The CPPS will discuss the following agenda items: AGENDA 1) Continuation of discussions regarding the Northeast Land Use Plan review. 2) Other. Staff has been directed to advise all committee members that access to the County Administration Building -for night meetings that do not occur in the Board room will be limited to the back door of the four-story wing. I would encourage committee members to park in the county parking lot located behind the new addition or in the Joint Judicial Center parking lot and follow the sidewalk to the back door of the four-story wing. U TOMMITTEESTPPS\Agendas\2002 Agendas\November I I, 2002.wpd 107 North Kent Street • Winchester, Virginia 22601-5000 ITEM #1 CONTINUATION OF DISCUSSIONS REGARDING THE NORTHEAST LAND USE PLAN REVIEW The Comprehensive Plans and Programs Subcommittee (CPPS) has been reviewing the Northeast Land Use Plan (NELUP) for the past few months, per a directive of the Board of Supervisors. More specifically, the committee was tasked with reviewing the industrial and historic land uses, both existing and as proposed in the Northeast Land Use Plan. During the CPPS' monthly meeting in August, the committee achieved a consensus that the land uses identified in the adopted NELUP were generally acceptable west of Martinsburg Pike (Route 11), and north of Walters Mill Road (Route 836). As a result, the CPPS Chairman requested that each committee member provide staff with a potential land use scheme for the land located south of Walters Mill Lane (Route 836), and east of Martinsburg Pike (a.k.a. "concentrated study area"). During September, staff received a number of potential land use plan scenarios from the CPPS membership. These potential land use plan alternatives were distributed to the CPPS membership under a memorandum from the Planning Department dated September 24, 2002. This September 24, 2002 memorandum and associated alternative land use schemes are available via the internet at http: //www. co. frederick. va. us/planninganddevelopment/Alternatives. htm Staff has enclosed, with this agenda package, a land use alternative which draws from the various land use suggestions received from the committee. Specifically, this alternative recognizes the concerns raised and identified in various committee alternatives, and suggests that industrial land use is not appropriate west of the CSX railroad. Accordingly, the proposed industrial land use label, as well as the SWSA, have been removed from this area. Shenandoah Valley Battlefield Foundation The Shenandoah Valley Battlefield Foundation (SVBF) has undertaken an effort of analyzing Winchester's historical areas. This exercise looks at various documents regarding civil war battles and other historical features. It is the SVBF's intent to identify land parcels which have retained their historical integrity, as well as those properties which are viable for preservation. This information, when made available, could be considered for incorporation into the NELUP. Land Owners' Request Staff has received a proposed land use alternative from the property owners who jointly own a majority of the land located south of Old Charlestown Road (Route 761) and east of Martinsburg Pike (Route 11). In a letter from Mr. Shockey and Ms. Slaughter, dated October 31, 2002, they request that the County consider a future residential planned community land use on their properties. The adopted NELUP presently identifies their lands for future industrial use. The letter of request, as well as their proposed revisions to the NELUP are attached. Conclusion Staff suggests that the committee be prepared to discuss the various land use alternatives that have been enclosed with this agenda. In addition to the documents noted above, staff has included a copy of the approved NELUP within the agenda. Lawrence, Planning Director Re: Northeast Land Use Plan Revision Dear Mr. Lawrence: The purpose of this letter is to request consideration of the attached general land use plan by the Frederick County Board of Supervisors, Planning Commission and Comprehensive Plans and Programs Subcomrnittee (CPPS). The attached general land use plan is in response to the CPPS consideration of revisions to the Northeast Land Use Plan. The Northeast Land Use Plan was adopted as a component of the Frederick County Comprehensive Policy Plan in January 1997 (then known as the Route 11 North Land Use Plan). This general land use plan was revised and adopted in September 2000 to include additional land from Interstate 81 Exit 321 to the West Virginia line between Berkeley County and Frederick County_ The adoption of each plan extended the Frederick County Sewer and Water Service Area (SWSA) to provide for the development of future land uses within the northeast area. The adopted original land use plan and the adopted revised land use plan identify the future land use for the area south of Old Charles Town Road (Route 761) and east of the CSX Railroad as industrial. Furthermore, both plans were adopted to identify a major collector road to provide for a connection between Old Charles Town Road and Martinsburg Pike (U.S. Route 11), with a secondary connection between the major collector road and Redbud Road (Route 661). Finally, a Developmentally Sensitive Area (DSA) designation was established along the Milburn Road (Route 662) corridor, which also identified land area between Milburn Road and the CSX Railroad due to its historic significance. The Board of Supervisors denied a request to rezone 404 acres of Shockey land to M1, Light Industrial District in August 2001. The opposition to this industrial request suggested that a better use of this land was appropriate and that the industrial proposal was not a smart growth plan. The attached general land use plan is intended to provide the Board of Supervisors and the community with a smart growth plan for this portion of the Northeast Land Use Plan. This proposal calls for the revision of the future industrial land use bubble on the south side of Old Charles Town Road and east of the CSX Railroad to a future residential planned community land use bubble. The future residential planned community land use bubble provides an opportunity to utilize smart growth principles that will enhance File 92760C Northeast Lard Use Plan Revision Letter Page —2 - October :31, 2002 development in this area of the community. The residential planned community proposal will provide for a mixture of housing types to create a range of housing opportunities and choices, will provide for mixed land use to provide opportunities to live, shop and work in the same community, will provide for public service and public recreation use which is limited in this area of the community, will provide for neighborhoods that promote walkability and active recreational areas, will cluster development to provide for preservation of open space, historic and environmental areas, will utilize low impact development techniques and best management practices to promote infiltration and water quality and will utilize design techniques and standards to foster distinctive, attractive communities with a strong sense of place. The Shockey and McCann families control much of the land area on the south side of Old Charles Town Road and east of the CSX Railroad. The proposal to modify the future industrial land use bubble to the future residential planned community bubble is acceptable to both families. A map depicting the land owned by the Shockey and McCann families has been provided in addition to the proposed land use plan revision for the Northeast Land Use Plan. Representatives of Greenway Engineering will attend the November 11, 2002 Comprehensive Plans and Programs Subcommittee meeting to address questions of the subcommittee regarding this proposed land use plan revision. Thank you for the opportunity to submit a proposal that addresses the community's desire for smart growth opportunities within Frederick County. We appreciate your consideration of this matter.
