HomeMy WebLinkAboutPC_10-05-83_Meeting_MinutesMINUTES OF THE MEETING OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board of Supervisors' Meeting Room on October 5, 1983. PRESENT: Frank Brumback, Chairman; James Golladay, Vice - Chairman; George L. Romine; W. French Kirk; A. Lynn Myers; Manuel C. DeHaven; Kenneth Y. Stiles; Marjorie H. Copenhaver; John T. P. Horne, advisory; Stephen M. Gyurisin, advisory ABSENT: Carl M. McDonald CALL TO ORDER Chairman Brumback called the meeting to order at 7:00 p.m. The first order of business was the consideration of the minutes of September 21, 1983. Motion was made by Mr. Golladay, seconded by Mr. Kirk, and passed unanimously to approve the minutes as presented. BIMONTHLY REPORT The staff reviewed pending applications with the Commission. DISCUSSION OF COMPOSITION OF RURAL ORDINANCE SUBCOMMITTEE Mr. Horne stated that the Ordinance Subcommittee will soon begin work on the ordinances dealing with the rural development areas of Frederick County. Mr. Horne stated that in order to solicit opinions from a wide range of interests, the Subcommittee would like to include as members on the committee some individuals from local groups that have expressed an interest in the general topic of rural development. The Commission recommended that one representative from each of the following groups be included in the subcommittee as 1811 - 2 - nonvoting consultants: Frederick County Farm Bureau, Extension Homemakers, Blue Ridge Board of Realtors, Local Homebuilders DISCUSSION OF ROAD DESIGNATION FOR OVERSIZED TRAILERS Mr. Horne stated that a request was made by a local trucking industry to have certain sections of highway designated for use of double wide trailers. The specific roads requested are: Route 522 South (approximately one mile south of Route 50 East); Route 50 East (to Route 728); the north side of Route 11 (from Route 81 to the city limits) and the south side of Route 11 (from Route 37 to the city limits). Mr. Bushman of the Virginia Department of Highways and Transportation stated that special permits may be issued by the Highway Department to individuals wishing to use roads not already designated for double wide trailers. Mr. Bushman said that he and Mr. Diamond drove on the roads requested in this particular case and determined that Routes 522 South and 50 East would be adequate for use, however, Routes 11 North and South would not be adequate. He added that Route 11 North and South is adequate for single bottom trailers. The Commission directed the staff to gather more information from the Highway Department and local industries to determine all local needs. The Commission also requested that the Virginia Department of Highways and Transportation forward to the Commission all requests for special permits for twin trailers on county roads not designated under the existing system. 1812 - 3 - PUBLIC HEARINGS Rezoning Application #016 -83 of George T. McCumbee to rezone 1.558 acres from B -2 (Business, General) to B -3 (Industrial, Transition) for mobile home and recreational vehicle sales and service. ACTION - Denied Mr. Horne read the background material. Mr. Richard Ambrose, partner of Mr. McCumbee, came forward and introduced himself to the Commission. Mr. Ambrose stated that the B -2 zone accomodates the sale of travel trailers but because sales of RVs are mainly seasonal, they decided to also sell mobile homes. Mr. Ambrose said that they are committed to erecting screening and /or fencing to enhance the appearance of the property. Chairman Brumback called for anyone wishing to speak in opposition to the rezoning and the following people came forward: Mr. John E. Hoover, adjoining property owner, located directly across the street, came forward and introduced himself to the Commission. Mr. Hoover was concerned about devaluation of his property and whether the property would be screened on the side facing him. Mr. Paul L. Barbour, adjoining property owner, was concerned about the devaluation of his property. Mrs. Helen Hodges, adjoining property owner, stated that her home plays an important role in Frederick County history. Mrs. Hodges stated that for the past three years they have been actively restoring their home to its original appearance and they were concerned that an establishment of this type would take away from the character of the Roundhill community. Mr. Timothy Hodges, husband of Mrs. Hodges, felt that a B -3 1813 - 4 - rezoning would set a precedent for similiar rezonings in the area. Mr. Hodges felt that preservation of the rural character of the community was important. There being no one else wishing to speak in opposition, Mr. David Soper, owner of the property, came forward. Mr. Soper stated that he is not trying to upset the neighborhood, but he would like to see a business operation at this location. Mr. Stiles asked Mr. Horne to read the list of permitted uses in a B -2 zone. After some discussion, Mr. DeHaven moved for denial of this rezoning. This motion was seconded by Mr. Kirk. BE IT RESOLVED, That the Frederick County Planning Commission does hereby deny rezoning request #016 -83 of George T. McCumbee to rezone 1.558 acres in the Back Creek District for a mobile home and recreational vehicle sales and service operation. The vote on the above resolution was as follows: YES: Mrs. Copenhaver, Messrs. Stiles, Myers, Brumback, Golladay, DeHaven, Kirk NO: Mr. Romine REVIEW OF AMENDMENTS TO M -1 ZONING REGULATIONS Mr. Horne presented a letter from Mr. Donald Shockey requesting an amendment to the M -1 zoning regulations to allow certain types of office facilities within the M -1 (light industrial) districts. Mr. Horne stated that this would include offices whose daily traffic consists only of employees, such as corporate headquarters, and preclude those that may have general daily contact with the public, such as a dental office. Mr. Horne added that this amendment will be heard as a public hearing on October 19, 1983 and 1814 - 5 - no action is needed by the Planning Commission until then. COMMISSION RETIRES TO EXECUTIVE SESSION Upon motion by Mr. Stiles, seconded by Mr. DeHaven and passed unanimously, the Frederick County Planning Commission retired into executive session in accordance with the Freedom of Information Act, Section 2.1- 344.4. This section deals with discussions concerning prospective businesses or industries where no previous announcement has been made of the business or industry interested in locating in the community. COMMISSION WITHDRAWS FROM EXECUTIVE SESSION Motion was made by Mr. Golladay, seconded by Mr. Stiles and passed unanimously to withdraw from executive session.
