PRESENT: Frank Brumback, Chairman; James Golladay, Jr., Vice - Chairman; Carl M. McDonald; Kenneth Y. Stiles; A. Lynn Myers; Manuel C. DeHaven; W. French Kirk; M. Domenic Palumbo ABSENT: George L. Romine CALL TO ORDER Chairman Brumback called the meeting to order at 7:00 p.m. The first order of business was the consideration of the minutes of March 16, 1983. Mr. Myers moved for approval of the minutes as presented. This motion was seconded by Mr. Palumbo and passed unanimously.* *Mr. Stiles was not present for this vote. MONTHLY AND BIMONTHLY REPORT Mr. Gyurisin reviewed pending Board of Zoning Appeals applications with the Commission. Col. Myers noted that when the Planning Commission initially approved Mr. Robert Brown's conditional use permit, he was not intending to draw traffic from I -81. Col. Myers noted that the Health Department had approved his permit assuming that Mr. Brown would have a small, local filling station. The Commission requested that Mr. Gyurisin express their concerns to the Board of Zoning Appeals. SITE PLANS Site Plan #003 -83 of Delco Plaza Shopping Center, zoned B -2 (Business, General) in the Shawnee Magisterial District for an electronics store. ACTION - Approved Mr. Horne read the background material. Mr. David Smith, representative for the site plan, came forward. In answer to Mr. Palumbo's question, Mr. Smith stated that the building will contain 3,750 square feet. 1708 -2- In answer to Mr. DeHaven's question, Mr. Smith stated that the building will be about 15' -16' in height going back about 40' and from there the building is taller to accomodate a small second story storage area. Mr. Golladay asked if this was a private enterprise and Mr. Smith replied that this site is for Sound City. He noted that they are expanding on their existing operation. The Commission expressed concern about Mr. Smith's proposal for diagonal parking along the side of the building. Commission members felt that parking in this area would only add to the existing congestion at this entrance to the shopping center. They felt the parking in the rear, as it appeared on the site plan, was satisfactory. Mr. Kirk moved to approve the site plan as presented and this was seconded by Mr. Palumbo. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Site Plan #003 -83 of Delco Plaza Shopping Center, zoned B -2 (Business, General), in the Shawnee Magisterial District for an electronics store. The above resolution passed unanimously. Site Plan #004 -83 of High's Store, zoned B -1 (Business, Limited), in the Opequon Magisterial District for the addition of gasoline pumping facilities to the existing convenience store, the addition of approximately 4,950 square feet of paving, and to widen the existing entrance. ACTION - Approved Mr. Horne gave the background information. Mr. Bruce Edens, representative for the application, came forward. 1709 -3- Mr. Golladay suggested that Mr. Edens redirect the night lighting on the parking lot because of its tendency to reflect off the store window and cause glare for drivers. Upon motion by Mr. Golladay and seconded by Mr. Stiles, BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Site Plan #004 -83 of High's Store, zoned B -1 (Business, Limited), in the Opequon Magisterial District for the addition of gasoline pumping facilities to the existing convenience store, the addition of approximately 4,950 square feet of paving, and to widen the existing entrance. The above resolution passed unanimously. Site Plan #005 -83 of CEDE Warehousing, zoned M -1 (Industrial, Limited), in the Stonewall Magisterial District to construct one 28,800 square foot warehouse with a 3,600 square foot concrete apron. ACTION - Approved Mr. Horne gave the background material and also noted that this warehouse is an addition to an existing site with three other large metal warehouses. Mr. Douglas Toan, part owner of the project, came forward and introduced himself to the Commission. Chairman Brumback inquired if the building would have plumbing facilities and Mr. Toan replied that it would not; the building is strictly dry storage. He noted that buildings one and two have plumbing facilities. Mr. Kirk asked if there would be any personnel on the site. Mr. Toan stated that a tow motor man will be there from 7:00 a.m. to 3:00 p.m. and trucks will be in and out to unload storage items. Mr. Golladay asked Mr. Toan how many warehouses were proposed on his original site plan for this area. 1710 -4- Mr. Toan noted that