At a Special Meeting of the Board of Supervisors of Frederick
County, Virginia, held at the Court House thereof, on Friday, February 12, 1937.
PRESENT: C. I. Brumback, Chairman, C. M. Rosenberger, E. W.
Adams, P. H. Gold, W. H. Branner, B. P. Harrison, Commonwealth's Attorney and Harry L.

IMPROVEMENT OF CLERK'S OFFICE
After further consideration, it was unanimously decided to
allow the minute of January 29, in reference to the rejection of bids for the Clerk's
Office, stand approved.
INSURANCE FOR COURT HOUSE
On motion of Mr. Gold, seconded by Mr. Rosenberger, it is
unanimously ordered that $20,000:00 additional fire insurance shall be placed on the
Court House and said insurance shall be divided equally between the following agents:
0. L. Jamison, I. N. Good and J. W. Baker. Said policies to be written for three years
and the said protection shall be from this date.
FIRE PROOFING BOILER ROOM
On motion Phil H. Gold is appointed a committee to have the
boiler room fire proofed under the Court House.
REMODELING CLERK'S OFFICE
On motion the following resolution was unanimously adopted:
"Be it resolved, that the plans and specifications for the
improvement and enlargement of the Clerk's Office heretofore submitted, be, and they are
hereby re- adopted and approved, and the Clerk of this Board is authorized and directed
to advertise for competitive bids for the construction provided for in tl.e plans and
specifications. Bids for the construction, heating plant and plumbing are to be sub-
mitted separately. This advertisement shall be by publication in The 'Kinchester Evening
Star and the form and terms thereof shall be substantially as follows:-
BIDS FOR REMODELING AND ENLARGING
FREDERICK COUNTY CLERK'S OFFICE
Sealed proposals will be received by the Board of Supervisors of Frederick
County, Virginia, at the office of the Frederick County Clerk, not later than 10 o'clock
A. M., March 6th, 1937, and there p - dblicly opened and read immediately thereafter for
the construction of the following project.
Remodeling and building an addition to the County Clerk's
Office, located in Winchester, Virginia, according to plans and specifications on file
at the office of the County Clerk, Winchester, Virginia.
Said plans, specifications and forms of proposal made be
obtained at the office of the County Clerk, Winchester, Virginia, upon deposit at the

said Office of $25.00 by certified check, of vihich $20.00 will be refunded upon return
of same in good condition within ten days after the opening of bids.
All proposals shall conform to specifications complied by the
Architect and sealed and plainly marked, but the bids for heating shall be separately
submitted and the bids for the plumbing shall be separately submitted. All bids must
be accompanied by certified check or acceptable bidder's bond in the amount of 5% of the
total bid made payable to the Clerk of the Board of Supervisors. The said check or
bond will be returned to the unsuccessful bidders within ten days after the 6pening of
bids.
The successful bidder shall furnish a bond in the amount of
the contract price, issued by a responsible surety, approved by the Frederick County
Board of Supervisors. Should the successful bidder fail to furnish the said bond and
execute the contract within twenty days after the notice of acceptance of his proposal,
the five per cent bid check or bidder's bond will be forfeited to the Board of Supervisors
of Frederick County, as liquidated damages. Public liability and workmans compensation
insurance satisfactory to the said Board of Supervisors in accordance to the Virginia
State Law must be carried by the contractor.
After bid opening no bidder may withdraw his bid for a period
of thirty days. The work to start not later than April 1, 1937 and to be completed
within five (5) months t:ereafter.
The Board of Supervisors reserves the right to reject any or
all bids.

On motion of W. H. Branner, seconded by E. W. Adams the bid
for remodeling and enlarging the Clerk's "ffice, of Stuart M. Perry, Fred L. Glaize, Jr.,
and Philip B. Glaize, trading as Perry Construction Company, for the sum of $23,449.95,
in accordance with specifications on file in the Clerk's Office and advertisement hereto-
fore published and subject to the building supervisor's approval of materials and supplies
to be furnished, be and it hereby is accepted subject to the execution of a formal con-
tract in accordance therewith but with one exception thereto, that is to say: Rock
excavation is to be $2.50 per cubic yard additional. On a recorded Vote upon said
motion is was unanimously carried.

