Chairman Sempeles called the meeting to order at 3:25 p.m.
MINUTES OF MAY 19, 1998
On a motion made by Mr. Rinker and seconded by Mr. Wakeman, the minutes for the
May 19, 1998 meeting were unanimously approved as presented.
Variance #011-98 of Cynthia D. Ebert for an 11 -foot rear yard setback variance for an attached
addition to an existing single-family residence. This property is located at 208 Lakeridge Drive,
and is identified with Property Identification Number 7511-3-7-197 in the Shawnee Magisterial
District.
ACTION - APPROVED
DISCUSSION
Mr. Lawrence read the application background and the staff comments, and presented
photographs of the property and of the crawl space for the Board's review.
Cynthia D. Ebert, applicant, came to the podium and described the property's water
problems in the crawl space and the related storage space concerns. She described her difficulties with

the builder and the realtor in regard to the water problems, and the attempts to rectify the problems by
installing a sump pump and gravel for drainage but the storage space still never dried out completely.
A second sump pump was installed after the first one failed; then that one burned out and a third one
was installed which also broke down.
Chairman Sempeles asked how high the proposed storage building would be and whether
she would settle for a seven -foot instead of an 11 -foot variance; Ms. Ebert replied that the building
would be as high as the present roof, that she wants to leave the deck where it is so she would prefer
to keep the request at 11 feet.
Ms. Linda D. Hobbs, who was also present and would be living in the house, added that
the builder told them that architecturally, it would not be wise to build longer than the width of the
house.
Mrs. Catlett asked Ms. Ebert if she wanted living space upstairs and storage space
downstairs. Ms. Ebert replied it made sense to have it that way because they were both teachers and
the new addition would allow them enough room for their computers, and to not have to go outside to
get to the storage area as they do now.
Chairman Sempeles asked if there were any other houses that had extensions in the back.
She said that other neighbors had pools or decks that had been added after the houses were built but
to her knowledge, no other neighbors had the same water problems. One neighbor had an outside
storage shed but there was a concern with temperature extremes in the winter and summer months.
Mrs. Catlett asked if the builders she had spoken with assured her that she would not
have the same water problems in the new addition. Ms. Ebert replied that they felt relatively certain the
addition would not have the same problems due to the shale base and because it would be built up high
enough.
Mr. Rinker commented that it seemed that installing vents in the crawl space would help
to dry it out; Ms. Ebert said there were already six vents in place and it didn't help much. Mr. Rinker
asked if the new storage space would have a concrete floor; Ms. Ebert was not really sure and would
have to check with the builder.
Eric Lawrence, Zoning Administrator, pointed out that there was some discussion as to
how far the back of the house is from the back property line, and that if Ms. Ebert were to only get an
eight -foot variance, she would only be able to build an eight -foot wide room. He also stated that there
was a large open space area behind Ms. Ebert's property so if she were to build, nothing would be built
behind her.
There was no one else present to speak for or against the variance request.
Mr. Wakeman moved for approval of the variance as requested; Mr. Rinker offered a
second. The motion was unanimously approved.

BE IT RESOLVED, that the Frederick County Board of Zoning Appeals does hereby approve, by
unanimous vote, Variance #011-98 of Cynthia D. Ebert for an 11 -foot rear yard setback variance
for an attached addition to an existing single-family residence.
ADJOURNMENT
No further business remained to be discussed and the meeting was adjourned at 4:00
p.m. by unanimous consent.

