SERVICE LEARNING FORUM CALL TO ORDER
Chairman DeHaven called the meeting to order at 6:00 p.m.
SERVICE LEARINNG STUDENT PRESENTATIONS
Deputy County Administrator Jay Tibbs explained the Service Learning Program.
Three student groups representing James Wood, Millbrook, and Sherando High Schools presented the
projects they had completed under the supervision of various County departments and community organizations.
Chairman DeHaven and the Board members thanked the students for their efforts and recessed the
meeting until 7:00 p.m.

Supervisor Wells delivered the invocation.
PLEDGE OF ALLEGIANCE
Vice Chairman McCarthy led the Pledge of Allegiance.
ADOPTION OF AGENDA-APPROVED
The proposed agenda was adopted on a voice vote following a motion by Supervisor Slaughter,
seconded by Vice Chairman McCarthy.
CITIZEN COMMENTS
Leslie Schottroffe, Opequon District, referred to the Short Term Lodging Ordinance Discussion on
the agenda. She said that the use of shared private driveways such as Wayne's Lane where she resides
needs to be resolved to address contention between neighbors when the private drives are overused by
short-term renters.
Mike Schottroffe, Opequon District, provided photos of Wayne's Lane and discussed the traffic
problems created by a recent wedding event at the rental property. He said the short-term rental is a business.
Sue Case, Opequon District, said she wants short-term rental owners to obtain written consent of
the neighbors if they are using a shared private driveway before getting a permit to operate the rental.
Stephen Carroll, Back Creek District, spoke in opposition to Conditional Use Permit #02-21 for Eli
Williams. He provided aerial photos of the proposed site and an existing event center property and said the
property is not large enough for an event center use and the proposed restrictions are not enough to protect
the neighbors.
Teresa Soto-Aguilar, Back Creek District, spoke in opposition to Conditional Use Permit#02-21 for
Eli Williams. She provided a property map of the area and said the property is residential rather than
agricultural and that more houses are being built in the neighborhood.
Margaret Thompson, Back Creek District, spoke in opposition to Conditional Use Permit#02-21 for
Eli Williams saying the property across from her home is slated for a 150-car gravel parking lot which will
create noise, dust, and traffic concerns.
Denny Derflinger, Back Creek District, spoke in opposition to Conditional Use Permit#02-21 for Eli

Williams.
Rodrigo Pineir, Back Creek District, spoke in opposition to Conditional Use Permit #02-21 for Eli
Williams saying the site would need a commercial-grade entrance and is too small for the proposed use.

RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF FREDERICK,
VIRGINIA ON THE ISSUANCE OF UP TO $120,000,000 OF REVENUE BONDS BY THE
ECONOMIC DEVELOPMENT AUTHORITY OF THE CITY OF WINCHESTER, VIRGINIA
FOR THE BENEFIT OF WESTMINSTER-CANTERBURY OF WINCHESTER,INC.
WHEREAS, Westminster-Canterbury of Winchester, Inc., d/b/a Shenandoah Valley Westminster-
Canterbury (the "Borrower"), a nonstock, not-for profit Virginia corporation, has requested that the Economic
Development Authority of the City of Winchester,Virginia(the"Authority")approve the Borrower's application that
requests that the Authority issue up to $120,000,000 of its revenue bonds in one or more series at one time or from
time to time(the"Bonds")and loan the proceeds of the Bonds to the Borrower:
(a) to finance all or a portion of an expansion project at the Borrower's facilities (the
"Facilities") located at 654 Fox Drive, Winchester, Virginia 22603 (a portion of which is located in the County of
Frederick, Virginia), including without limitation (i) the acquisition, construction and equipping of 10 new villa