the original site plan was a five acre site and only three buildings were permitted. This new warehouse is being placed on an additional two acres adjoining the property that was recently purchased. Upon motion by Mr. Stiles, seconded by Mr. Palumbo, BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Site Plan #005 -83 of CEDE Warehousing, zoned M -1, (Industrial, Limited), in the Stonewall Magisterial District to construct one 28,800 square foot warehouse with a 3,600 square foot concrete apron. The above resolution passed unanimously. PUBLIC HEARINGS Rezoning Petition #004 -83 of Dennis N. Thompson to rezone 1.33 acres now zoned B -1 (Business, Limited) to B -2 (Business, General) in the Opequon Magisterial District for a car wash, laundromat, gas station, grocery store, real estate office, possible restaurant, and owner/ operator's living quarters, and possible construction of a second story. Mr. Horne gave the background information. Mr. Dennis Thompson, applicant, came forward. Chairman Brumback called for anyone wishing to speak in favor or opposition to this rezoning. Mr. John Funkhouser, adjoining property owner, felt there was less than 1.33 acres at the site. Mr. Horne noted that this is the amount carried on the tax records. Mr. Golladay felt that Mr. Thompson's plans would be an improvement to the site. Mr. Golladay moved for approval and this motion was seconded by Mr. Palumbo. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Rezoning Petition #004' -83 of Dennis N. Thompson to rezone 1.33 acres now zoned B -1 (Business, Limited) to B -2 (Business, General) in the Opequon Magisterial District for a car wash, laundromat, gas station, grocery store, real estate office, possible 1711 -5- restaurant, and owner /operator's living quarters, and possible construction of a second story. The above resolution passed unanimously. Conditional Use Permit #002 -83 of Glenwood Nicholson for an off -site advertising sign in the Stonewall Magisterial District. ACTION - Approved Mr. Horne read the background information. Mr. Glenwood Nicholson, owner of the property, came forward. Mr. Nicholson was concerned that his sign permit could be cancelled in a year's time because of the annual review. He noted that he would have about $1,200 in this sign. Mr. Horne noted that the only reason for cancelling the sign would be because maintenance was neglected and it became unsightly. There being no one in the audience wishing to speak in favor or opposition to this request, Mr. DeHaven moved for approval with the conditions listed under staff recommendations. This motion was seconded by Mr. Kirk. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Conditional Use Permit #002 -83 of Glenwood Nicholson for an off -site advertising sign in the Stonewall Magisterial District with the following conditions: 1. This be a one year permit to be renewed annually by the staff, Planning Commission, and the Board of Supervisors. 2. If the use, occupancy, or ownership of the property changes, this conditional use permit shall expire and a new conditional use permit will be required. The above resolution passed unanimously. Conditional Use Permit #003 -83 of Chester S. Webber for a Cottage Occupation /Small Engine Repair in the Stonewall Magisterial District. ACTION - Approved 1712 cm Mr. Horne read the background material. Mr. Webber came forward and introduced himself to the Commission. In answer to Mr. Stiles' question, Mr. Webber said there would be no outside storage. In answer to Mr. Palumbo's question, Mr. Webber said that there was a complete building lot between his property and the nearest residence. Mr. Stiles asked that condition #4 be added to read "on -site parking to be provided ". There being no one present to speak in favor or opposition to this application, Mr. Stiles moved for approval of the application with the conditions discussed. This motion was seconded by Mr. DeHaven. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Conditional Use Permit #003 -83 of Chester S. Webber for a Cottage Occupation /Small Engine Repair in the Stonewall Magisterial District with the following conditions: 1. This be a one year permit to be renewed annually by the staff, Planning Commission, and the Board of Supervisors. 2. If the use, occupancy, or ownership of the property changes, this conditional use permit shall expire and a new conditional use permit will be reauired. 3. All outside storage must be fully screened from adjacent residential properties. 