MEETING MINUTES
OF THE
FREDERICK COUNTY AGRICULTURAL DISTRICT ADVISORY COMMITTEE
Held in the first floor conference room of the Frederick County Administration Building, 107
N. Kent Street, Winchester, Virginia on July 26, 2016.
PRESENT: William Cline, Stonewall District; Cordell Watt, Gainesboro District; Jason
McDonald, Shawnee District; Carl Ay, Stonewall District; John Marker, Back Creek Alternate;
John Stelzl, Opequon District; Mark Sutphin, Extension Agent, and Ellen Murphy, Commissioner
of Revenue.
ABSENT: Dudley Rinker, Back Creek District; Harman Brumback, Back Creek District; and Gary
Lofton, BOS Liaison.
STAFF PRESENT: Mark Cheran, Zoning Administrator; Pam Deeter, Secretary.
CALL TO ORDER
The meeting was called to order by Mr. Cheran at 6:00 p.m.
Mr. Cheran presented to the Board that Mr. Bill Cumberland requested the removal of the six
(6) parcels totaling 407.48+/- acres from the North Opequon Agricultural and Forestal District.
This District was established in 2013 and has been renewed one time. The North Opequon
District was recently renewed in 2015 for a period of five years. This is a voluntary program and
we do encourage landowners to stay in for the renewal term. Staff is requesting a motion from
the ADAC for the removal of the six (6) parcels in the North Opequon District.
Questions and Discussion
A Board member ask is this the only landowner in this District. Mr. Cheran replied yes.
The Board member inquired who owns the property. Mr. Cheran stated it is Cumberland
Properties IV, Inc.
Mr. Gary Oates from GreyWolfe is representing the Cumberland Properties. This is Mr. Bill
Cumberland’s property. Mr. Cumberland is looking to remove the properties from the

Agricultural and Forestal and to place a Conservation Easement on his properties. Mr.
Cumberland has parcels of different acreage and is trying to even up the parcels. Since Mr.
Cumberland properties are in the Agricultural and Forestal District, he cannot do a boundary
line adjustment. Mr. Cumberland is trying to complete this process before the end of the year.
A Board member asked what the property use is. Mr. Oates replied is it used for hay or
hunting.
A Board member asked the question, after the properties are removed and the landowner
completes the conversation easement can the property come back into the Agricultural and
Forestal District. Mr. Cheran replied yes, he can but it will depend on how his easement is set
up.
On a motion made by Mr. Marker to remove the six (6) parcels totaling 407.48+/- acres from
the North Opequon Agricultural and Forestal District and seconded by Mr. McDonald and
passed unanimously.
