July 25, 1939 to October 02, 19391G6 At a Special Meeting of the Board of Supervisors for Frederick County, Virginia, held in the Supervisors'Room over the Clerk's Office on T.°uesday, July 25, 1939 PRESENT: C•..I: Brumback, Chairman; W. H. Branner; C. M. Rosenberger; and B. P. Harrison, Commonwealth's Attorney. ORDINANCE REGARDING MAD DOGS Whereas, it has been proved that a mad dog has been recently at large in the neighborhood of Mountain Falls, and that he has or may have bitten other dogs; Therefore, be it ordained by the Board of Supervisors of Frederick County in 14eeting specially called this day that effective immediately, the owners of all dogs within a radius of three miles of the Post Office at Zbuntain Falls shall be and hereby are required to keep all dogs within said radius confined in their premises unless muzzeled in such manner that persons or animals will not be subject to the danger of being bitten thereby. This Ordinance shall remain in force for a period of 45 days. The Officers of the Law, including the Game Warden, are instructed to enforce and publicize this ordinance. MII4JTES OF THE PREVIOUS MEETINGS The minutes of the last regular meeting and of the special meeting of July 25, 1939, were read and unanimously approved. Ln BUDGET FOR SECONDARY ROAD SYSTEM W. C. Poston, Resident Engineer, presented the final budget for the secondary road system for the year 1939 -40 and on motion of W. H. Branner, seconded by C. M. Rosenberger, the same is unanimously approved. NOTIFICATION OF CARSON HITACRE On motion it is ordered that the Clerk notify Mr. Carson Whitacre of Grimes, Virginia to appear before the Board of Supervisors of Frederick County, Virginia, at their regular meeting to be held in September, relative to Mr. Whitacre's interest in a road running through his property. 167 ABANDONMENT OF ROADS Due to the relocation and construction on Route 614, Project 1393 -K in Frederick County, it has become necessary to abandon three sections of the old loca and add three sections of the new location to the secondary system. Therefore, be it resolved, that the following three sections of the . , o old location be abandoned. Section 1 - Old location of Secondary Route 614 from Sta. 88180, as shown on the plans of the above project, northeast and southeast 0.22 mile to Sta. 79125. Section 4 - From Sta. 77155, looking easterly 0.12 mile to Sta. 71160. Section 6 - From Sta. 41 +15 looping easterly 0.08 mile to Sta. 37t60. Be it further resolved that the following location be added to the secondary system. Section 2 - New location from Sta. 88 80 east 0.18 mile to Sta. 79�25. Section 3 - From Sta. 771.55, east 0.11 mile to Sta. 71160. Section 5 - From Sta. 41 east 0.07 mile to Sta. 37/ PROPOSED CELEBRATION ON ROUTE 275 Mr. Rosenberger and Mr. Gold are hereby appointed a committee to cooperate with and to work in conjunction with the Chamber of Commerce in the preparation of plans for a celebration to be had upon Route 275 on the completion of that road from West Virginia, the purpose of which celebration is to foster a more pleasant relationship between the people of West Virginia and Virginia. REPORT OF MISS BLAIR Miss Madeline Blair, County Home Demonstration Agent, presented her report and the same was unanimously approved. b T OF T. IN. RUSSELL T. 1 +1. Russell, Superintendent of the County Home, presented his report and the same was unanimously approved. ADDING MACHINE FOR CLERK'S OFFICE Whereas, the adding machine in the Clerk's Office is old and is not functioning properly. Be it ordered that a new adding machine be purchased from the Burroughs Adding Machine Company to be paid for in September 1939. REPAIR OF COITORT STATION It is ordered that the comfort station under the Court House be repainted white inside and that extra lights be added to give ample light and that coat hooks be provided. Mr. Cold of the Committee on County Property is authorized to proceed at once with this work. REPORT OF TREASURER Harry L. McCann, Treasurer, presented his report and the same was unanimously approved. Mr. McCann, the Treasurer, requested until September to make up the delinquent list due to excessive business. I ROAD GRADER By unanimous consent of the Board, the Chairman is authorized to pro- ceed against Frank Bucher of Stephens City, Virginia, to have him return to the place f which he borrowed one of the County's road graders. H. L. HAYES LARRANT The County Clerk is authorized after a further investigation if Warrant No. 329 from the Dog Fund issued to H. L. Hayes on June 5, 1939 cannot be found or if it has not been cashed at the Bank, to issue a duplicate for the same. PETTY CASH ACCOUNT On motion the Clerk is ordered to draw a warrant for $18.32 payable to