The minutes of the last regular meeting and of the special

RETRANSFERING OF ROAD FUNDS
On motion of Mr. Rosenberger, seconded by Mr. Branner the
following resolution was unanimously adopted.
Whereas on December 16, 1936,'a resolution was adopted by the

Board transfering $2653.35 to the Greenspring Road Rt C -654, this fund to /supplemented by
Federal funds in connection with the constructioni_of this road, provided relief labor
would be available to prosecute this project, and
Whereas the Board has been advised by the local Federal P.W.A.
authorities that there is not sufficient relief labor available in this section to proper•
ly staff this proposed work;

it is ordered that the said amount of $2653.35 be re- transferred to the ordinary mainten-
ance on the secondary system to be used at his discretion as it may be required.
RESOLUTION UPON DEATH OF R. S. SMITH
On motion the following resolution was unanimously adopted.
"Whereas Divine Providence has called to His Eternal Home our
friend and co- taborer, Robert S. Smith, who for the past twenty two years, has been
Treasurer of Frederick County.
Therefore, be it resolved, that the Board of Supervisors
cause to be entered of record the deep sense of sorrow felt by the individual members of
this Board. In our official relations we bear witness to the marked efficiency with which
the office of Treasurer was conducted by Mr—Smith. Robert Smith will be remembered by
the citizens of Frederick County, first, for his spirit of Good Fellow ship to all men,
for the marked efficiency with which he'kept the Count records and always as the Prince
of Good Fellows by his co- laborers and all with whom he came in contact.
Therefore it is ordered that these resolutions be entered of
record in the supervisors's minute's and a copy supplied the family and published in The

Evening Star.

Board with a list of secondary roads and suggested that they be dropped from maintenance
and after due consideration of the same, it is unanimously decided to drop the following:
Myers Road: Route C -613 Yyers Road from intersection of Route 612 to a point 0.2 miles
North r, it intersects Route 600; to be abandoned 1.1 miles; and that ti following
roads be recommended to be included in the secondary road system under state maintenance:
Cooper Road in Back Creek Dist: Beginning at the intersection of Houte 614 at Star Tanner
E. Church and extending in a South '.:esterly direction for a distance of 1 mile to Cedai
Creek at Shenandoah Co. line.
Spiggle Road: That part of the Spiggle road described as beginning at a point .1 of a
mile west of intersection of Route 11 and at intersection of routes 624 and 625 and ex-
tending West a distance of approximately 1/8 of a mile to a point between the W. H. Spigg:
and Hottle farms.
Glaize Street, in "''laize Addition" on Paper ?'ill Road: Glaize Ave. in Glaize Addition

to leave the chimneys as mere in said office originally, except to close up the fire place;

MINUTES OF THE PREVIOUS MEETINGS
The minutes of the last regular meeting and of the two special
meetings of March 13 and of April 5, were read and unanimously approved.
BAND STAND
On motion it is ordered that the Apple Blossom Festival
Committee be allowed to erect a band stand on the north east corner of the hitching yard,
for use during the two nights of the Apple Blossom Festival. Said stand to be erected an(
torn down at the expense of the committee.
FENCE AT COUNTY HOME
The committee for the County Home is authorized and directed
to purchase wire to build a fence at the County Home, which County Home property adjoins
the C. L. Robinson Estate, Fred Robinson, Charles A. Lupton Estate and Bond Borthers. The
above named adjacent landowners to repair and rebuild their portion of said fence. It
is further ordered that a copy of this minute be sent to each of the above named parties.

TRANSFER OF FUNDS
Whereas, Opequon District owes no more District road debts;
it is ordered that all balances accumulated now and hereafter from unpaid taxes in Opequ
on District for Opequon Road District debt be transferred to the The County School Fund
to be applied to The Opequon District School debts made prior to consolidation of the
County unit school system.
TRANSFER OF FUNDS
It is ordered that the Treasurer transfer from The General
County Fund to The Virginia Public Assistance Fund, $679.00 for the period beginning
April 1, 1937 and ending July 1, 1937.