buildings, including a total of approximately 97 additional independent living apartments, a community room and
garage space and(ii)the acquisition,construction and equipping of a multi-story,multi-purpose professional building
(collectively,the"Project");and
(b) to finance amounts required for reserves,capitalized interest,working capital and costs of
issuance incurred in connection with the issuance of the Bonds(together with(a),the"Plan of Finance");
WHEREAS,the Authority held a public hearing on May 17,2022;
WHEREAS, Section 147(f)of the Internal Revenue Code of 1986,as amended(the "Code"),provides that
the governmental unit having jurisdiction over the issuer of private activity bonds and over the area in which any
facility financed with the proceeds of private activity bonds is located must approve the issuance of the bonds and
Section 15.2-4906 of the Industrial Development and Revenue Bond Act,Chapter 49,Title 15.2,Code of Virginia of
1950,as amended("Act")sets forth the procedure for such approval;
WHEREAS, Section 15.2-4905 of the Act provides that if a locality has created an industrial development
authority,no industrial development authority created by a second locality may finance a facility located in the first
locality unless the governing body of such first locality concurs with the inducement resolution adopted by the second
locality;
WHEREAS,a portion of the Project is located in the County of Frederick,Virginia(the "County")and the
Board of Supervisors of the County(the"Board")constitutes the highest elected governmental unit of the County;
WHEREAS, in accordance with Section 147(f) of the Code, the public hearing held by the Authority was
within 100 miles of the County;
WHEREAS,for purposes of Section 15.2-4906 of the Code of Virginia of 1950,as amended(the "Virginia
Code"),the Authority is issuing the Bonds on behalf of the County;
WHEREAS,the Authority has recommended that the Board approve the Plan of Finance and the issuance of
the Bonds;and
WHEREAS,a copy of the Authority's resolution approving the issuance of the Bonds, subject to the terms
to be agreed upon,a certificate of the public hearing and a Fiscal Impact Statement have been filed with the Board.
NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF
FREDERICK,VIRGINIA:
1. The Board hereby approves the issuance of the Bonds, in an aggregate principal amount up to
$120,000,000,by the Authority for the benefit of the Borrower,solely to the extent required by Section 147(f)of the
Code and Section 15.2-4906 of the Code of Virginia of 1950, as amended, to permit the Authority to assist in
accomplishing the Plan of Finance.
2. The Board concurs with the resolution adopted by the Authority and approves the issuance of the
Bonds by the Authority for the benefit of the Borrower as required by Section 15.2-4905 of the Virginia Code.
3. The approval of the issuance of the Bonds does not constitute an endorsement to a prospective
purchaser of the Bonds of the creditworthiness of the Plan of Finance or the Borrower. In accordance with the Act,
the Bonds shall not be deemed to constitute a debt or a pledge of the faith and credit or taxing power of the
Commonwealth or any political subdivision thereof,including the Authority and the County.
4. This resolution shall take effect immediately upon its adoption.

WINCHESTER REGIONAL AIRPORT UPDATE
Executive Director Nick Sabo provided an update on the current activities at the Winchester Regional
Airport.
APPOINTMENTS TO BOARDS, COMMITTEES, AND COMMISSIONS
JENNIFER MYERS APPOINTED TO PARKS AND RECREATION COMMISSION—APPROVED
On motion of Supervisor Slaughter, seconded by Vice Chairman McCarthy and carrying on a voice
vote, Jennifer Myers was appointed to a four-year term as Stonewall District Representative on the Parks
and Recreation Commission beginning June 24, 2022, replacing Randy Carter who is no longer eligible
following redistricting.
GAYLE GUSTAFSON-FERREIRA REAPPOINTED TO SOCIAL SERVICES BOARD—
APPROVED
On motion of Supervisor Ludwig, seconded by Supervisor Graber and carrying on a voice vote, Gayle
Gustafson-Ferreira was reappointed to a four-year term ending June 30, 2026, on the Social Services Board.
GENE FISHER REAPPOINTED TO WINCHESTER REGIONAL AIRPORT AUTHORITY—
APPROVED
On motion of Supervisor Wells, seconded by Supervisor Slaughter and carrying on a voice vote,
Gene Fisher was reappointed to a four-year term ending June 30, 2026, on the Winchester Regional Airport
Authority.

cover the costs of maintenance and support for the public meeting streaming system and upgrades to

and a transfer from the County Capital Fund in the amount of $152,046. The total ($625,000) represents
funds needed to renovate space at Sunnyside Plaza to accommodate the relocation of the Voter Registrar's

