The HRAB will discuss the following items: AGENDA 1. Review of North Stephenson, Inc. rezoning proposal, submitted by Evan Wyatt of Greenway Engineering. 2. Shenandoah Valley Battlefields Foundation presentation - Battlefield Clusters. 3. Review of Shen -Valley Lime Corporation rezoning proposal, submitted by Evan Wyatt of Greenway Engineering. 4. Other. RAR/bah Attachments 107 North Kent Street • Winchester, Virginia 22601-5000 Item # 1 Review of North Stephenson Rezoning Proposal The Historic Resources Advisory Board has been requested to review and provide comment on the North Stephenson rezoning proposal, which has been submitted by Greenway Engineering. The proposal seeks to rezone a portion of the 37.9 -acre parcel from RA (Rural Areas) for 6.45 acres of commercial use. The property is located on Route 11 North/Martinsburg Pike east of the intersection with Interstate 81. The applicant confirms that one site included in the Rural Landmarks Survey may be impacted by the proposed rezoning. Specifically, the Seven Oaks house (ID #34-1067) is located on the property, south of the portion proposed for rezoning. This structure is listed as "potentially significant" in the Rural Landmarks Survey. The Study of Civil War Sites in the Shenandoah Valley published by the National Park Service includes the North Stephenson property within the Second Battle of Winchester battlefield study area and also the Third Battle of Winchester study area. The study indicates that the property is in an area that has lost its integrity as a battlefield resource. The property is not located either within or immediately adjacent to core battlefield area. The applicant indicates that the Seven Oaks property will be well buffered from the proposed commercial use by existing vegetation and zoning ordinance requirements. Lawrence, Director Re: Historic Resources Advisory Board Review — North Stephenson Inc., Rezoning Dear Mr. Lawrence: The purpose of this letter is to request inclusion on the Historic Resources Advisory Board (HRAB) December 17, 2002 agenda to discuss the referenced rezoning proposal. North Stephenson Inc., is proposing a rezoning of a portion of a 37.9 -acre parcel to establish approximately 6.45 -acres of heavy commercial use in Frederick County. The Frederick County Rural Landmarks Survey identifies Seven Oaks (34-1067) as a potentially significant structure on the 37.9 -acre parcel. The Seven Oaks house is currently used for residential purposes. North Stephenson, Inc., proposes to continue this use following the rezoning of the 6.45 -acre portion of this site. The southern boundary line for the proposed rezoning is located approximately 200 feet from the potentially significant structure. The Seven Oaks house is surrounded by mature trees and other vegetation, which coupled with the required buffer and screening of the heavy commercial acreage, will mitigate impacts to this structure. It should be noted that the Virginia Department of Transportation (VDOT) preliminary plans for Interstate 81 widening identify right-of-way needs that will significantly impact Seven Oaks. The applicant will provide for the Interstate 81 right-of-way as a condition of the rezoning, and is amenable to allowing for Seven Oaks to be inventoried and cataloged should this improvement impact the structure. Please find attached a map and orthophotography identifying the potentially significant structure, as well as information obtained from the Department of Historic Resources pertaining to the identified site. The presentation will provide information on what core battlefield parcels have been determined viable for preservation efforts. Item # 3 Review of Shen -Valley Lime Corporation Rezoning Proposal The Historic Resources Advisory Board has been requested to review and provide comment on the Shen -Valley Lime Corporation rezoning proposal, which has been submitted by Greenway Engineering. The proposal seeks to rezone approximately 215 acres from EM (Extractive Manufacturing) for use as an industrial park. The property is located south of Stephens City on the west side of Valley Pike, north of Family Drive in the Back Creek Magisterial District. The applicant confirms that three sites included in the Rural Landmarks Survey are proximate to the proposed industrial park. Specifically, LaGrange (ID #34-69), Dalke's Theater/Family Drive -In (ID #34-300) and Sycamore Hill (34-1003) are located east and south of the property. (Please see attached exhibit provided by the applicant.) It is noted that LaGrange and Sycamore Hill are included on the survey's list of "potentially significant" properties. The Family Drive -In has been determined eligible for listing on the State and National Register of Historic Places. The Study of Civil War Sites in the Shenandoah Valley published by the National Park Service does not include the property within any battlefield study areas. The applicant is proposing to develop a buffer with screening along the Shen -Valley Lime Corporation's boundary with the Family Drive -In. The applicant proposes to require developed sites within the proposed industrial park located within 300 feet of the Family Drive -In to utilize downcast lighting to prevent glare onto the adjoining property. Shen -Valley Lime Corporation is proposing a rezoning of five parcels totaling 215 acres to create a new industrial park with railroad access in Frederick County. The Frederick County Rural Landmarks Survey identifies three potentially significant sites within the proximity of this acreage. These sites are identified as 34-69 LaGrange, 34-300 Dalke's Theatre (Family Drive -In) and 34-1003 Sycamore Hill. The identified sites are located on the east and west side of Valley Pike (Route 11 South) with the LaGrange and Dalke's Family Drive -In sites adjoining the Shen -Valley Lime Corporation parcels. The developed area of the Dalke's Family Drive -In site is located closest to the parcels proposed for rezoning, sharing a property boundary line of approximately 285 feet, while the LaGrange house is located approximately 1,950 feet (0.4 miles) from the Shen -Valley Lime Corporation property. The Sycamore Hill site is located approximately 1,600 feet (0.3 miles) southeast of the location of the proposed entrance to new industrial park. It is the applicant's intention to submit a conditional zoning application to Frederick County for the new industrial park. The applicant will propose to develop a buffer with screening along the 285 -feet of shared boundary with the Dalke's Family Drive -In that will be consistent with the buffer and screening that is developed to protect the houses just to the north of the theatre. Furthermore, the applicant will propose to require any industrial site that is developed within 300 feet of the Dalke's Family Drive -In to utilize downcast box lighting fixtures that are shielded so that lighting does not impact the adjoining property. The applicant believes that the distances between LaGrange and Sycamore Hill and the new industrial park are adequate to protect these potentially significant sites. Please fmd attached a map and orthophotography identifying the potentially significant sites, digital images depicting the relationship between the adjoining properties and information obtaining from the Department of Historic Resources pertaining to each identified site.
