OF THE
FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors' Meeting Room on October 20, 1982.
PRESENT: Frank Brumback, Chairman; James Golladay, Vice - Chairman;

ABSENT: Manuel DeHaven; M. Domenic Palumbo
CALL TO ORDER
,Chairman Brumback called the meeting to order.
The first order of business was the consideration of the
minutes of October 6, 1982. There being no corrections, Mr. Golladay
moved for approval. This was seconded by Mr. Kirk and passed
unanimously.
BIMONTHLY
Mr. Gyurisin stated that all of the 19 lots belonging to
Orpha G. Martin were approved for variance by the Board of Zoning
Appeals on October 19, 1982.
After a brief discussion on the number of building permits
approved for zoning, Chairman Brumback accepted the Bimonthly and
Monthly Reports as information only.
SITE PLANS
Site Plan Request #018 -82 of Frederick Homes, Inc., zoned B -3
(Industrial- Transition), for the construction of a mobile home sales
office; storage of mobile and modular homes for sale; and off - street
parking facilities in the Back Creek Magisterial District.
ACTION - Approved
Mr. Horne read the background information.
In answer to Chairman Brumback's question, Mr. Horne stated
that the site consists of slightly less than one acre.

Mr. Donald Fowler came forward and introduced himself to the
Commission. Mr. Fowler stated that he leases this property from
Frederick Homes.
In answer to Mr. Romine's question, Mr. Fowler replied that
this will be a sales operation.
Mr. Golladay asked if all three mobile homes on the site were
attached permanently to the ground. Mr. Fowler replied that they were
temporarily attached to the ground so they can be sold within eight to
twelve months.
Mr. Kirk asked if a well was being drilled on the site.
Mr. Fowler stated that it was. He also noted that even though city
water runs across the road, the Highway Department may not grant them
the right to cut through the pavement to extend the water line.
In answer to Mr. Golladay's question, Mr. Horne replied that
this site is located on the northern corner of the B -3 zone.
There being no further discussion, Mr. Stiles moved to
approve the site plan. This was seconded by Mr. Romine.
BE IT RESOLVED, That the Frederick County Planning Commission does
hereby approve Site Plan Request #018 -82 of Frederick Homes, Inc.,
zoned B -3 (Industrial - Transition), to construct a mobile home sales
office; storage of mobile and modular homes for sale; and off - street
parking facilities in the Back Creek Magisterial District.
The above resolution was unanimously passed.
Site Plan Request #005 -82 of James Horton, zoned B -2 (Business - General)
in the Back Creek Magisterial District.
ACTION - Tabled until later in the meeting.
Since the applicant had not yet arrived, Mr. Golladay moved
to table the request. This was seconded by Mr. Stiles and passed
unanimously.

Site Plan Request #020 -82 of T. G. Adams, zoned B -2 (Business - General),
for the construction of 18 additional motel units and required parking
facilities in the Back Creek Magisterial District.
ACTION - Approved
Mr. Horne read the background material. He stated that the
additions will be to the southern end of the existing building. He
also noted that there will be some additional paving for maneuvering
and parking.
Mr. T. G. Adams, owner of the Echo Village Motel, came
forward and introduced himself to the Commission.
In answer to Mr. Kirk's question, Mr. Adams stated that the
addition will be two -story and lines up with the existing structure.
Mr. Golladay asked what effects this addition would have on
the sewage treatment plant. Mr. Adams replied that Mr. Sluder was
consulted and enough capacity exists for these 18 additional units.
However, if more units are added, upgrading would be necessary.
Mr. Romine moved for approval and this was seconded by
Mr. Kirk.
BE IT RESOLVED, That the Frederick County Planning Commission does
hereby approve Site Plan #020 -82 of T. G. Adams, zoned B -2 (Business -
General), for the construction of 18 additional motel units and
required parking facilities in the Back Creek Magisterial District.
The above resolution was passed unanimously.
DISCUSSION OF REGIONAL WASTE WATER TREATMENT FACILITY
Mr. Stiles, liaison from the Board of Supervisors, stated
that the Board approved of proceeding with the design phase of the
Regional Waste Water Treatment Plant at the confluence of the Opequon
and Abram's Creek. Mr. Stiles stated that the plant will be built, but