PLANNING COMMISSION BUSINESS—PUBLIC HEARINGS
REZONING #02-22 OF R&J LAND DEVELOPMENT, LLC-APPROVED
Senior Planner Tyler Klein explained the application to rezone 1.444 acres from B3 (Industrial
Transition) District to B2 (General Business) District with proffers and 15.444 acres from B3 (Industrial
Transition) District to B3 (Industrial Transition) District with amended proffers. He said the rezoning
application modifies approved land uses associated with Rezoning Application (REZ) #01-06 and the
intended use of the proposed B2 zoned parcel is a general merchandise store (Dollar General).
Supervisor Dunn and Mr. Klein discussed the current owner and zoning issues which are being
addressed.
Tim Stowe spoke in favor of the rezoning on behalf of the applicant

ORDINANCE AMENDING
THE ZONING DISTRICT MAP
REZONING#02-22 R&J LAND DEVELOPMENT
WHEREAS, REZONING #02-22 R&J LAND DEVELOPMENT submitted to rezone 1.444-acres from B3 (Industrial
Transition) District to B2 (General Business) District with proffers and 15.444-acres from B3 (Industrial Transition)
District to B3 (Industrial Transition) District with amended proffers. The properties are located northwest corner at
intersection of Martinsburg Pike(Route 11)and Jeff's Way,and are identified by Property Identification Numbers 33-A-

Supplementary Use Regulations
§165-201.08 Protection of environmental features.
In order to protect those areas of a parcel which have environmental characteristics that make them unsuitable for
development, certain portions of a development shall remain undisturbed or be protected. It is the intention of this
section that the disturbance of such areas by the development process be limited. It is also the intention of this section
that the large portions of the areas with such environmental characteristics be placed in open space, environmental
easements,the portion of the parcel left undivided or other areas where they will remain undisturbed. It is intended
that the environmental conditions on a property be reviewed as the first step in the planning process before lots or
dwellings are located.
A. The requirements of this section shall apply to land in the following zoning districts:
RP Residential Performance District
R4 Residential Planned Community District
R5 Residential Recreational Community District
MH 1 Mobile Home Community District
B 1 Neighborhood Business District
B2 Business General District
B3 Industrial Transition District
OM Office-Manufacturing Park District

B. All developments which require a rezoning, master development plan, subdivision design
plan, site plan,or preliminary sketch plan shall preserve the following environmental features as
described:
(1) Floodplains. Disturbance of floodplains is only permitted in accordance with the
requirements of Article VII,Part 702,FP Floodplain Districts.
(2) Lakes and ponds. Lakes, ponds and impoundments shall remain undisturbed. The
Administrator may allow the removal of a lake,pond or impoundment if it serves no useful
retention,environmental,or recreational purposes.
(3) Wetlands, natural waterways, and riparian buffers. Disturbance of wetlands is only
permitted in accordance with the requirements of the United States Army Corps of
Engineers or other qualified state or federal agency.The disturbance of natural waterways
and riparian buffers is prohibited, except when necessary for, and only in conformance
with Part 702,the following:
a) Public or private utilities;
b) Public facilities,access to a property or roads(only perpendicular riparian buffer
crossings shall be permitted);
c) Riparian buffer restoration or enhancement projects;
d) Creation of wetlands;
e) Pedestrian,recreational and/or bicycle trails;and

f) The Zoning Administrator may allow for the disturbance of riparian buffers for
the creation of park areas or for stormwater management purposes.
(4) Sinkholes. No disturbance of sinkholes is allowed other than filling with nonpolluting
natural materials that will not contribute to groundwater pollution.
(5) Natural stormwater retention areas. No more than 10% of natural stormwater retention
areas on a site shall be disturbed. Natural stormwater retention areas may be replaced with
the approval of the Administrator by artificial stormwater facilities if the total storage
capacity of the site,as well as within each drainageway,is maintained. Natural stormwater
retention areas which are floodplains, wetlands, lakes or ponds shall not be disturbed or
replaced.
(6) Steep slopes. No more than 25%of steep slopes,as defined shall be disturbed or regraded.
The Zoning Administrator, through a written request made at time of site plan or
subdivision desrj plan, may allow the disturbance of additional small areas where that
disturbance will allewiate patential healt>, ^ a *., problems and will not significantly

