The Frederick County Comprehensive Plans and Programs Subcommittee (CPPS) will be meeting
on Monday, December 7, 1998 at 7:30 p.m. in the first floor conference room of the County
Administration Building, 107 North Kent Street, Winchester, Virginia. The CPPS will discuss the
following agenda items:
AGENDA
1) Request from Kenneth Marshall to incorporate 120 acres into the county's Urban
Development Area (UDA). This acreage is located between Cedar Creek Grade (Route 622)
and the Winchester & Western Railroad, adjacent to western corporate limits of the City of
Winchester.
2) Request of Greenway Engineering to incorporate 162 acres into the county's Sewer and
Water Service Area (SWSA). This acreage is located on the south side of Tasker Road
(Route 642) between White Oak Road (Route 636) and the Eastgate Commerce Center.
3) Discussion regarding the Capital Improvements Plan for the 1999-2000 Fiscal Year.
4) Discussion regarding the Southern Frederick Land Use Study.
5) Other.
Staffhas been directed to advise all committee members that access to the County Administration Buildingfor night
meetings that do not occur in the Board room will be limited to the back door of the four-story wing. I would
encourage committee members to park in the county parking lot located behind the new addition or in the Joint
Judicial Center parking lot and follow the sidewalk to the back door of the four-story wing.

Item #1: Marshall UDA Expansion Request
Please find included under this agenda item a letter from Mr. John C. Lewis, P.E., C.L.A., to Mr. Kris
C. Tierney, Planning Director, dated October 27, 1998, and three exhibits depicting the location the
two tracts owned by Mr. Marshall, zoning information, topography, and the limits of the county's
Urban Development Area (UDA). Mr. Lewis has requested that the two tracts, totaling 119.27 acres,
be incorporated into the UDA for the purpose of rezoning this acreage to the highest and best use.
The Comprehensive Policy Plan states that the predominant type of development in the UDA will be
suburban residential, and will also include areas of commercial and industrial development. The
information provided by Mr. Lewis indicates that public water and sewer owned by the City of
Winchester is located at the northern and southern property limits, that the topography lends itself
for gravity sewer, and that the proposed extension of Jubal Early Drive will traverse this acreage.
Staff has invited Mr. Lewis and Mr. Marshall to address the CPPS during the December meeting.
The CPPS should consider the following issues during this discussion:
1) Is it reasonable to consider other properties within the proximity of the Marshall tracts for
inclusion in the UDA or is this a valid request on its own merit?
2) What does Mr. Marshall believe to be the highest and best use of the 119.27 acres?
3) What impact will this request have on Cedar Creek Grade until Jubal Early Drive is ultimately
constructed to Route 37 West?
Note: The Winchester City Council recommended approval of the Jubal Early Drive improvement
project with three caveats during their November 10, 1998 meeting. These caveats include
no through truck traffic and no access from properties in the county. City Council approved
this resolution by majority vote noting that if any of the conditions were rejected by VDOT,
that the project would come back to them for another vote. Staff discussed this issue with
Mr. Byron Cobourn, VDOT Staunton District Construction Engineer, and was advised that
VDOT had not reviewed the resolution delineating these caveats; however, those type of
conditions were not acceptable to VDOT. Therefore, it appears that the Jubal Early Drive
extension project, particularly the timing associated with construction is uncertain.
The CPPS will ultimately be asked to forward a recommendation to the Planning Commission and
Board of Supervisors. This recommendation will be for approval or denial of the request. This
recommendation could be made during the December meeting, or at a subsequent meeting should the
CPPS desire staff to provide additional information or conduct further research.

On behalf of Mr. Kenneth Marshall, I am requesting consideration by Frederick County for the
adjustment of the current limits of the Urban Development Area, UDA, such that lands owned by
Mr- Marshall would be included within the adjusted limits. The Urban Development Area is a
planning tool which essentially divides the county into rural and urban areas. Exhibit 3 shows the
present delineation of the UDA in the area of the subject property. Inclusion into the UDA would
be the first step towards inclusion of this property into the sewer and water service area and then
toward a potential rezoning wherein the highest and best use of the land could be realized.
Mr. Marshall owns approximately 120 acres bordering the Winchester City limits between Cedar
Creek Grade and the CSX Rail Road right-of-way. Please refer to Exhibit 2. Public water and
sewer facilities are located at both the northern and southern property limits. The land lies within
the natural drainage shed of the existing sewer system and could be served generally by a gravity
line. These facilities are owned by the City of Winchester. Providing these services to the property
would require the exercising the reciprocal agreement which is now in place between Frederick
County and the City of Winchester.
The land to the east and north of the property includes the Meadow Branch Planned Urban
Development and the Orchard Hills residential development. Both of these developments are
within the city limits of Winchester. The land to the west is zoned RA and is currently used for
residential and agricultural purposes. Vacant land lies across the Cedar Creek Grade right-of-way.
This land is zoned RA. Please refer to Exhibit 1,
Exhibit 3 shows the conceptual extension of Jubal Early Drive as it crosses the northern portion of
this property departing from Meadow Branch and eventually connecting to Route 37. Recent
newspaper articles indicate that the City of Winchester is again considering some options
regarding the extension of Jubal Early Drive in this area. The extension of this road through the
subject property will obviously have significant impacts on its potential development.

