Tierney, Planning and Development Director; Carol Cameron, Secretary CALL TO ORDER Chairman Sempeles called the meeting to order at 3:35 p.m. MINUTES OF MAY 20, 1997 On a motion made by Mr. Larrick and seconded by Mr. Wakeman, the minutes for the April 15, 1997 meeting were unanimously approved as presented. PUBLIC HEARING (3:40 p.m.) Appeal Application #006-97 of CFJ Properties (Flying J) to appeal the determination made by the Director of Planning and Development in the administration of the Zoning Ordinance regarding commercial business signs within the IA (Interstate Area) Overlay District. Variance Application #007-97 of CFJ Properties (Flying J) for a 20' sign height variance, and a 198.95 - square -foot sign size variance for a business sign within the Interstate Area Overlay District. The property is located at 1530 Rest Church Road and is zoned B3 (Industrial Transition) District and IA (Interstate Area Overlay) District. The site is identified with Property Identification Number 33-9-1 in the Stonewall Magisterial District. ACTION - TABLED - TO BE HEARD ON OR PRIOR TO AUGUST 20, 1997 2 DISCUSSION Mr. Ruddy informed the Board that the applicant, CFJ Properties, Inc., had submitted a letter requesting a continuation on their application. A copy of the letter was made available to each Board member. Mr. Ruddy suggested that the Board may wish to address each item individually and to follow the procedures as outlined in the By-laws. Chairman Sempeles asked if anyone from CFJ Properties wished to speak. Mr. Richard Carlisle, an attorney representing CFJ Properties, Inc., spoke on behalf of the applicant stating that he had spoken with staff and that if the Board agreed to it, the continuation date of August 18, 1997 was suggested. He apologized for the short notice. Mr. Larrick asked why they were being asked to continue the hearings. Mr. Carlisle replied that they needed more time, and again referenced their discussion with staff in tenons of dealing with policy issues. He also stated that they needed to get a crane out there [proposed site] to literally show how high 20 feet is over the mean sea level. Mr. Larrick asked Mr. Kris Tierney, Director of Planning and Development, if staff concurred that tabling the application was an appropriate action. Mr. Tierney replied that he had met with representatives from Flying J regarding what is the appropriate height for a sign at the proposed location, and staff is not fully convinced that what Flying J is asking for, and the information they have provided, justifies the request. He stated they had no problem with granting the applicant more time. Mr. Sempeles asked if the `new agenda for this would set a precedence for a new sign height or dimensions in the next meeting.' Mr. Tierney replied he did not know what it would do but the applicant wanted to erect a crane at the proposed sign site to show the actual size, and that there were issues in the ordinance involving signs in the IA Overlay District that were subject to interpretation. Some discussion followed regarding whether it had been clearly stated to the applicant how much ground work needed to be done on the sign along the interstate, which direction on I-81 were they talking about [for the observation of the sign], and whether the visibility was more prevalent going south or going north. Mr. Ruddy mentioned that the By-laws state that when an item is tabled, a date needs to be set to bring the item back up and that 90 days would be appropriate. This would set the next date for hearing the item at August 19th. 3 Mr. Sempeles asked why it was going to take three months. Mr. Tierney replied that from the staffs perspective, rather than run the risk of coming back to the BZA with an incomplete application, they would rather err on the side of allowing too much time. If arnendments to the ordinance are in order, revisions take time. In reply to a question from Mr. Sempeles, he stated it was not staff's intention to change the format of the signs along the interstate but that multiple interpretations of the ordinance are possible and re -wording may be required in order to clarify the intent of the ordinance. W. Rinker questioned whether there would be a technicality question regarding the 90 -day tabling period because August 19th would actually be 91 days. Mr. Ruddy replied that if the tabling were an action of the Board, it would need to be acted on within 90 days but since the tabling is at the request of the applicant, the 90 -day requirement may be extended if the applicant is in agreement. Upon motion made by Mr. Larrick and seconded by Mr. Rinker, the Board unanimously consented to allow a continuance and that the matter be brought before this Board on or before August 20, 1997. MAGISTERIAL DISTRICT: Back Creek PROPERTY ID NUMBER: 58-1-1C PROPERTY ZONING & USE: Zoned RA (Rural Areas) District; Land use - Apple Orchard ADJOINING PROPERTY ZONING & USE: Zoned RA (Rural Areas) District; Land use - Apple Orchard and residential. VARIANCE: A 110' north side yard variance and a 135' west side yard variance for construction of a single-family residence. REASON FOR VARIANCE: See #12 and #13 on page 2 of application. STAFF COMMENTS: Within the RA (Rural Area) zoning district, the.minimum side and rear year yards for a principal structure when adjoining an orchard is 200'. The requested variance would place the proposed 90' x 60' structure 90' from the side yard and 65' from the rear yard. Staff is of the opinion that the requested side yard variance would be necessary to allow for the construction of a residence on the parcel. However, the requested rear yard variance warrants additional attention. From visiting the property, observing the rock ledge, and looking at the plat submitted with the application, it would appear that sufficient space is available in front of the rock ledge to construct the proposed residence. The proposed well and drainfield have not been constructed. Other alternative locations for these facilities may exist on the property. Regardless, the proposed structure could still fit in between the proposed well location and the rock ledge. Variance #008-97, Mike and Diana Crites Page 2 June 9, 1997 With regards to the rear yard request, strict application of the zoning ordinance would not prohibit the use of the property for residential purposes. The Code of Virginia, Section 15.1495(2)(a), states that no variance shall be authorized by the board unless it finds that strict application of the ordinance would produce an undue hardship approaching confiscation. Staff believes that granting the rear yard variance would be inappropriate as a hardship approaching confiscation does not exist. REASON FOR VARIANCE: See attached letter from applicant. STAFF COMMENTS: Within the RA (Rural Area) zoning district, the side yard setback when adjoining vacant land is 50'. The existing structure is located closer to the adjoining property line than is currently permitted. However, this 17'x 45' existing foundation is legally nonconforming. The addition to the existing foundation would increase the level of nonconformance. This is not permitted. In this case, strict application of the zoning ordinance does not prohibit the use of the property for residential purposes. The Code of Virginia, Section 15.1-495(2)(a) states that no variance shall be authorized by the board unless it finds that strict application of the ordinance would produce an undue hardship approaching confiscation. Staff believes that granting this variance would be inappropriate as a hardship approaching confiscation does not exist. The addition could be constructed in a manner that would not require a variance. Variance #009-97, Philip D.