C. In residential developments, the areas of undisturbed environmental features described in § 165-
201.0813 shall be located in areas of open space. However, the Zoning Administrator may allow
undisturbed areas to be included in the required setback and yard areas on residential lots when the
extent,location,and disturbance of environmental areas make it impractical to place the undisturbed
areas in common open space.In such circumstances,environmental easements,deeds of dedication,
final subdivision plats, or other legal instruments approved by the Zoning Administrator shall be
required to specify the restrictions to be placed on the environmental areas.
D. In rural preservation subdivisions, the environmental features described in § 165-201.0813, along
with agricultural or locally significant soils,shall be placed within the forth-percent parcel,without
undue detriment to other principles of quality subdivision design or significant loss of density, as
determined by the Zoning Administrator.
E. In commercial and industrial developments, the areas of undisturbed environmental features
described in § 165-201.0813, shall be located in areas of open space, environmental easements,
deeds of dedication, final subdivision plats or other legal instruments approved by the Zoning
Administrator which specify the restrictions to be placed on the environmental areas.

CONDITIONAL USE PERMIT #02-21 FOR ELI WILLIAMS - DENIED
Zoning &Subdivision Administrator Mark Cheran explained the request for a Conditional Use Permit
(CUP) to allow for the operation of a special event facility located at 1570 Gough Road, Winchester, in the
Back Creek Magisterial District. He reviewed the conditions suggested by the Planning Commission should

the Board find the application to be appropriate. He noted the public hearing had been held on April 27, 2022,
with the Board postponing action until this meeting.
Supervisor Graber proposed two additional conditions regarding amplified noise not being audible at
the property line and extending the time period in which neighbors could request additional landscape
buffering.
Supervisor Dunn and Supervisor Graber discussed the condition regarding 24-month review.
Supervisor Graber moved for approval of Conditional use Permit #02-21 for Eli Williams with the
addition of the two additional new conditions regarding amplified noise not being audible at the property line
and extending the time period in which neighbors could request additional landscape buffering. Supervisor
Dunn seconded the motion.
Supervisor McCarthy noted generally he is not in favor of Conditional Use Permits and with the
number of neighbors objecting to the permit he cannot support it.
Supervisor Graber said he hopes the conditions will protect the neighbors and also allow the
applicant to proceed with restoring and using the property.
The motion to approve Conditional Use Permit # 02-21 with the proposed conditions failed on a

ORDINANCE AMENDMENT—SHORT-TERM LODGING— REFERRED BACK TO PLANNING
Senior Planner Tyler Klein reviewed the request to amend Chapter 165—Zoning to add "short-term
lodging (STL)"to the definitions section, provide additional regulations for short-term lodging and add the use
to the RA(Rural Areas), RP (Residential Performance)and MH1 (Mobile Home Community)Zoning Districts.
He said as proposed by staff, Short Term Rentals would be permitted by-right through an administratively
reviewed permit process. He said staff has incorporated the changes suggested by the Board and was
seeking Board approval to send the amendment forward to public hearing.

The Board and Staff discussed the issue of private shared driveways being used for homes that are
short-term rentals, how to address neighbors on the shared driveways who object to the short term renters
using the driveways, property rights, whether to define a short-term rental as a business, whether short-term
rentals should be by-right or governed by a conditional use permit, permitting of short-term rentals as they
relate to the type of easement on a shared driveway, and the possibility of requiring a conditional use permit
only for those short term rentals on a shared driveway but not for those with access from a public road.
By consensus, the Board referred the matter back to the Planning Department for additional review.
BOARD LIAISON REPORTS
Supervisor Wells noted the Public Safety Communications Department has received accreditation by
the Virginia Office of Emergency Medical Services for performance in emergency medical dispatch at the
highest level of service. He also noted that on May 19, three emergency communications officers were
awarded the team of the year award by Virginia Association of Public Safety Communications officials for
stellar performance during an active shooter event.
CITIZEN COMMENTS
Earl Case, Opequon District, said the short-term rentals could be limited to properties accessed from
a state-maintained road to avoid the issue of shared private driveways being used by short-term renters.
Sue Case, Opequon District, said she doesn't understand why property-owners are left to deal with
the private driveway issue regarding short-term rentals. She said the short-term rental business should halt
until the issue is resolved.
Mike Schottroffe, Opequon District, noted that with his private shared driveway, a short-term rental
owner would need to contact only about eight or nine neighbors to obtain permission for use of the driveway
by renters if that were required.
Leslie Schottroffe, Opequon District, inquired about who would pay for the extra wear and tear on
the private driveway by short-term renters.

