Item One - May 2011 and October 2011 Meeting Minutes: Approved by the HRAB Item Two: Planner Perkins introduced the second agenda item which was a CUP for an AT&T telecommunication facility CUP for 3392 Back Mountain Road. This item was carried over from the October 2011 meeting due to the lack of a quorum. The HRAB reviewed the October minutes where the item was initially discussed and recommended that the CUP application include the following: (1) a tree preservation area should be identified on the site plan to help screen the proposed tower and compound; and (2) the HRAB suggested that the applicant contribute to the Frederick County Historic Property Designation Program (Plaque Program). This is a voluntary program that allows Frederick County to award numbered plaques to formally acknowledge structures that have an architectural and historical significance. Item Three: Planner Perkins provided an overview of the attachments which consisted of the HRAB Bylaws, a guide for the conduct of meetings, and formulating good recommendations. The group discussed the bylaws and suggested that the Section 2.4 that states that the HRAB shall have annual training sessions be modified to state that the HRAB may have annual training sessions. The HRAB also discussed changing the meeting time from 6:30pm to 6:00pm. The HRAB wanted these changes made to the bylaws so they could be adopted at the next scheduled meeting. The HRAB then discussed the document titled "Guide to Conduct of Meetings" and stated that they would like to more closely follow the format outlined in this document for future meetings. Item One: Planner Perkins introduced the first agenda item which was proposed Changes to the HRAB Bylaws. The HRAB had previously discussed changes to the bylaws in 2011 and requested that the changes be adopted at next meeting (May 2012). The changes included changing the meeting time from 6:30pm to 6:00pm, and a change to state that the HRAB may have training annual training sessions (instead of shall). The HRAB agreed with the changes and voted to approve the amended bylaws. Item Two: Planner Perkins introduced the first agenda item which a Historic Property Designation (Plaque) Application for the White Hall United Methodist Church. The HRAB agreed that the subject property was historic and eligible to receive a plaque. The Board by unanimous vote to approved the plaque application. Item One: Planner Cheran introduced the first agenda item which was a review of the site plan application for Rose Hill Farm access and parking, submitted by John Lewis with Painter & Lewis. The site plan application seeks to use gravel access and parking in lieu of double prime and seal for this property as required by the Frederick County Zoning Ordinance. The HRAB supported the request and added that wooden wheelstops in lieu of concrete wheelstops should be used because they would be more in keeping with the theme of Rose Hill. With that one suggestion the HRAB approved the site plan. Item Two: Planner Cheran introduced the second item which was a Conditional Use Permit application for a proposed 199 -foot commercial monopole telecommunications tower with an accessory equipment building for AT&T. The property is located at 141 Fairview Road. The Rural Landmarks Survey Report for Frederick County Virginia identified three historic structures located within the vicinity of the proposed tower, one of which is located on site. All of these properties are listed as potentially significant. The sites that are listed in the survey are: ® Easton House (#34-482) ® Fairview Church (#34-1515) ■ White -McKee House (#34-1516) The HRAB felt that the submitted application did not provide the board with enough information to make a recommendation on the proposed tower and requested that the application provide additional information and return to a future meeting. This application seeks to construct a 199 -foot monopole telecommunications tower with an accessory equipment building. The property is located at 141 Fairview Road. The Study of Civil War Sites in the Shenandoah Valley published by the National Park Service, does not identify the proposed tower site or the surrounding areas as being part of a battlefield. The Rural Landmarks Survey Report for Frederick County, Virginia, identifies three historic structures located within the vicinity of the proposed tower, one of which is located on site. All of these properties are listed as potentially significant. According to information provided by Bechtel (Bechtel, Site Plan, dated March 9, 2011), the proposed activities at the site will include clearance of vegetation from a 50 -foot by 50 -foot lease area for the construction of a 195 -foot tall monopole, an 11 -foot five -inch by 20 -foot equipment shelter, an electrical H -frame, and a Mesa cabinet. A chain link fence will