The Frederick County Agricultural District Advisory Committee (ADAC) will be meeting on
Tuesday, November 27, 2001 at 7:00 p.m. in the first floor conference room of the County
Administration Building, 107 North Kent Street, Winchester, Virginia. The ADAC will discuss the
following agenda items:
AGENDA
1) Request to remove Parcels 73-A-95, 73-A-99, 73 -A -99A and 73-A-102, owned by Rinker
Properties, LLC., from the South Frederick Agricultural and Forestal District.
2) Request to include Parcel 62-A-34, owned by Ruth Gregory, into the South Frederick
Agricultural and Forestal District.
3) Request to include Parcels 85-A-125, 85-A-130 and 85-A-131, owned by Mary Ritenour;
Parcel 85-A-132, owned by Sandra Ritenour; Parcel 85-A-129, owned by Steven and Mary
Ritenour; and Parcel 85 -A -125A, ownedbyBenjamin and Priscilla Ritenour, into the Double
Church Road Agricultural and Forestal District.
4) Other.

Staff has been directed to advise all committee members that access to the County Administration Building for night
meetings that do not occur in the Board room will be limited to the back door of the four-story wing. I would
encourage committee members to park in the county parking lot located behind the new addition or in the Joint
Judicial Center parking lot and follow the sidewalk to the back door of the four-story wing.

RINKER PROPERTIES, LLC.
PARCEL REMOVAL REQUEST
Please find attached a letter from Mr. Dudley Rinker to Evan Wyatt dated November 15, 2001. Mr.
Rinker has requested the removal of four parcels owned by Rinker Properties, LLC., from the South
Frederick Agricultural and Forestal District. The South Frederick Agricultural and Forestal District
was established in 1980 and has been renewed four times. The most recent renewal of this district
occurred in March 2000 for a period of five years. Currently, 11,926.64 acres are contained in this
district which are comprised of 179 parcels.
Mr. Rinker desires to remove four parcels totaling 160.80 acres from the South Frederick
Agricultural and Forestal District. Mr. Rinker has identified a need to pursue other options for this
acreage due to the financial constraints that local orchardists have experienced over the past several
years. Section 15.2-4314 of the Code of Virginia, 1950, as amended, provides property owners with
the ability to request removal of land from an agricultural and forestal district through a public
process through the local governing body.
Staff will present mapping during the committee meeting which delineates the location of this
acreage and its proximity to other land within the South Frederick Agricultural and Forestal District.
Staff requests that the Agricultural District Advisory Committee consider this request and forward
a recommendation to the Planning Commission and the Board of Supervisors for final determination
regarding this matter.

PARCEL INCLUSION REQUEST
Please find attached a form submitted by Ruth Gregory which requests the inclusion of Parcel 62-A-
34 into the South Frederick Agricultural and Forestal District. The South Frederick Agricultural and
Forestal District was established in 1980 and has been renewed four times. The most recent renewal
of this district occurred in March 2000 for a period of five years. Currently, 11,926.64 acres are
contained in this district which are comprised of 179 parcels.
The Gregory parcel is located on the north side of Middle Road (Route 628) across from the Orchard
View Elementary School. This parcel totals 107.79 acres and is intended to be included in the South
Frederick Agricultural and Forestal District. Section 15.2-4310 of the Code of Virginia, 1950, as
amended, provides property owners with the ability to request additions of land to an existing
agricultural and forestal district through a public process through the local governing body.
Staff will present mapping during the committee meeting which delineates the location of this
acreage and its proximity to other land within the South Frederick Agricultural and Forestal District.
Staff requests that the Agricultural District Advisory Committee consider this request and forward
a recommendation to the Planning Commission and the Board of Supervisors for final determination
regarding this matter.

RITENOUR FAMILY
PARCEL INCLUSION REQUEST
Please find attached a letter from Gary DeOms to Mary Ritenour dated October 23, 2000, and several
forms submitted by members of the Ritenour family which request the inclusion of Parcels 85-A-
125, 85 -A -125A, 85-A-129, 85-A-130, 85-A-131 and 85-A-132 into the Double Church Road
Agricultural and Forestal District. The Double Church Road Agricultural and Forestal District was
established in 1995 and has been renewed one time. The most recent renewal of this district
occurred in March 2000 for a period of five years. Currently, 1,131.46 acres are contained in this
district which are comprised of 30 parcels.
The Ritenour parcels are along Peace and Plenty Lane, immediately south of the County's Urban
Development Area (UDA). The parcels total 381.34 acres and are intended to be included in the
Double Church Road Agricultural and Forestal District. Section 15.2-4310 of the Code of Virginia,
1950, as amended, provides property owners with the ability to request additions of land to an
existing agricultural and forestal district through a public process through the local governing body.
Staff will present mapping during the committee meeting which delineates the location of this
acreage and its proximity to other land within the Double Church Road Agricultural and Forestal
District. Staff requests that the Agricultural District Advisory Committee consider this request and
forward a recommendation to the Planning Commission and the Board of Supervisors for final
