The Frederick County Historic Resources Advisory Board (HRAB) will be meeting on Tuesday,
March 21, 2006, at 6:30 p.m., in the Board of Supervisors' Executive Session Room* in the
Frederick County Administration Building, 107 North Kent Street, Winchester, Virginia. The
HRAB will discuss the following items:

The meeting began at 6:30 pm.
The first agenda item was the November 2005 minutes, which were approved.
The second item was a discussion on the rezoning proposal for the Chemstone-Middletown Property (O -N
Minerals) submitted by Patton Harris Rust & Associates, PC. The rezoning consists two parcels that total 691
acres. The current zoning is RA (Rural Areas) and the requested zoning is EM (Extractive Manufacturing).
Staff made a brief presentation for the proposal and then gave the floor over to Mr. Chuck Maddox of
PHR&A. Mr. Maddox stated that limestone mining is going to take place on the site and out of the 691 acres
only 80 acres or 11 % (approximate) will be disturbed. He also stated that environmental and ground water
studies were conducted on the site in 1992 and that water rights have been acquired by the Sanitation
Authority. Some of the minerals from the quarry could be transported across the Cedar Creek by conveyor to
the Strausburg quarry, as well as by truck through the Town of Middletown to Route 11. Mr. Maddox also
stated that the Town of Middletown had provided comments to the Board of Supervisors to review. While site
is not part of the National Park area, Civil War troops traveled through some of the site and there were some
camps on the property. This site also contained what is called the "Nieswander's Fort" which was demolished
about 25 years ago. Mr. Maddox stated that the quarry will be shielded by a berm that could contain trees.
There were numerous comments from representatives that attended the meeting, they are as follows:
Mike Kehoe: The property contains significant historic resources which he marked on a map many years ago,
and battles took place on the southern portion of the property. There is a cemetery on the northern portion of
the property that needs to be protected and research further. He also expressed concern regarding the viewshed
of adjoining historical properties.
Elizabeth McClung: Stated that there may be an ability to have the quarry provide tours since it is an historical
quarry and possibly a geologic museum. There are many concerns about the viewshed from Belle Grove due
to the large red berms that are around the existing quarry. She also stated that they would like a timeline for
the mining north of Belle Grove as well as identification of future visual impacts.
Mr Stinson: Stated that he will clarify the mineral rights to the HRAB, as well as address any issues that the
battlefield foundation may have.
The HRAB then discussed the proposal. The following recommendations were formulated:
• A Phase I Archeological Survey needs to be done on the site, focusing on core battlefield areas and the
site of the Nieswanger Fort. If warranted by the Virginia Department of Historic Resources,
subsequent studies should be performed. (Phase II/VI).
• A detailed Viewshed Mitigation Analysis/Plan needs to be completed that will show the effects of the
new quarry operation from key points (critical areas and views/pull-offs to be determined by the
National Park Service, Belle Grove and the Cedar Creek Battlefield Foundation). This plan needs to
be completed before any land disturbance is allowed on the site and implementation of any
suggestions that may result from the plan should be given a proffered timeline. In addition, the
viewshed study should also ensure that views from Chapel Road are not impaired.
• Cedar Creek should be bridged so that quarry trucks can use this route instead of going through
historic Middletown and passing by the Belle Grove entrance.
• The conveyer system being discussed should be studied further to ensure that it does not impact the
viewshed or create noise issues. The amount of traffic this system will alleviate should be provided as
well. The applicant should propose a plan for the conveyer system that will not have a huge visual
impact on the surrounding landscape.
• A timeline for the removal of the existing stockpile of dirt (overburden) that can be seen from the
Cedar Creek Battlefield needs to be provided with this proposal.
• Strategic landscaping needs to be looked at, as well as preserving natural existing landscaping, as
opposed to high berms to try to screen the operation. A detailed landscaping study needs to be done
for the site.
• The location for the overburden from the new quarry operation needs to be provided so that large piles
of dirt similar to the current operation are not present, maximum elevations for new berms need to be
proffered. A documented plan for any new berms and overburden stockpiles needs to be provided.
• Perimeter fencing and lighting details need to be provided so that they do not affect the adjacent
historic uses.
• The proffers provided to the HRAB included an eight acre reserve for Belle Grove. The proffer states
that, "Said reserve shall be set aside for future dedication to Belle Grove Foundation". This proffer
includes no timeline for the dedication of the property and as provided, the dedication could never
happen. A specific timeline for the dedication of this property needs to be provided to ensure that the
Foundation is given this property.
There was a recommendation by the HRAB to approve the rezoning so long as the issues discussed above were
mitigated.
At the end of the meeting Ms. Gochenour (Planning Commission Liaison gave a brief speech regarding her
service on the Historic Resources Advisory Board, as it was her last meeting. She stated that the HRAB had
improved greatly since the beginning of her term and that she would continue to be involved in the County
processes. The HRAB acknowledged that Patricia Gochenour's service as Planning Commission Liaison was
greatly appreciated.