surround the site and barbed wire will be installed on the top of the fence. A 300 -foot long 12 -foot wide gravel access road will connect the site compound to Fairview Road. The APE for visual effects associated with this project was a one half (%2) mile radius from the proposed tower site as specified by Section VI.C.4/a of the "Nationwide Programmatic Agreement (NPA) for Review of Effects on Historic Properties For Certain Undertakings Approved By The Federal Communications commission" if the proposed tower is 200 feet or less in overall height. Cardno ATC reviewed the Virginia Department of Historic Resources (VDHR) geographic information system (GIS) database and the Frederick County Register of Historic Places for the properties within the APE that met the criteria for the Identification and Evaluation of Historic Properties in accordance with Section VI.D.I. of the NPA as stated below: Properties listed in the National Register of Historic Places; Properties formally determined eligible for listing by the Keeper of the National Register; iii. Properties that the SHPO/THPO certifies are in the process of being nominated to the National Register; iv. Properties previously determined eligible as part of a consensus determination of eligibility between SHPO/THPO and a Federal Agency or local government representing the Department of Housing and Urban Development (HUD); and V. Properties listing in the SHPO/THPO Inventory that the HPO?THPO has previously evaluated and found to meet the National Register criteria, and that are identified accordingly in the SHPO/THPO Inventory. Cardno ATC's initial historical research for the proposed tower included a review of the VDHR GIS database, Cardno ATC discovered that seven (7) National Register listed or formally eligible to be listed historic sites (George Parrish Place, VDHR #034-0170, House VDHR #034- 5093, House VDHR #034-5094, J.R. Lewis House, VDHR #034-483, House — Border Lane, VDHR #034-5092, Garage, VDHR #034-5091, Easton House, VDHR #034-0482) were located within the APE. On May 4, 2011, Cardno ATC sent a letter to the Frederick County Department of Planning and Development requesting comments on the proposed undertaking's potential impact on any historic properties. No response was received within thirty (30) days of the May 4, 2011 consultation letter. ATC submitted an FCC Form 620 to the Virginia Department of Historic Resources (VDHR) in May 2011, The package was withdrawn from the e -filing system before DHR concurred. ATC resubmitted the FCC Form 620 to VDHR in June 2012 for reconsideration. The determination of effects listed in the Form 620 was "No Historic Properties in the Area of Potential Effects" (APE) for direct effects, and "No Adverse Effect on Historic Properties in the APE" for visual effects. On August 16, 2012, the VDHR concurred with Cardno ATC's determination. Based on this information, no further evaluation of historic properties is warranted. In addition, ATC submitted an FCC Form 620 to the West Virginia State Historic Preservation Office (SHPO) in August 2012. A copy of the submittal package is included in Appendix D. The determination of effects listed in the Form 620 was "No Historic Properties in the Area of Potential Effects" (APE) for direct effects, and "No Effect on Historic Properties in the APE" for visual effects. ATC received a response from the West Virginia SHPO dated September 14, 2012, stating that "no historic buildings and/or structures are identified in the area of potential effects in the State of West Virginia." Based on this information, no further evaluation of historic properties is warranted. As a result of a zoning board hearing with the Frederick County Department of Planning and Development, Bechtel contacted Cardno ATC regarding the planning Department's request that two additional sites (Fairview Lutheran Church, VDHR #034-1515 and White -McKee House) be evaluated for effect and one site (Easton House, VDHR #034-0482) be further evaluated. ATC notes that the sites identified by the department were either located outside of the standard APE, or were previously identified under a different name. On October 15, 2012, Cardno ATC conducted a site visit to evaluate all nine (9) identified properties (both DHR and Frederick County Planning Department) and the tower's potential impact on those properties. II. Physical Setting The APE is located within the United States Geological Survey (USGS) Capon Bridge, West Virginia, Virginia, 7.5 Minute Series (Topographic) map, dated 1986. The site is currently a wooded area of a residential lot with Fairview Road to the east. A review of the topographical map revealed the subject property was located approximately 1,103 feet above mean sea level on the slope of a ridge in a very hilly area. No on-site surface water features were observed