1. Frederick County Fire & Rescue public education on smoke
detectors/other:
Deputy Chief Fire Marshall Mark Showers addressed the committee regarding his
department's educational programs which are available to the citizens of Frederick
County. Along with addressing multiple public events (i.e. scout groups, fairs) and
the abundance of information found on the Frederick County Fire& Rescue
website, there are 15 second radio spots that run daily with helpful tips as well as
"Knock and talk" events that have taken place over the years. Volunteer Fire&
Rescue President Dan Cunningham reiterated that these are done by the volunteer
and career staff. The Fire Marshal's offices are currently looking into obtaining
grant funding for additional residential smoke detectors so this practice can grow in
the community.
2. Departmental updates:
Communications Director Perez stated that the department is currently holding
interviews for its 3 dispatcher vacancies. During the Public Safety Committee
meeting on 12/9/21, Director Perez requested a Radio System Administrator
position which the PSC recommended sending the request to the Human Resources
Committee. Mrs. Perez will be taking her request to the HR Committee for
finalization in the coming months. She also mentioned that 3 dispatchers,
nominated by their peers, have been awarded the Team of the Year by APCO
(Association of Public Safety Communications Officials) and will be officially

honored in mid-May. Also, the communications center has become EMD
(Emergency Medical Dispatch) accredited by the Emergency Medical Service
Board.
Chief Majchrzak stated the Fire& Rescue Department is doubling up on training
classes and hiring to fill current vacant positions. They are also holding discussions
about the long-range plan for the Fire& Rescue Department and volunteer
companies. Chief Majchrzak mentioned that Company 18 (Greenwood)has a letter
of intent to draw down from the proffer funds set aside in the amount of$41,398 for
renovations to the stations living quarters.
The consensus from the Public Safety Committee was to send the letter of intent to
the Finance Committee for approval of the withdrawal.
Captain Aleck Beeman discussed recent hiring and recruitment difficulties the
Sheriff's Office has been facing. When the department intends to offer a position to
a seasoned officer at a higher starting salary, they are being requested to provide
written justification for the higher salary to Human Resources and sometimes the
County Administration. Lt. Kittoe explained this can be very time consuming. She
went on to say that obtaining knowledgeable officers is difficult and candidates will
go elsewhere if they cannot be compensated appropriately. Mr. Williams said he
would have a discussion with the County Administrator to find out more about this
practice.

(7-0).
2.The Buildings and Grounds Committee made a motion to approve the installation of a Public
Safety Radio Tower at Clearbrook Park, seconded by Mr. Sandy. Based on assurances that
should Frederick Water ever need to install a water tower in Clearbrook Park, the Public Safety
Radio equipment will be integrated leaving only one tower at the park, the motion carried
unanimously(7-0).
3.The Buildings and Grounds Committee is recommending the installation of a fence at
Stonewall Park to separate users from the road near Roper Field and the fields dugouts. In
response to citizen comments regarding play features at Stonewall Park, the Committee is
requesting that staff return with playground options for their consideration.

1. The Planning Director provides a proposed Monetary Guaranty and Performance Agreement
policy and requests a recommendation from the Committee to the Board of Supervisors for
adoption of the policy. See attached policy, p.5—18. The committee recommends policy
adoption with the latitude to make minor edits via the County Attorney.
2. (*)The Parks& Recreation Interim Director requests a General Fund supplemental
appropriation in the amount of$1,500. This amount represents a donation for volleyball nets
at Clearbrook Park. No local funds required. See attached memo, p. 19.
3. The EMS Billing Manager requests an EMS Expense Recovery Fund supplemental appropriation
in the amount of$450,000. This amount represents expected revenue and expenses through
the end of FY 2022. No local funds required. See attached memo, p.20. The committee
recommends approval.
4. The Greenwood Volunteer Fire& Rescue Company President requests a General Fund
supplemental appropriation in the amount of$41,398.14. This amount represents available

