The Frederick County Historic Resources Advisory Board (HRAB) will be meeting on Tuesday,
September 18, 2012 at 6:00 p.m., in the Board of Supervisors Executive Session Room* in the
Frederick County Administration Building, 107 North Kent Street, Winchester, Virginia. The
HRAB will discuss the following items:
AGENDA
1. Review of the site plan application for Rose Hill Farm access and parking.
2. Review of the AT&T Commercial Telecommunications Facility Conditional Use Permit
(proposed tower located at 141 Fairview Road).

Access to this building is limited during the evening hours. Therefore, it will be necessary to
enter the building through the rear door of the Board Room. I would encourage Committee

Rose Hill Farm Site Pian
The Historic Resources Advisory Board (HRAB) has been asked to provide a review agency
comment pertaining to a site plan for the Rose Hill Farm, submitted by Painter -Lewis, P.L.C.
This application seeks to use gravel access and parking in lieu of double prime seal for this
property as required by the Frederick County Zoning Ordinance. The property is located on the
east side of Jones Road (Route 621).
The Study of Civil War Sites in the Shenandoah Valley, published by the National Park Service,
identifies this site and surrounding areas as being part of the First Kernstown Battlefield. The
Rural Landmarks Survey Report for Frederick County Virginia identifies one structure:
• Rose Hill (#34-115) — Located on site
Representatives of the applicant will be available at the HRAB meeting to provide additional
information on the proposed site plan. Staff will be seeking comments from the HRAB on the
historical elements possibly impacted by proposed development. The comments will be
included in the site plan application package for the site plan when it is submitted.

AT&T Commercial Telecommunications Facility Conditional Use Permit
The Historic Resources Advisory Board (HRAB) has been asked to provide a review agency
comment pertaining to the AT&T Commercial Telecommunications Facility Conditional Use
Permit application. This application seeks to construct a 199 -foot monopole
telecommunications tower with an accessory equipment building. The property is located at
141 Fairview Road.
The Study of Civil War Sites in the Shenandoah Valley, published by the National Park Service,
does not identify the proposed tower site or the surrounding areas as being part of a
battlefield. The Rural Landmarks Survey Report for Frederick County Virginia identifies three
historic structures located within the vicinity of the proposed tower, one of which is located on
site. All of these properties are listed as potentially significant. The sites that are listed in the
survey are:
• Easton House (#34-482)
• Fairview Church (#34-1515)
• White -McKee House (#34-1516)
Please find attached for your information a map of the site, portions of the impact analysis and
the proffer statement, photographs, and survey information from the Virginia Department of
Historic Resources provided by the applicant. Representatives of the applicant will be available
at the HRAB meeting to provide additional information on the proposed Conditional Use
Permit. Staff will be seeking comments from the HRAB on the historical elements possibly
impacted by proposed development. The comments will be included in the Conditional Use
Permit application package.

New Tower ("NT") Submission Packet
FCC FORM 620
Introduction
The NT Submission Packet is to be completed by or on behalf of Applicants to
construct new antenna support structures by or for the use of licensees of the Federal
Communications Commission ("FCC"). The Packet (including Form 620 and
attachments) is to be submitted to the State Historic Preservation Office
("SHPO") or to the Tribal Historic Preservation Office ("THPO"), as appropriate,
before any construction or other installation activities on the site begin. Failure
to provide the Submission Packet and complete the review process under
Section 106 of the National Historic Preservation Act ("NHPA")' prior to beginning
construction may violate Section 110(k) of the NHPA and the Commission's rules.
The instructions below should be read in conjunction with, and not as a substitute
for, the "Nationwide Programmatic Agreement for Review of Effects on Historic
Properties for Certain Undertakings Approved by the Federal Communications
Commission," dated September 2004, ("Nationwide Agreement") and the relevant rules
of the FCC (47 C.F.R. §§ 1.1301-1.1319) and the Advisory Council on Historic
Preservation ("ACNP") (36 C.F.R. Part 800).2
Exclusions and Scope of Use
The NT Submission Packet should not be submitted for undertakings that are
excluded from Section 106 Review. The categories of new tower construction that
are excluded from historic preservation review under Section 106 of the NHPA are
described in Section III of the Nationwide Agreement.
Where an undertaking is to be completed but no submission will be made to a SHPO or
THPO due to the applicability of one or more exclusions, the Applicant should retain in
its files documentation of the basis for each exclusion should a question arise as to the
Applicant's compliance with Section 106.

Section II.A.9. of the Nationwide Agreement defines a "historic property" as: "Any prehistoric or historic
district, site, building, structure, or object included in, or eligible for inclusion in, the National Register
maintained by the Secretary of the Interior. This term includes artifacts, records, and remains that are
related to and located within such properties. The term includes properties of traditional religious and
cultural importance to an Indian tribe or Native Hawaiian Organization that meet the National Register
criteria."