4. On -site parking to be provided. The above resolution passed unanimously. An ordinance to amend the Frederick County Code, Chapter 21, Zoning, Section 21 -14(3) allowing for Cottage Occupation signs, not to exceed four (4) square feet. ACTION - Approved 1713 -7- There being no one present wishing to speak in opposition, Mr. Stiles moved to approve the amendment. This motion was seconded by Mr. Golladay. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the ordinance to amend the Frederick County Code, Chapter 21, Zoning, Section 21 -14(3) to substitute the following for the existing section as follows: (3) Cottage Occupation Sign: A sign not exceeding four (4) square feet in area directing attention to a product, commodity, or service available on the premises in conjunction with an approved conditional use permit for a cottage occupation. The above resolution passed unanimously. An ordinance to amend the Frederick County Code, Chapter 21, Zoning, Section 21 -120 by the addition of (j) and Section 21 -121 by the deletion of (a); to provide for temporary office and storage trailers in the M -1 District as a permitted use. ACTION - Approved There being no one wishing to speak in opposition to this amendment, Mr. Stiles moved for approval and this was seconded by Mr. Golladay. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the ordinance to amend the Frederick County Code, Chapter 21, Zoning, Section 21 -120 by the addition of (j) as follows and Section 21 -121 by the deletion of (a): (j) Temporary office trailers or storage trailers, provided there is no residential use of the trailer and the trailer is removed from the property at the time of issuance of the Final Certificate of Occupancy. The above resolution passed unanimously. An ordinance to amend the Frederick County Code, Chapter 21, Zoning, Section 21 -127.1 by the deletion of (j) to provide for temporary office and storage trailers in the M -2 District as a permitted use. ACTION - Approved 1714 There being no one wishing to speak in opposition to this amendment, Mr. Stiles moved for approval and this was seconded by Mr. Golladay. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the ordinance to amend the Frederick County Code, Chapter 21, Zoning, Section 21 -127.1 by the deletion of (j). The above resolution passed unanimously. Each conditional use permit has either been rezoned to a category that places regulations on the use which were not on that use when it had its conditional use permit, or there have been changes in the internal regulations of the zoning district in which the use is placed so as to make it unnecessary to have a conditional use permit as well as being a permitted use in that zoning district. CANCELLATION OF INACTIVE CONDITIONAL USE PERMITS CUP Approved District 002 -80 - Roadway Express 6/25/80 Back Creek This conditional use permit is being cancelled due to the fact that the permit has never been used. ACTION - Approval to cancel all permits There being no one present wishing to speak in opposition to these cancellations, Mr. Stiles moved for approval of the cancellations. This motion was seconded by Mr. Golladay. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the cancellation of conditional use permits approved in existing commerical, industrial, and mobile home zoning districts and the cancellation of inactive conditional use permits. The above resolution passed unanimously. 1716 -10- Changes in conditions of conditional use permits on the following permits: CUP Approved District 005 -80 - Robert & Betty Kerns 009 -82 - James M. Horton, Ent. 019 -81 - Craig & Seri Kern 6/11/80 Gainesboro 5/26/82 Back Creek 1/20/82 Gainesboro Mr. Wayne Kerns, owner of Wayne's Garage, came forward. Mr. Kerns wanted the Commission to delete condition #3, hours of operation, from his permit. Mr. Kerns stated that his garage sits in the middle of 30 acres and his family owns all the adjoining land. Mr. Kerns also wanted condition #1, outside storage of inoperable vehicles shall not exceed four vehicles, to be changed. Mr. Kerns stated he needed to increase the number of vehicles stored outside because of his towing operation. He stated that if he disposed of the cars immediately he would lose money on towing fees. The Commission next discussed with Mr. Kerns the specifics of his operation. Chairman Brumback called for anyone wishing to speak either in favor or opposition to the renewal and /or change in conditions of this permit. No one came forward. Upon motion by Col. Myers, seconded by Mr. Stiles, BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the renewal of Conditional Use Permit #005 -80 of Robert and Betty Kerns for a Public Garage /Towing Service in the Gainesboro Magisterial District with the following conditions: 1. No more than five motor vehicles of any kind which are not capable of being operative and which would not be economically profitable to make operative may be placed on the property at any one time. 2. All outside storage shall be adequately screened. 