proffer funds for the station renovation. This item was approved by the Public Safety
Committee. No local funds required. See attached memo, p.21—22. The committee
recommends approval.
5. (*)The F&R Chief requests a General Fund supplemental appropriation in the amount of
$7,000. This amount represents the sale of a trailer and will be used to purchase an inflatable
fire safety education house and cart. No local funds required. See attached memo, p.23—24.
6. (*)The EDA Director requests an EDA Fund supplemental appropriation in the amount of
$6,300. This amount represents funds received for the Employer Expo. No local funds
required. See attached memo, p.25—26.
7. (*)The EDA Director requests an EDA Fund supplemental appropriation in the amount of
$8,936. This amount represents funds received from Shenandoah County and the City of
Winchester for website design and an interactive jobs board for the regional partnership—
Shenandoah Valley Talent Solutions Coalition. No local funds required. See attached memo,
p.27—29.
8. (*)The Sheriff requests a General Fund supplemental appropriation in the amount of$100.
This amount represents donations for the Honor Guard and will be used for uniforms. No local
funds needed. See attached memo, p.30—33.
9. (*)The Sheriff requests a General Fund supplemental appropriation in the amount of$3,161.
This amount represents donations to the department and will be used for the impound lot
building. No local funds required. See attached memo, p.32—39.
10. (*)The Sheriff requests a General Fund supplemental appropriation in the amount of$4,560.
This amount represents traffic control recovered costs in excess of budgeted revenue and will
be used for overtime. No local funds required. See attached memo, p.40—41.
11. (*)The Sheriff requests a General Fund supplemental appropriation in the amount of
$43,278.36. This amount represents vehicle insurance claims to be used for replacements and
repairs. No local funds required. See attached info, p.42—47.
12. (*)The Sheriff requests a General Fund supplemental appropriation in the amount of
$11,235.74. This amount represents DEA reimbursements to be used for overtime. No local

13. (*)The Sheriff requests a General Fund supplemental appropriation in the amount of
$4,041.45. This amount represents reimbursement for IT equipment. No local funds required.
See attached memo, p.50—51.
14. The IT Director requests a General Fund supplemental appropriation in the amount of$71,811.
This amount represents restricted PEG funds to cover the costs of maintenance and support for
the public meeting streaming system and upgrades to microphones and camera. No local
funds required. See attached memo, p. 52—62. The committee recommends approval and
requests the IT Director obtain a cost estimate for broadcasting from the back of the BOS
meeting room.
15. The NRADC Superintendent requests a Jail Fund supplemental appropriation in the amount of
$300,000. This amount represents reimbursement of medical expenses for the last 3 fiscal
years. No local funds required. See attached memo, p.63. The committee recommends
approval.
16. The NRADC Superintendent requests a Court Services Fund budget transfer in the amount of
$3,000 from a fringe benefit line item to personnel. No local funds required. See attached
memo, p.64. The committee recommends approval.
17. The Deputy County Administrator requests a General Fund supplemental appropriation in the
amount of$472,954 from available proffer funds and a transfer from the County Capital Fund
in the amount of$152,046. The total ($625,000) represents funds needed to renovate space at
Sunnyside Plaza to accommodate the relocation of the Voter Registrar's Office. Any unspent
funds in FY22 will carry forward to FY23. The Public Works Committee has recommended
approval of the project. See attached memo, p. 65. The committee recommends approval.
18. The Registrar requests a General Fund supplemental appropriation in the amount of$28,000.
This amount represents the balance of funds needed to conduct the June 2022 primary
election. Local funds are required. See attached memo, p.66—67. The committee
recommends approval.
19. The WRA Director requests an Airport Fund supplemental appropriation in the amount of
$160,000. This amount represents funds needed for fuel sales through the end of FY22. No
local funds required. See attached memo, p. 68. The committee recommends approval.

20. The WRA Director requests an Airport Capital Fund appropriation in the amount of$100,000
and a General Fund supplemental appropriation in the amount of$27,504. These amounts
represent the FY2023 Airport Capital budget request and the associated County portion.
Airport Capital Fund and General Fund revenue and expenditure appropriations for open
purchase order balances at the end of FY2022 will automatically carry forward to FY2023.
Projects currently in process with a corresponding open purchase order have been previously
approved. See attached information, p.69—71. The committee recommends approval.
