1991, the Frederick County Planning Commission does express its deep appreciation and gratitude to Douglas C. Copenhaver STUDY OF ALTERNATIVE WASTEWATER TREATMENT; RURAL COMMUNITY CENTERS Mr. Tierney said that the County, with assistance from the Planning District Commission, applied for and received grant funds to examine possible methods for treating wastewater in rural communities. He said that a tentative schedule for the study has been prepared and includes an organizational meeting of a Technical Advisory Committee (TAC) in November. The staff suggested November 12 as the first meeting date and requested that the Commission appoint a representative to serve on the TAC. 3411 7 ADJOURNMENT No further business remained to be discussed and the meeting adjourned at 8:40 p.m. by unanimous vote.