REPORT OF MRS. NALLEY
Mrs. Eulalia S. Nalley, Superintendent of the Board of Public
Welfare, presented her report and the same was unanimously approved.
CHECK TO R S. SYJTH ESTNTE
It is ordered that a check be drawn by the Clerk, payable to
the estate of R. S. Smith for the sum of $489.09. It appearing from the auditor's
report that R. S. Smith, former County Treasurer, had carried from time to time certain
of his personal funds which had accrued from commissions several years back while he
worked under a fee system and in order to close his accounts, it is necessary to with-
draw this amount from The General County Fund to balance his books as Treasurer.
REPORT OF III SS FARRAR
Miss Elizabeth Farrar, Home Demonstration Agent, presented
her report and the same was unanimously approved.
STATE HIGHWAY COMMISSION MEETING
On motion, the Board hereby authorizes the Chairman and as
many of the other members of the Board to attend the hearing of the Highway Commission
at Lynchburg on April 14, 1937, asking that Frederick County be allotted at least
$25,000.00 more money for the secondary road systemp and that Route 275 (from Route 50
Highview)and Route 50 to the Shenandoah River, be completed.
RAISE OF SCHOOL LEVY
The School Board appeared before the Board and presented
tentative budget for the fiscal year beginning July 1, 1937 and ending July 1, 1938,
wherein they show a deficit for the year ending July 1, 1937 of $10,327.84, in the ope
tion of an eight months school system in Frederick County; and
Whereas, the said School Board asked the Board of Supervisors
to increase the County levy for school purposes from 901 to $1.00 to help wipe out this
deficit and to increase the teachers salaries 5jo, and the said increase on the present

valuation would only represent 60% of the deficit as shown in the fiscal year ending
July 1, 1937. After due consideration, the question was discussed from many angles and
a record vote was taken on the question of the increase of the County levy: Mr. Rosen
for; Mr. Adams, against; her. Branner, against;. Mr. Gold, for; and Mr. Brumback, for.
Whereas said motion was carried.
ROAD PASSING OPEQUON M. PRES. CHURCH
It was brought to the attention of the Board in regards to
a former petition and resolution passed by the Board on May 11, 1936, relative to a road
leading off Route 11 at Kernstown, passing by the Opequon Memorial Presbyterian Church,
intersecting with Route 652; the Highway Department is asked to consider this road on
behalf of these petitioners and the congregation who attend this Church to have this road
maintained and kept in a passable condition.
THE DOUBLE "S" CURVE
Whereas, U. S. Highway No. 50 is a main travelled east and
west highway extending entirely across the continent and carries very heavy traffic
the northern portion of Virginia; and
Whereas, said Route No. 50 enters Virginia at the state line
between Hampshire County, West Virginia, and Frederick County, Virginia, and at a point
in Frederick County, Virginia, approximatelk thirteen miles west of Winchester said high-
way passes over a grade and a series of blind curves known as the "Double S "; and
Whereas, the State of West Virginia has improved said highway
across that state, largely eliminating dangerous curves so that the travelling public
entering Virginia no longer anticipates such dangers as exist at said "Double S" and
because of this fact numerous serious accidents have occured at said point in Virginia;
Now, therefore, be it resolved by the Board of Supervisors of
Frederick County, Virginia, at regular session, that the State Highway Commission of
Virginia be, and it is hereby requested to re- locate and re -build said Route No. 50 at
said point known as the "Double S" to the end that said blind curves and general
condition may be eliminated and the said road may be made reasonably safe for the travel-
ling public.
Warrants Nos. 1974 to 2037, inclusive, totaling $2,828.59,
were approved and ordered to be paid from The General County Fund.
Warrants Nos. 128 to 134, inclusive, totaling $110.90 were
approved and ordered to be paid from The Dog Fund.
Warrants Nos. 267 to 312, inclusive, totaling $1,128.47 were
approved and ordered to be paid from The Virginia Public Assistance Fund.

And it is further ordered that the Clerk shall certify a copy
of this resolution to the State Highway Department immediately.
R. S. SMITH ESTATE
Whereas, the Attorney General has ruled that the warrant for
$86.24, issued to the estate of the late R. S. Smith, should have been for $36.12 for
salary and office expenses.
Therefore, it is ordered by the Board of Supervisors that
Mrs. R. S. Smith be requested to refund $50.19, the difference between the above amounts,
to the County Treasurer and it is ordered that a corrected expense account be submitted
to the State.

and the Board of Supervisors that the contractor A be permitted to change from the specifi-
cations as written on said Clerk's Office, in regards to -the windows;. that the contractor

may use all wood, frame and windows instead of steel sash and frames as specified in
the specifications throughout the old and new structure at the same price named in
tract by contractor and lintels be placed in all windows of old structure; the cosh and
installation of same to be paid by party of the first part and all new shutters to be
used throughout the old and new structure except in the western exposure of the new
structure which contractor
may ise
the
old steel shutters
now on the old structurewith
no additional cost to the
party of
the
first part.