it will be five to six years before it is operational. He noted that
this approval was a unanimous vote by the Board of Supervisors.
DISCUSSION OF THE OAK HILL SUBDIVISION CASE
Mr. Stiles stated that notification was received from the
Virginia Supreme Court and they have refused to hear the appeal in the
Oak Hill Subdivision Case. Mr. Stiles explained that this was the case
brought against the County in which the Judge of the Circuit Court
ruled in the County's favor. Mr. Stiles felt this was highly
significant in that by letting Judge Woltz's decision stand, the
Supreme Court has enhanced the powers of the local governing bodies
over what they have been previously thought to be. He felt the Supreme
Court had affirmed that if a subdivision request meets all of the
requirements of the Code, yet there remains significant questions about
the appropriateness of the subdivision, it is still within the bounds
of the discretion of the Board to deny the request.
Site Plan Request #005 -82 of James Horton, zoned B -2, (Business -
General), for the installation of gas pumps, walkway, and additional
pavement in the Back Creek Magisterial District.
ACTION - Approved
Mr. Horne stated that this request was an amendment to a
previously approved site plan and he then proceeded to read the
background information. He explained that due to the expansion of the
business on this site, the staff felt the installation of a four foot
walkway and striped, painted lines for a crosswalk should be added for
safety. He also requested that the applicant add raised planted areas
to direct traffic across the large paved area.

The Commission was concerned that the traffic flow would not
be safe because of the many different areas on the site that the public
would be attracted to. They were also concerned as to whether
Mr. Horton had plans for any other activity on the site; considering
that his other projects on this site were established one at a time.
Mr. James Horton, owner of the property came forward and
introduced himself to the Commission. Mr. Horton stated that possibly
in the future he would put wholesale greenhouses on the back of the
property and a miniature golf course in the front of the property.
In answer to Mr. Horne's question, Mr. Horton stated that
there will be two islands with four or five self - service pumps at each.
He noted that there will be no canopies, but the islands will be
lighted. Mir. Horton also explained that one of the islands will be
maintained by Quarles Petroleum.
Mr. Stiles next moved to approve the site plan with the
stipulation that traffic control devices be provided at the area
between the southern entrance and the gas pumps and that natural,
vegetative screening be provided between Route 11 and the flea market.
This motion was seconded by Mr. Romine.
BE IT RESOLVED, That the Frederick County Planning Commission does
herebv approve Site Plan #005 -82 of James Horton, zoned B -2, (Business -
General). for the installation of qas pumps, a walkway, and additional
pavement with the stipulation that traffic control devices at the area
between the southern entrance and the gas pumps be installed and that
natural, vegetative screening be added between Route 11 and the flea
market.
The above resolution passed unanimously.

DISCUSSION OF NEW STATE HEALTH REGULATIONS BY HERBERT SLUDER
Mr. Herbert Sluder, Sanitarian for the Frederick County
Health Department, gave a presentation on the New State Health
Regulations that are to go into effect on November 1, 1982. Mr. Sluder
highlighted the new procedures that his department will be following,
along with other changes that would effect the public. After a brief
question and answer period, Mr. Sluder concluded his presentation.
DISCUSSION ON DISTRIBUTION OF COMPREHENSIVE PLAN
There ensued a discussion on the most effective way to
inform interested members of the public on the final version of the
policy package for the Comprehensive Plan.
Chairman Brumback requested that the Comprehensive Plan
Subcommittee review the alternatives and present a recommendation to
the Commission.
DISCUSSION OF POSSIBLE EXPANSION OF
SHENANDOAH COLLEGE AND CONSERVATORY OF MUSIC
Mr. Gyurisin stated that the staff had been contacted by
Shenandoah College and Conservatory of Music about the possible
purchase of land east of Route 81 for the future expansion of the
College campus. Mr. Gyurisin explained that this land is currently
zoned R -2, which does not allow colleges as a permitted use. He stated
that Shenandoah College and Conservatory of Music would purchase the
property only if they could be assured that they would be allowed to
use the property for the college campus. The Commission informally
approved of the expansion of the college on this property and felt that
when the Commission and the Board of Supervisors begin redrafting the
commercial sections of the ordinance, an actual zoning category

appropriate for college campuses could be instituted. Mr. Horne stated
that he would bring this inquiry before the Board of Supervisors on
October 27 to get their feelings.
ADJOURNMENT
There being no further business to discuss, Mr. Golladay
moved for adjournment. This was seconded by Mr. Kirk and passed
unanimously.