With factors such as proximity to public utilities, accessibility to Cedar Creek Grade, proximity, to
Route 37, potential frontage on Jubal Early Drive extension, and proximity to high density
residential development in the City of Winchester, it appears that the time is appropriate for Mr.
Marshall to work with Frederick County to plan for the highest and best use of this property.

Item #2: Orndoff SWSA Expansion Request
Please find included under this agenda item a letter from Mr. Ralph Beeman, Greenway Engineering,
to Mr. Evan Wyatt, Deputy Planning Director, dated November 25, 1998, and two exhibits depicting
a location map of the county's Sewer and Water Service Area boundary (SWSA), and signatures of
six property owners. Greenway, Engineering has requested that the six tracts identified by the
property owner signatures be incorporated into the SWSA. These tracts total 162.32 acres and range
in size from 1.41 acres to 120.73 acres. The Comprehensive Policy Plan states that suburban
residential development has to occur in the Urban Development Area (UDA); therefore, properties
that are incorporated into the SWSA are limited to commercial and industrial development.
In January 1991, the Comprehensive Plans Committee considered a similar request to include these
properties, as well as additional properties to the east into the SWSA. On April 10, 1991, the Board
of Supervisors approved an expansion of the SWSA to incorporate the tracts east ofthese properties
which comprise the Eastgate Commerce Center and the Jouan Global Center. It is unclear why the
six properties under consideration at this time were not included into the SWSA in 1991; however,
according to a conversation between staff and Ms. Omdoff, it may have been the result of the
property owners request to not be included at that time.
Staff has invited Mr. Beeman and the six property owners to address the CPPS during the December
meeting. The CPPS should consider the following issues during this discussion_
1) Is it reasonable to consider the inclusion of the six tracts into the SWSA at this time based on
the development activity to the east and west of these properties and the completion of
Tasker Road (Route 642)?
2) What impact will this request have on Front Royal Pike (Route 522 South), White Oak Road
(Route 636) and Tasker Road?
The CPPS will ultimately be asked to forward a recommendation to the Planning Commission and
Board of Supervisors. This recommendation will be for approval or denial of the request. This
recommendation could be made during the December meeting, or at a subsequent meeting should the
CPPS desire staff to provide additional information or conduct further research.

Item #3: 1999-2000 Capital Improvements Plan
During the November meeting, representatives of the Frederick County Public School Board, the
Department of Public Works, and the Winchester Regional Airport presented new capital
improvement project requests to the CPPS, and the Director of Parks and Recreation updated the
subcommittee on the status of the field house and indoor pool project which was included during the
1998-1999 Capital Improvements Plan. The CIP functions as an advisory document to communicate
the capital facility needs of various county departments and agencies. This document serves as a
budgetary tool that is utilized by the Board of Supervisors, the County Administrator and the Director
of Finance to determine which projects can be funded through the general fund or loan sources, as
well as a tool to realize development proffers for capital projects.
The CPPS felt that the new project requests should be incorporated into the 1999-2000 CIP, and
determined that the current system utilized to rank project priorities should be modified to include
a weighted category that awarded points based on agency priorities. The CPPS directed staff to
prepare an amendment to the rating system and provide information depicting the project ratings
based on the new criteria. The CPPS also directed staff to update the text and financial information
associated with the 1999-2000 CIP for consideration during the December meeting.
Included under this agenda item is information regarding the CIP Evaluation Form including the new
rating category, updated financial information, and the modifications to the text from the 1998-1999
CIP. Staff asks that the CPPS consider this information and be prepared to forward a
recommendation to the Planning Commission and the Board of Supervisors for the disposition ofthis
matter.

Item #4: Southern Frederick Land Use Study Discussion
Staff has reviewed the information received during the public meeting process and has prepared
materials for review by the CPPS. These materials include information regarding the study area
boundary, the limits of the Sewer and Water Service Area (SWSA), and recommendations for future
land use development within the study area.
Staff will be conducting a work session with the Planning Commission and the Board of Supervisors
on December 9, 1998 from 6:00 p.m. to 7:00 p.m. in the Board Room of the County Administration
Building. The purpose of this work session is to present recommendations of the CPPS and receive
direction from the Board that will be utilized to develop a preferred alternative land use plan. Staff
will conduct another public information meeting once this plan and accompanying information have
been prepared to demonstrate the results of the information received and to obtain additional input.