H. L. McCann, Treasurer for the Petty Cash Account. Bills totaling $2,368.65 were approved and ordered to be paid from the General County Fund by Checks Nos. 3969 to 4116, inclusive. Sheep claims totaling $151.15 were approved and ordered to be paid from the Dog Fund by Checks Nos. 345 to 351, inclusive. MILLER, COMPENSATION FOR DAMAGES Whereas, the relocation of Route 654 has taken a strip of corn from the land of Dory C. Miller, and Whereas, Mr. Miller has donated the land and requests that he be allowed $15.00 for the corn lost. Be it ordered that a check be drawn to Dory C. Miller for $15.00 in full compensation for damages to his corn field. CARSON WHITACRE, COMPENSATION FOR DAMAGES Carson Whitacre appeared before the Board and presented a claim for seven (7) apple trees taken in the relocation of the highway at Siler, Virginia, for he asks that he be paid the sum of $25.00 for seven (7) full bearing apple trees, which were destroyed in relocating the road. Said bill is ordered paid. IG9 REPORT OF T. W. RUSSELL T. W. Russell, Superintendent of the County Home, presented his re- port and the same was unanimously approved. SECRETARY FOR MISS BLAIR Whereas, clerical assistance heretofore furnished Miss Blair by the P. W. A. has terminated August 25, 1939. On motion of Mr. Branner, seconded by Mr. Adams, it is unanimously ordered that the Secretary of Miss Blair be restored until January 1, 1940 and to receive $50.00 per month to be paid out of the General County Fund. REPORT OF I. FRED STINE I. Fred Stine, County Agent, presented his report and the same was unanimously approved. APPROPRIATION FOR FIRE APPARATUS AT STEPHENS CITY On motion of N,r. Gold, seconded by Mr. Branner, it is unanimously ordered that there be appropriated $250.00 to the Independent Hose Company, Stephens City, Virginia, to be used for assistance in the purchase of fire apparatus. It is ordered that this amount be paid as follows: $125.00 at the present time and $125.00 to be paid at the regular meeting of the Board in December. SALARY OF GAME WARDEN Whereas, by resolution passed in July 1938, the Game Warden was allowed $20.00 per month as compensation for looking after damages done by dogs to live- stock and poultry, and Whereas, this service has so increased, it is, therefore ordered that the Game Warden's salary be increased from $20.00 per month beginning September 1, 1939 to $25.00 per month for the balance of this fiscal year. TRANSFER OF FUNDS The Treasurer is authorized to transfer to the Frederick County School Board the sum of $125.00 to be used for dental .clinic for school children and he is also authorized to transfer the sum of $25.00 to the School Board to be used for diptheria clinic. This is done in accordance with resolution of March 8, 1939. TRANSFER OF FUNDS The Treasurer is authorized to transfer from the General County Fund to the County School Fund the sum of $10,500.00 as per resolution passed March 17, 1939, to be applied on the County School debt. DELINQJENT LIST FOR 1938 The Treasurer presented the delinquent list for the year 1938 which was accepted except the following list consisting of $3,552.47 which leaves a balance of $8,152.18 delinquent.for the tax year 1938 which shows a much smaller delinquent list for the year 1938 than for 1937 and the Board hereby commends Treasurer McCann for the effi- cient manner in which he has collected taxes and having a much reduced delinquent list th for previous years. The minutes of the previous meeting(regular) of Sept. 6,1939, were read and unanimously approved. REPORT OF T.W.RUSSELL SUPT. OF COUNTY HOME. T.W.Russell,Supt. of the County Home psdsented his Report and the same was unanimously approved. REPAIRS OF COUNTY OFFICE BUILDING. On motion of Mr. Gold seconded by Mr. Adams, it is orddered that the Chairman of the Board, b authorized to see that a galvanized covering is put over the top of the building to prevent water from seeping through the building into the Clerk's Office. COT<MITTEE TO GO BEFORE CITY COUNCIL. It is ordered by the Board that a Committee of two consisting of C.I.Brumback, Chairman, and P.H.Gold, go before the City Council relative to taxes on County property located in the City, and the said Committee is to report at the next meeting as to the results of their conference with the Council. PERRY CONSTRUCTION COMPANY CHECK. It is o by the Board that $25.00 be returned to the Perr,; Construction Co. for deposit on plans r eceived by them and returned, relative to Sanitary Store,which the Board was negotiating for, to be erected on the Hitching Yard; and as the building was not erected it is ordered that the sum of $25.;00 be refunded the Perry Construction Co. and a warrant is ordered to be drawn for that amount.
