FREDERICK COUNTY BOARD OF SUPERVISORS
WEDNESDAY, JUNE 15, 2022

ATTENDEES
Board of Supervisors: Charles S. DeHaven, Jr., Chairman; Blaine P. Dunn; Judith McCann-
Slaughter; Shawn L. Graber; and Josh E. Ludwig were present. J. Douglas McCarthy, Vice Chairman,
participated remotely. Robert W. Wells was absent.
Staff present: Michael Bollhoefer,County Administrator; Roderick B.Williams,County Attorney;Scott
Varner, Director of Information Technologies; Jennifer Place, Risk Manager/Budget Analyst; and Ann W.
Phillips, Deputy Clerk to the Board of Supervisors.
CALL TO ORDER
Chairman DeHaven called the meeting to order at 6:00 p.m.
REMOTE PARTICIPATION AUTHORIZED
Supervisor Dunn moved that the Board of Supervisors of Frederick County approve remote
participation by Vice Chairman Doug McCarthy from Winchester for business reasons. Supervisor Graber
seconded the motion which carried on a voice vote.
ADOPTION OF THE AGENDA
Supervisor Dunn moved that the Board of Supervisors adopt the draft agenda with the addition of
the following action item prior to the Closed Session:Adoption of Operation and Maintenance; Facilities; and
Technology categories of the School Operating Fund budget and appropriation for the 2022-2023 Fiscal
Year, noting that Supervisor Wells has waived notice of the Board of Supervisors' special meeting with
respect to consideration of the budgeting and appropriation of the School Operating Fund. Supervisor Gaber
seconded the motion which carried on a recorded vote as follows:

ADOPTION OF FY 2022-2023 FUNDING AND APPROPRIATION OF FREDERICK COUNTY PUBLIC
SCHOOLS OPERATING FUND CATEGORIES OF OPERATION AND MAINTENANCE; FACILITIES;
AND TECHNOLOGY CATEGORIES AT 25% OF REQUESTED AMOUNTS -APPROVED
The Board discussed their recent request for further information from the School Board and the
response that had been received. Vice Chairman McCarthy called for the adoption of the resolution as
presented with funding by category as proposed by the School Board. Supervisors Dunn, Graber, and
Ludwig reiterated their desire for more detail about proposed spending in the three categories before
approving the full budget request.
Supervisor Graber moved for approval of FY 2022-2023 Funding and Appropriation of Frederick
County Public Schools Operating Fund Categories Of Operation And Maintenance; Facilities; And
Technology categories at 25%of the amount of each category as proposed by the School Board. Supervisor
Dunn seconded the motion. The Board further discussed the motion which failed on a recorded vote as
follows:

Vice Chairman McCarthy moved for approval of FY 2022-2023 Funding and Appropriation of
Frederick County Public Schools Operating Fund Categories Of Operation And Maintenance; Facilities; And
Technology categories at 25% of the amount of each category as proposed by the School Board with the
requirement that additional funding be re-addressed by the Board before July 31, 2022. Supervisor Dunn
seconded the motion which carried on a recorded vote as follows:

RESOLUTION
TO APPROVE FY2022-2023 FUNDING OFFREDERICK COUNTYPUBLIC SCHOOLS OPERATING FUND
CATEGORIES OF OPERA TIONAND MAINTENANCE;FACILITIES;AND TECHNOLOGYAT 25%OF THE
PROPOSED AMOUNTS
WHEREAS, a notice of public hearing and budget synopsis has been published and a public hearing held on March
23,2022,in accordance with Title 15.2, Chapter 25, Section 15.2-2506, of the Code of Virginia, 1950 as amended;
THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Frederick, Virginia, that the
Operation and Maintenance;Facilities;and Technology categories of the School Operating Fund budget for the 2022-
2023 Fiscal Year be hereby approved in the amount of$9,754,694.

BE IT FURTHER RESOLVED that the Operation and Maintenance; Facilities; and Technology categories of the
School Operating Fund budget for the 2022-2023 fiscal year be adopted categorically and the funds appropriated as
follows with funding of the remaining portion of each line item as requested being re-addressed by the Board of
Supervisors before July 31,2022:

CLOSED SESSION
At 6:31 p.m., Supervisor Slaughter moved that the Board of Supervisors of Frederick County enter
a closed session pursuant to Virginia Code Section 2.2-3711(A)(1) for personnel matters, specifically the
annual evaluation of the county attorney and the county administrator. Supervisor Dunn seconded the motion
which carried on a recorded vote as follows:

At 6:45 p.m., the Board members being assembled within the designated meeting place in the
presence of members of the public and the media desiring to attend, the meeting was reconvened on motion
of Supervisor Slaughter, seconded by Supervisor Dunn, and carrying on a voice vote. Supervisor Slaughter

moved that the Board of Supervisors of Frederick County certify that, to the best of each member's
knowledge, (i) only public business matters lawfully exempted from open meeting requirements by Virginia
law were discussed in the closed meeting to which this certification applies, and (ii)only such public business
matters as were identified in the motion convening the closed meeting were heard, discussed, or considered
by the Board. Supervisor Dunn seconded the motion which carried as follows on a recorded vote:
