HomeMy WebLinkAboutPC_05-20-87_Meeting_MinutesMINUTES OF THE MEETING OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board of Supervisors' Meeting Room in the Old Frederick County Court House, 9 Court Square, Winchester, Virginia, on May 20, 1987. PRESENT: Frank H. Brumback, Chairman; James W. Golladay, Jr., Vice - Chairman; Marjorie H. Copenhaver; Kenneth Y. Stiles; A. Lynn Myers; S. Blaine Wilson; Carl M. McDonald; Robert W. Watkins, Secretary; Stephen M. Gyurisin, Advisory. ABSENT: Manuel C. DeHaven, George L. Romine CALL TO ORDER Chairman Brumback called the meeting to order at 2:00 p.m. MINUTES P The first order of business was the consideration of the minutes of May 6, 1987. Upon motion made by Mr. Golladay and seconded by Col. Myers, the minutes of May 6, 1987 were unanimously approved as presented. BIMONTHLY REPORT Mr. Gyurisin presented two requests for administrative approval. The first was an addition to the Dowell J. Howard Vocational School. The second request was from Perry Engineering Company for expansion of existing offices. Chairman Brumback instructed the staff to proceed with administrative review and approval. Mr. Wilson and Mr. Golladay abstained from discussion on the Perry Engineering request due to a possible conflict of interest. Mr. Gyurisin next presented, for informational purposes only, additional sections to the Blue Ridge Mobile Home Park. Mr. Gyurisin noted that the new sections were in conformance with the overall site plan. COMMITTEE REPORTS Sanitation Commission Mrs. Copenhaver, liaison to the Sanitation Commission, presented the Commission with a copy of the overflow /bypass and average flow for 1987. 2432 - 2 - She reported from the Sanitation Commission that their solution is to upgrade Lakeside and be aggressive in repairing inflow as fast as the problems are found. She also reported that the plant does operate efficiently, but has too much flow. Mr. Stiles said that he and Mr. Riley met with Mr. Jones, subsequent to the Sanitation Authority meeting, to discuss the matter and they are satisfied that progress is being made as fast as possible. INTRODUCTION OF ASSISTANT COUNTY ADMINISTRATOR John R. Riley, Jr., County Administrator, introduced the Commissioners to the newly hired Assistant County Administrator, Stephen Owen. Mr. Riley said that Mr. Owen will be dealing with capital infrastructure such as airport, water and sewer, landfill, jail, and all other areas on the capital improvements plan. SITE PLANS Site Plan 11021 -87 of Landmark Chapel Church for a church, parking, access, and site improvements in the Stonewall Magisterial District. Action - Approved Mr. Watkins noted that the proposed church will be 80' X 40' with a single entrance on Route 11 North. He said that there is substantial parking, however, car stops are needed in areas without curbing. Mr. Watkins said that the proposal is on public water, but not on public sewer. He added that the Fire Code has been met. Mr. Carl Nester, representative for this site plan, stated that the Highway Department requested a 40' entrance instead of a 30' entrance and they had no problems with that change. Upon motion made by Mr. Stiles and seconded by Mr. Golladay, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously approve Site Plan 11021 -87 of Landmark Chapel Church for a church, parking, access, and site improvements. This property is located 0.75 miles north of US Route 11 in the Stonewall Magisterial District. RESOLUTION ON THE SHENANDOAH WATER SUPPLY PLAN Mr. Watkins stated that the State Water Control Board has asked the County for a resolution supporting the Shenandoah Water Supply Plan that they have prepared. He said that the Board of Supervisors has requested a 2433 - 3 - recommendation from the Planning Commission. Mr. Watkins said that based on the Commission's discussions at their worksession, the staff drafted the following resolution. Upon motion made by Mr. Colladay and seconded by Mr. Wilson, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously support the following resolution: SHENANDOAH WATER SUPPLY PLAN RESOLUTION WHEREAS, the Virginia Water Control Board is developing water supply plans for each river basin in the State; and WHEREAS, the Virginia Water Control Board has developed a draft of the Shenandoah Water Supply Plan; and WHEREAS, the County of Frederick has had the opportunity to provide input and comments into the planning process through a local representative on an advisory committee: THEREFORE, BE IT RESOLVED, that the County of Frederick commends the Virginia