Tierney, Deputy Director RE: Meeting Notice and Agenda DATE: January 24, 1990 There will be a meeting of the Frederick County Historic Resources Advisory Board at 7:30 p.m., on Tuesday, February 20, 1990, in the conference room of the old County Court House, 9 Court Square Winchester, Virginia. Please let me know if you are unable to attend. There are a couple of informational items in addition to item related to the agenda included in your package. AGENDA 1. Presentation by representatives of the Caleb rezoning application of a revised Third Battlefield Preservation Area 2. Formulation of recommendation to Board of Supervisors on the Caleb Rezoning application. 3. other. 9 Court Square - P.O. Box 601 - Winchester, Virginia - 22601 Historical Review Board, Agenda items February 20, 1990 1. G.W. Clifford and Associates have revised the staff's proposal of an area to be set aside as a Third Battle memorial park. The revision adjusts the boundary of the designated area so as to make a more workable layout from an engineering stand point. 2. The acreage encompassed in the applicants version amounts to significantly more than was originally included in the staff proposal, ( flet acres verses approximately 100 in the staff proposal). In this proposal all housing units are located within the wooded area of the Caleb parcel and would therefore be less visible from the preserved battlefield area. The area of Dupont's Hill is preserved and connected to the main acreage of the park. (A copy of the G.W. Clifford Associates proposal is enclosed.) In light of this and other proffers made by the applicant in relation to historic preservation on the site; " All infrastructure other than roads shall be located underground, and any land disturbed during construction shall be restored to its original condition after construction is finally completed. The applicant shall provided suitable buffering and landscaping along any road which may be constructed, compatible with the historic preservation purposes of this proffer, and approved by the Director of Planning and Development as being in accord herewith and with the standards established in the Frederick County Zoning Ordinance." the staff supports this revision. There is however, a significant amount of detail which remains to be worked out in terms of the county's actual acceptance of such a dedication. The staff recommends the following: 1. The applicant include a financial contribution and or actual construction of park facilities as a proffer. 2. The applicant proffer that any and all artifacts related to the battle which are unearthed during construction also be given to the county to be displayed in a battlefield museum to be located within the park. 3. The details pertaining to layout and funding of the park be worked out with representatives of the Parks and Recreation Department and the Boards of Supervisors. 4. That this site, and a larger area surrounding this site, be considered for designation as a historic district at such time as the county develops the appropriate regulations. 5. That the HRAB recommend to the Board of Supervisors that concerns over the historical significance of this parcel will have been adequately addressed if the conditions listed above are met. 3. Other. Price REV. 2.0 COUNTY of FREDERICK IDepartment of Planning and Development 703/665-5651 MEMORANDUM FAX 703/667-0370 TO: Planning Commission Members FROM: RCT, Deputy Director DATE: February 21, 1990 RE: HRAB action on the Caleb Rezoning Application At their regular meeting of February 20, 1990, the members of the Frederick County Historic Resources Advisory formulated a recommendation opposing the rezoning application of the Top of Virginia Development Corporation for the Caleb Heights Development. The recommendation was stated as follows: " The HRAB feels that the entire Caleb Heights parcel and surrounding area, comprising the undeveloped portion of the Third Battle of Winchester, are of such historical significance that the dedication of any portion of the Caleb Heights tract for a memorial park, would not adequately compensate for the residential development of another portion." The HRAB has scheduled a meeting for March 7, 1990 to finalize a more detailed statement of the rational supporting their motion. 9 Court Square - P.O. Box 601 - Winchester, Virginia - 22601