3. The applicant is authorized to operate a towing business on these premises. 1717 4. If the use, occupancy, or ownership of the property changes, this conditional use permit shall expire and a new conditional use permit will be required. 5. This conditional use permit shall be a one year permit and shall be reviewed annually by the staff, Planning Commission, and the Board of Supervisors. The above resolution passed unanimously. Mr. James Horton came forward. Mr. Horne felt that condition #5, noise - screening, was not necessary because the go -carts are not noisey. Mr. Horton explained that the new building he is proposing will be divided by a block wall. The front of the building will be a ticket selling area, snacks and drink area, and video game arcade. The front of the building will have a patio with picnic tables. The rear of the building will be for storage and repair of the go- carts. Mr. DeHaven asked if vault priveys were still required as per condition #4. Mr. Horne noted that Mr. Horton has installed permanent bathroom facilities. Upon motion by Mr. Stiles, seconded by Mr. Golladay, BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the renewal of Conditional Use Permit #009 -82 of James M. Horton, Ent. for a Recreational Fun Cart Track with the following conditions: 1. This conditional use permit will be a one year permit and shall be reviewed annually by the staff, Planning Commission, and the Board of Supervisors. 2. If the use, occupancy, or ownership of the property changes, this conditional use permit shall expire and a new conditional use permit will be required. 3. All night lighting to be directed away from adjacent properties. The above resolution passed unanimously. Craig and Seri Kern next came forward. 1718 -12- Mrs. Kern stated that they wished to expand their current facilities by building a ten -run kennel in a 40' x 50' block building on an adjacent piece of property that they had recently purchased. After some discussion, the Commission felt that this expansion was significant enough to require another conditional use permit in order to review plans and notify adjoining property owners. Upon motion by Col Myers, seconded by Mr. McDonald, BE IT RESOLVED, That the Frederick County Planning Commission does hereby require that Craig and Seri Kern submit a new conditional use permit for the expansion of their kennel operation as the expansion is significant enough that it can not be handled under the original application. The above resolution passed by the following majority vote: YES: Messrs. McDonald, Palumbo, Stiles, Myers, Kirk, Brumback No: Messrs. Golladay, DeHaven Renewal of the expired Conditional Use Permit #017 -79 of Denny's, Inc., approved on September 26, 1979, in the Stonewall Magisterial District. ACTION - Approved Upon motion by Mr. Stiles, seconded by Mr. DeHaven, BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the renewal of Conditional Use Permit #017 -79 of Denny's, Inc. with the following conditions: 1. This will be a one year permit to be reviewed annually by the staff, Planning Commission, and the Board of Supervisors. 2. If the use, occupancy, or ownership of the property changes, this conditional use permit shall expire and a new conditional use permit will be required. The above resolution passed unanimously. PREALLOCATION HEARINGS FOR PRIMARY HIGHWAYS TO BE HELD ON APRIL 15, 1983, STAUNTON, VA Upon motion by Mr. Stiles, seconded by Mr. Golladay, BE IT RESOLVED, That the Frederick County Planning Commission does hereby move to encourage the Board of Supervisors to make a statement to be made available at the preallocation hearings and /or to have the Chairman of the Board of Supervisors or other members attend that meeting to obtain funding for the addition of two lanes to Route 522 South from Double Tollgate to the Delco Plaza area and Route 522 North from Cross Junction to the West Virginia line.
