OF THE
FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors' meeting room on July 20, 1983.
PRESENT: Frank Brumback, Chairman; James Golladay, Vice - Chairman; Carl
M. McDonald; A. Lynn Myers; Manuel C. DeHaven; W. French
Kirk; George L. Romine
ABSENT: Kenneth Y. Stiles
CALL TO ORDER
Chairman Brumback called the meeting to order at 2:00 p.m.
The first order of business was the consideration of the
minutes of July 6, 1983. Motion was made by Mr. Golladay, seconded by
Mr. Kirk, and passed unanimously to approve the minutes of July 6,
1983, as presented.*
*Mr. Romine was not present for this vote.
MONTHLY AND BIMONTHLY REPORTS
Mr. Horne explained that the Conditional Use Permit for Yusuf
Ali will be heard again by the Planning Commission on August 3, 1983
because all adjoiners were not notified at the first public hearing.
The staff and Commission then reviewed pending applications.
Discussion on Day Care Centers in Residential Zoning Districts
Mr. Horne stated that the State Welfare Department has divided
day care centers into three levels.
Mr. Gyurisin described three levels and gave the staff's
feelings on how each level should be treated with regard to zoning
regulations:
Level 1, In -home Day Care Center, consisting of less than five children
would be considered as a home occupation.
Level 2, Family Day Care Center, consisting of nine or less children
and would require a conditional use permit.
Level 3, Day Care Center, for ten or more children would require a B -1
or B -2 zoning category.

The Commission requested the staff to draft an ordinance based
on day care center state requirements for the Commission's
consideration.
Conditional Use Permit #OOB -83 of R. D. Brown /Bauserman Oil Company,
Inc. for an off - premises highway sign.
ACTION - Tabled
Mr. Horne stated that the applicant has not submitted
sufficient plans to indicate the nature of the signs proposed.
Mr. Robert Brown, applicant, came forward and introduced
himself to the Commission. Mr. Brown stated that he did not have a
particular type or size of sign in mind as of this time, but he wanted
first to determine what was feasible or reasonable from both the
state's and locality's viewpoint.
The Commission felt that Mr. Brown should present a proposal
for exactly what he intended for the mobile signs, ie. dimensions,
lettering, type of vehicle. The Commission did not feel they could
consider Mr. Brown's application until this was done.
Upon motion by Mr. DeHaven, seconded by Mr. McDonald, and
passed unanimously,
BE IT RESOLVED, That the Frederick County Planning Commission does
hereby table Conditional Use Permit #008 -83 of R. D. Brown /Bauserman
Oil Company, Inc. for an off - premises highway sign, due to the lack of
sufficient data submitted by the applicant.
Site Plan #013 -83 of Quik Stop, zoned B -2 (Business, General), for a
convenience grocery store on an existing commerical site in the Shawnee
District.
ACTION - Approved
Mr. Horne gave the background information.

Ms. Pam Throckmorton came forward and introduced herself to
the Commission. Ms. Throckmorton stated that the existing building
will be used for storage and the new building will be for grocery and
gift items.
In answer to Mr. Kirk's question, Mr. Horne stated that the
building will be 36' x 84'.
Upon motion by Mr. Kirk, seconded by Mr. Romine, and passed
unanimously,
BE IT RESOLVED, That the Frederick County Planning Commission does
hereby approve Site Plan #013 -83 of Quik Stop for a convenience grocery
store on an existing commerical site with required parking in the
Shawnee District.
Priority List for Road Surfacing Projects
Mr. Horne presented a list compiled by the Virginia Department
of Highways and Transportation listing all roads in Frederick County
which were eligible for hard - surface funds through the Six Year Plan.
The Commission discussed possible roads from the list to be
included in the revised list of hard - surfacing projects for the Six
Year Plan. The Commission concluded that the following roads should be
included: Routes 673, 629, 851, 676, and 696.
Planning Commission Appointment to Economic Development Commission
Chairman Brumback asked Mr. McDonald if he would fill out the
unexpired term of Mr. Palumbo on the Economic Development Commission.
Mr. Palumbo had submitted his resignation from the Planning Commission
and the Economic Development Commission.
Mr. McDonald replied that he would accept the appointment.

ADJOURNMENT
There being no further business to discuss, the meeting
adjourned.