VARIANCE: Request for a 5.8 -foot front yard setback variance for an existing home.
REASON FOR VARIANCE: Applicant states that the house was built in 1990; the house was
purchased in 1993 and they were unaware of the problem and are now trying to sell. They have
found the house to be over the 35 -foot setback line; variance is needed to resolve problem.
STAFF COMMENTS: Within the RP (Residential Performance) zoning district, the front yard
setback is 35 feet. This house was constructed in 1990, prior to the implementation of setback survey
standards, 29.2 feet away from the front property line, thus requiring the 5.8 -foot front yard setback
variance.
It is staff's belief that the fact that this building was constructed in violation of the setbacks should
have been addressed at the time of construction and during the inspection process, in particular, at
the time a final Certificate of Occupancy was issued. This obviously did not occur. Therefore, staff
is of the opinion that this variance request meets the test for Board of Zoning Appeals as specified in
Section 15.2-2309(2(b)(1), (2) and (3) of the Code of Virginia. Strict application of the Zoning
Ordinance would produce an undue hardship; this hardship is not shared generally by other properties
in the vicinity, and approval of the variance request will not have a detrimental impact on the
adjoining properties or the Zoning District as a whole.

REASON FOR VARIANCE: Applicant states that "topographical conditions would not let us
move house back any further. Pumped water out of footer for two days and high point of property
is for drain field. I met with Frederick County Health Department."
STAFF COMMENTS: Within the RA (Rural Areas) zoning district, the minimum front yard
setback is 60 feet. The residence that is currently under construction is located 49.4 feet away from
the front property line; therefore, requiring a 10.6 -foot variance to bring the structure into compliance
with the setback requirements.
The house is being built in violation of both the setback requirements and the building permit. The
building permit states that the house is to be located 150 feet from the front setback. Without the aid
of a new building permit, the house was relocated to its current position. It is clear that there is a
drainage/water concern associated with Hiatt Run, limiting the location of a residence and the
location of a sewage disposal system. However, the applicant has not demonstrated that the house
could not have been placed on the 6.5 -acre parcel in conformance with the building setbacks.

The Code of Virginia, Section 15.2-2309(2) states that no variance shall be authorized by the Board
unless it finds that a) strict application of the ordinance would produce an undue hardship; b) that
such hardship is not shared generally by other properties in the same zoning district and the same
vicinity, and; c) that the authorization of such variance will not be of substantial detriment to adjacent
property, and that the character of the district will not be changed by the granting of the variance.
Staff is of the opinion that strict application of the ordinance would not produce an undue hardship
approaching confiscation of the property. It would appear as though the house could have been
placed on the high point of the property to the north of the current location, meeting the setback
requirements, while implementing an alternative health system.

STAFF COMMENTS: Within the Ml (Light Industrial) zoning district, the side yard setback is 25
feet. The existing building was constructed 18 feet from the property line requiring the seven -foot
side yard setback variance. The applicant is proposing to submit a site plan for an additional storage
building in the near future. Prior to this submission, the issue pertaining to the location of the existing
building must be resolved.
Upon visiting the property, staff observed an additional zoning violation. As depicted in the
accompanying pictures, an inoperable trailer and old construction materials are located to the rear of
the existing building. As a condition of the variance, the removal of this additional violation should
be guaranteed.

It is staffs belief that the fact that this building was constructed in violation of the setbacks should
have been addressed at the time of construction and during the inspection process, in particular, at
the time of the final building inspection and Certificate of Occupancy. This obviously did not occur.
Therefore, staff is of the opinion that this variance request meets the test for Board of Zoning Appeals
as specified in Section 15.2-2309(2(b)(1), (2) and (3) of the Code of Virginia. Strict application of the
Zoning Ordinance would produce an undue hardship; this hardship is not shared generally by other
properties in the vicinity, and approval of the variance request will not have a detrimental impact on
the adjoining properties or the Zoning District as a whole.
STAFF RECOMMENDATION: Approval with the condition that the inoperable trailer and
construction materials are removed from the property.

I (we), the undersigned, do hereby respectfully make application, and petition the Frederick
County Board of Zoning Appeals (BZA) to grant a variance to the terms of the Frederick County
Zoning Ordinance as described herein. I agree to comply with any conditions for the variance
required by the BZA
I authorize the members of the BZA and Frederick County officials to go upon the property
for site inspection purposes.
I understand that the sign issued to me when this application is submitted must be placed at
the front property line at least seven (7) days prior to the BZA public hearing and maintained so as
to be visible from the road or right-of-way until the hearing.