Water Control Board on its water supply planning efforts and endorses continuing a planning process, as a cooperative effort between local governments and the Water Control Board, to meet the future needs of the Shenandoah Valley; and BE IT FURTHER RESOLVED, that planning for water supply must be a part of local comprehensive planning and that planning at the state level must not limit local options; and BE IT FURTHER RESOLVED, that the County continues to be concerned about the capacity of existing water sources in relation to growing local needs, and about the potential for the transfer of water to users outside the Shenandoah Valley; and BE IT FURTHER RESOLVED, that the County emphasizes the need to examine all potential sources of water supply and to develop plans for alternative sources. Stiles, Chairman Frederick County Board of Supervisors 2434 - 4 - DISCUSSION ON GROUP HOME USE IN THE RP DISTRICT John R. Riley, Jr., County Administrator, stated that it was brought to his attention that under the RP section of the zoning ordinance, group homes currently require a conditional use permit. Mr. Riley felt this was not the intent of the Board when the old R -1, R -2, and R-3 sections of the zoning ordinances were in effect. Mr. Riley said that during the public hearing when the Planning Commission and Board acted on this petition, they acted on it as a permitted use, not one with a conditional use permit. With this in mind, Mr. Riley said that the County Administrator's office advertised this for public hearing for the Commission and Board to correct the ordinance and return it to the way it was in the ordinance as a permitted use. He added that group homes should be regulated as other residential uses and not regulated with any additional public hearing requirements. --------------------- RMS HOMEOWNERS' ASSOCIATION FOR ZONING Mr. Watkins said that the Dundridge Farms Homeowners' Association is requesting an amendment to the A -1 and A-2 Agricultural Zoning Districts so that group homes are required to have a conditional use permit rather than be a permitted use. Mr. Watkins stated that there is specific language in the Virginia Code addressing the issue of group homes. He said that the Virginia Code states that, ..physically handicapped /mentally ill or other developmentally disabled persons should not be excluded by the County or Municipal Zoning Ordinance from the benefits of normal residential surroundings..." Mr. Watkins said that due to the specificity of the State Code language, the staff recommends that more research be done on this matter and that this item be scheduled for discussion at a worksession. Mrs. Patricia Stiles came forward to speak in favor of allowing group homes as a permitted use in the Residential Zoning Districts. Mrs. Stiles said that five years ago when she addressed the Commission and Board on this matter, it was the intent of the Commission and Board at that time to allow group homes as defined as a permitted use. She urged the Commission to return the ordinance to the way they originally intended, which was to allow group homes as a permitted use in all of the residential districts. Mrs. Stiles said that the language in the Virginia State Code encourages and promotes the dispersion of group homes and encourages them to be proportional to the population. She added that Frederick County has only one group home at the present time and there definitely is a need for them. 2435 - 5 - 104 Mr. Watkins said that the staff has recieved a request from Potomac Edison Company to reconstruct a portion of its 138 kV line between their Vaucluse and Meadow Brook Substations. Mr. Watkins noted that they will be going from a single transmission line to a double transmission line and installing larger towers to accomodate the double line. Mr. Watkins added that this request is for informational purposes only because it is a reconstruction of an existing line. Mr. Jay Wetzel, counsel for the Potomac Edison Company, was present to answer questions. INTRODUCTION OF BRAY COCKERILL, PLANNER I Mr. Watkins introduced Bray Cockerill, the newly hired Planner I, who will be working in the Planning Department. Mr. Watkins said that Mr. Cockerill will be involved in zoning, transportation, and comprehensive planning. OTHER Chairman Brumback next discussed with the other commissioners their feelings on the involvement of the Commission in reviewing routine items, such as conditional use permits, minor site plans, etc. ADJOURNMENT There being no other business to discuss, the meeting adjourned.