during the site visit. Storm water runoff in the immediate vicinity of the site would likely flow west from the site. A copy of the Capon Bridge, West Virginia, Virginia, 7.5 Minute Series (Topographic) map, illustrating the proposed telecommunications site location and the APE has been provided as Appendix B. III. Historic Search Cardno ATC conducted a search on the VDHR GIS databases for sites located within the APE which were listed and/or eligible to be listed on the National Register of Historic Places. A review of this source revealed nine (9) National Register listed, State register listed, or formally determined eligible to be listed historic sites (George Parrish Place, VDHR #034-0170, House VDHR #034-5093, House VDHR #034-5094, J.R. Lewis House, VDHR #034-483, House — Border Lane, VDHR #034-5092, Garage, VDHR #034-5091, Easton House, VDHR #034-0482, ATC ASSOCIATES INC. 2 PROJECT N0. 09.75132.2006 (Task 1) Fairview Lutheran Church, VDHR #034-1515, and White -McKee House) were located within the %2 mile APE radius. (_anrga Parish House (Vn"p #034-017(1): The National Register listing George Parish House is located approximately 1,500 feet southeast of the proposed undertaking along US Route 50. This is a two-story, "L" -shaped residence, the rear being an addition. The front porch of the wooden structure has brick exterior end chimneys with stone foundations, and a two-story porch, five bays wide. Historic archaeological surface collection of the site suggests circa 1850 occupation. J.R. Lewis House (VDHR #034-483): The State Historic Landmark listing J.R. Lewis House is located approximately 1,750 feet southwest of the proposed undertaking along US Route 50. This is a two-story residence with additional structures on the property including: 1 '/Z story summer kitchen with front porch, modern garage/carport, misc. large framed sheds and coops, and a frame bank barn. The house was built between 1880 and 1900. Easton House (VDHR #034-0482): Cardno ATC notes that according to VDHR records, this listing is identified as the Eaton House; however, the Frederick County Planning Department identified it as the Easton House. This State Historic Landmark listing is located approximately 2,100 feet west to southwest of the proposed undertaking along US Route 50. This is a two-story residence with an addition of a 1 '/2 story rear ell with a stone exterior end chimney. The residence also has additional structures on the property including: garage, outhouse, smokehouse/root cellar combination, several modern tool/storage sheds. The house was built between 1870 and 1900. No detailed information was provided for the remaining historic properties. IV. Field Observations During the October 15, 2012 site visit, a clinometer was used to scan the "Line of Sight" for visual obstructions. The clinometer readings were utilized to determine if the line of sight of the tower will be obstructed from the historic properties to the top of the proposed tower. Based on the clinometer readings and the existing landscape between the historic properties and the proposed undertaking, the proposed tower will only be partially visible from five locations (only approximately the top 10 feet or less of the tower). V. Findings & Conclusions: Bechtel is committed to collocating on existing structures where possible to limit the proliferation of new telecommunications sites; however, there were no existing structures available in the area which would provide adequate service to the target area. This Visual Impact Assessment Report has been prepared to evaluate the potential visual impact of the proposed telecommunications site on nine (9) properties, mentioned above, identified on the VDHR database and through the Frederick County Department of Planning. The visual impact assessment consisted of an evaluation of the historic properties for potential visibility of the proposed tower. The assessment included photographs of the historic properties and the associated views towards the proposed properties in the direction of the proposed tower, to clarify the visual impact of the site. Virginia Department of Historic Resources (VDHR) Inventory Sites Fairview Lutheran Church (VDHR #034-1515), George Parrish Place (VDHR #034-0170) House (VDHR #034-5094), and Easton House (VDHR #034-0482): The proposed monopole will not be visible from these locations due to environmental factors such as dense vegetation and trees and houses in the line of sight, distance, and elevation. White — McKee House, House (VDHR #034-5093), J.R. Lewis House (VDHR #034-483, Border Lane House (VDHR #034-5092), Garage (VDHR #034-5091): The proposed monopole will be partially visible above trees in the winter from these locations; however, the trees are very dense and approximately only the top 10 feet of the monopole will be visible over the tree line.
