The Frederick County Transportation Committee will hold a meeting at 7:00 p.m. on Tuesday
December 5, 2000, in the Board Room of the Frederick County Administration Building, 107 North
Kent Street, Winchester, Virginia. Please note the earlier meeting time. The agenda for this meeting
is as follows:
AGENDA
I. Request submitted by Mr. Rex Dalrymple to discontinue the public's use of a portion of
Route 716 (Dairy Corner Place). Public discontinuance is sought in order to facilitate the
building of a 7-11 convenience store and fast food restaurant. Mr. Sam Shumate, agent
for the applicant, will be present at the meeting to answer questions, as will Mr. Steven
Melnikoff, Transportation Engineer for the Virginia Department of Transportation.
II. Other
Included in this agenda are a description of the request, a location map depicting the portion of Route
716 to be discontinued, and a copy of the letter requesting the discontinuance. Staff would request
that the Committee make a recommendation which can be forwarded to the Planning Commission
and Board of Supervisors.

This firm represents Mr. Rex Dalrymple who has cortracted ro purchase the
properties referenccd above contingent upon obtaining all of the necessary permits and
rezoning, and the discontinuance of a portion of State Rt 7161ying in a ort of and adjacent

of the City of Winchester, lying between the southern right of way line of the east bound
lanes of State Route 7 and the front property lines of the properties owned by Simpson,
Morris and Russell, and extending from the eastern right of way line of State Route 659 on
the west, to the driveway entrance of the Ganse property on the east.
Enclose, is a copy of a concept plan on which we have narked the _%otticn of road

Discontinuance of Route 716 - Support Information
Pursuant to § 33.1-150 of the Code of Virginia, the governing body (i.e. Board of Supervisors) may
discontinue any road in the secondary system when such a road is not required for public
convenience. The portion of Route 716 in question runs parallel to Route 7, Berryville Pike, and
intersects Valley Mill Road approximately 75 feet from Route 7 East. This portion of roadway is
approximately 570 feet long with a 40 -foot right-of-way.
The applicant has consulted with VDOT and is working to meet all of their requirements.
Discussions have been conducted with 220 Seafood and an agreement with the restaurant regarding
access is pending. A letter of understanding between the applicant and VDOT, outlining the details
of the agreement, is also pending.