The meeting began at 6:30 P.M.
The first agenda item was the December 2005 minutes, which were approved with the
following changes:
-The name of the development (O -N Chemstone) needs to be made consistent throughout
the minutes to provide consistency.
-Mr. Stinson (spokesman for Chemstone) needs to be added into the December minutes.
-Comments that Mr. Brown made in regards to Middletown and the town involvement
need to be revised.
-Patricia Gochenour's (Planning Commission Liaison) last HRAB meeting took place in
December 2005; her farewell to the HRAB needs to be included in the minutes.
The second item of the evening was the approval of the meeting dates for 2006, which
were listed in the agenda. HRAB member Felecia Hart brought up issues with the HRAB
by-laws, which was discussed by the members. The HRAB decided that the by-laws will
be changed so that the there is no time associated with the meeting dates, since meetings
start at 6:30 P.M. instead of the 7:30 P.M. start -time.
The third item on the agenda was to decide which properties would be invited to
participate in the Frederick County Historic Plaque Program. The following properties
were recommended for plaques: Branson House, Winter Hill, Buffalo Marsh, the Dillon
Boyles House, Klines Mill, the Miller's House at Hayfield, the E.B. Clevenger House,
the Ridings -McClung House, Indian Springs, the Glass -Rinker House, Homespun
(Opequon Historic District), and Paxton.
The following properties need further consideration: Linden, Shanholtz-Baker House, the
Heironimus-Mauzy House, J.E. Funkhouser, the Old Forge Farm, and the Chrisman-
Stickley House.
The advisory board decided that the plaque invitation letters should have a `return sender'
enclosed with the letter. A letter that the applicant can return should be included as well.
This letter could allow the property owner to express their desire to receive a plaque or
describe why they are not interested in participating in the plaque program. By knowing
why property owners may not want to have the plaque on their property will give the
HRAB better knowledge of how to approach property owners about the plaque program
in the future. A 30 day timeline for the invited property owners to respond will also be
set from when the letters are mailed. It was also suggested that the pictures that were
taken of the historical properties be placed on the Frederick County website, including
information about the plaque program and history of the HRAB.

BYLAWS
FREDERICK COUNTY
HISTORIC RESOURCE ADVISORY BOARD (HRAB)
1. Purpose of the HRAB
1.1 Mission Statement - Provide guidance to the Planning Commission and Board of
Supervisors on issues concerning the County's historic resources.
1.2 The HRAB was created in 1987 by the Frederick County Board of Supervisors to
consider the impact of a rezoning or development on historically and architecturally
significant sites and structures.
1.3 The HRAB will make recommendation of applications, either approval, approval
with conditions or denial. The recommendation will be based upon the proposed
treatment of historic resources as well as the degree of their significance. If
conditions are placed on the application, they shall be based on attached
document `Formulating Good Recommendations'
II. Membership
2.1 The HRAB consists of nine voting members, one member from each magisterial
district and three members at large. In addition to a Planning Commission Liaison, a
staff member from the Planning Department, as well as an historic preservation
consultant that advises the Board, also attend the meetings.
2.2 Members are appointed by the Board of Supervisors.
2.3 The Chairman and Vice Chairman shall be elected by the HRAB for a term of one
year.
2.4 The HRAB will have an annual training session.
2.5 HRAB members will be encouraged to attend outside training sessions and
conferences.
2.6 If an HRAB member has a conflict of interest with an application, it is expected that
they refrain from making recommendations.
III. Meetings
3.1 Meetings are held the third Tuesday of the month from 6:30pm to 8:OOpm as needed,
meetings are also open to the public.
3.2 Special meetings may be called for training sessions or if more time is needed for
discussion of applications. Special meetings may be called for by the Chairman and
the Planning Staff.
3.3 The staff member for the HRAB is required to make site inspections for all
applications. The HRAB members are also encouraged to make site visits.
3.4 Since the HRAB is an advisory Board and only makes recommendations, public
hearing and public notices are not required.
3.5 A majority of the members present is required for an approval or denial
recommendation; however, all recommendations will be recorded.
3.6 The HRAB will be courteous and respectful to each other and all applicants.
3.7 Regular attendance is expected of all members of the HRAB. If a member is unable
to attend, it is expected that he/she notify the staff. Once a member has missed three
(3) unexcused HRAB meetings, he/she shall be referred for replacement.
IV. Powers & Duties
4.1 The role of the HRAB is to make recommendations for properties that are or may be
considered historic or potentially significant when land development applications are
submitted to the county.
4.2 Fulfill responsibilities as designated by the HA Historic Overlay Zone Ordinance
(Article XVI HA Historic Area Overlay Zone — Frederick County Zoning Ordinance).
4.3 Make recommendations utilizing the "Formulating Good Recommendations"
handout. (See attachment)
4.4 Encourage historic preservation in Frederick County by recognizing significant
historic resources.
V. Application Review Process
5.1 Complete applications (see HRAB submission requirements) must be received at
least three (3) weeks prior to a scheduled HRAB meeting, ensuring that the HRAB
will receive their agenda two (2) weeks prior to a meeting. Once an application is
received, the staff member shall research the project and prepare an agenda for the
HRAB Members. At the HRAB meeting, the applicant is expected to be present to
answer any questions that the board may have.
5.2 The HRAB shall provide a recommendation to the applicant during the meeting
unless the applicant requests to bring the application back to the board at a later time.
5.3 Staff is responsible for notifying the applicant in writing of the HRAB's action on the
application. The notification letter should include all reasons for approval, approval
with conditions or denial.
VI. Bylaw Amendment Process
6.1 If a member of the HRAB desires to amend the bylaws, that member would need to bring
up the recommendation under the "other" portion of the meeting. A vote would then be
held with the members and if a majority vote is given a discussion will be held as to how
to amend the bylaws. Once the changes have been discussed and agreed upon, staff will
provide the HRAB members with a copy of the amended bylaws to adopt at the next
scheduled meeting.
