PLANNING COMMISSION BUSINESS - PUBLIC HEARINGS
CONDITIONAL USE PERMIT #02-22 FOR REDBUD RUN SOLAR LLC - APPROVED
Senior Planner Tyler Klein explained the request for a Conditional Use Permit (CUP) to enable the
construction of an approximately 263-acre+/-utility-scale solar power generating facility on RA(Rural Areas)
Zoned property in the Stonewall Magisterial District and he reviewed the conditions suggested by the
Planning Commission should the Board find the application to be appropriate.
Chris Mohn of Greenway Engineering and Gary Verkleeren of Oriden Power briefly addressed the
Board. In response to Supervisor Dunn's question, Mr. Verkleeren said his company would be willing to
address reasonable noise concerns of persons dealing with medical issues.
Chairman DeHaven opened the public comment period.
No one addressed the Board.

AND SOLAR SITING AGREEMENT
REDEUD RUN SOLAR LLC ENERGY FACILITY
TO CONSTRUCT A UTILITY-SCALE SOLAR POWER GENERATING FACILITY
WHEREAS, Conditional Use Permit#02-22 for Redbud Run Solar LLC Energy Facility, was submitted to construct a
utility-scale solar power generating facility located on properties totaling approximately 263+/--acres. The subject
properties are generally located east of Woods Mill Road(Rt. 660)and north of Pine Road(Rt. 661),approximately 0.5-
mile north of Berryville Pike(Rt.7)and are identified with Property Identification Numbers(PINS)55-A-136, 55-A-137,
55A-1-19, 55A-1-21, 55-A-135, 55-A-134, 44-A-297, 44-A-294A, and 44-A-295 in the Stonewall Magisterial District.
Pursuant to Code of Virginia Section 15.2-2316.6 et seq., a solar facility siting agreement, between Red Bud Run Solar
LLC and the Frederick County Board of Supervisors is also being considered.
WHEREAS,Pursuant to Code of Virginia Section 15.2-2316.6 et seq., a solar facility siting agreement,between Redbud
Run Solar LLC and the Frederick County Board of Supervisors was also considered; and
WHEREAS, the Frederick County Planning Commission held a public hearing on this Conditional Use Permit on
March 2,2022 and recommended approval with conditions; and

WHEREAS,the Frederick County Board of Supervisors held a public hearing on this Conditional Use Permit and solar
facility siting agreement during their regular meeting on April 13,2022;and,
WHEREAS,the Frederick County Board of Supervisors finds the approval of this Conditional Use Permit to be in the
best interest of the public health,safety,welfare,and in accordance with the Comprehensive Plan;and
WHEREAS,the Frederick County Board of Supervisors,pursuant to Code of Virginia Section 15.2-2316.6 et seq,agrees
to the solar facility siting agreement with Redbud Run Solar LLC dated April 13,2022;and
NOW, THEREFORE, BE TT ORDAINED by the Frederick County Board of Supervisors that Chapter 165 of the
Frederick County Code, Zoning, is amended to revise the zoning map to reflect that Conditional Use Permit
Application#02-22 for the Redbud Run Solar LLC utility-scale solar power generating facility is permitted on the
parcels identified by Property Identification Numbers Property Identification Numbers(PINS) 55-A-136, 55-A-137,
55A-1-19, 55A-1-21, 55-A-135, 55-A-134, 44-A-297, 44-A-294A, and 44-A-295 in the Stonewall Magisterial
District.with the following conditions:
1. All review agency comments provided during the review of this application shall be complied
with at all times.
2. An engineered site plan,in accordance with the requirements of Article VIII of the Fredrick County
Zoning Ordinance, shall be submitted to and subject to approval by Frederick County prior to the
establishment of the use.The site plan shall address additional regulations for specific uses outlined
in§165-204.26 of the Frederick County Zoning Ordinance and be in general conformance with the
Concept Plan,included with the CUP application,prepared by Greenway Engineering,dated March
10,2022.
3. Pursuant to Code of Virginia§15.2-2241.2(B),the owner shall comply with the Decommissioning
Plan,included with the CUP application,prepared by Oriden,and shall update the
Decommissioning Plan every five(5)years.
4. Within thirty(30)days after the Commercial Operation Date,the Applicant shall make a one-time
payment to the County in the amount of Two Hundred and Fifty Thousand Dollars ($250,000.00).
These conditions shall be memorialized in a solar siting agreement, dated April 13, 2022, with
Frederick County,attached as Exhibit A of these Conditions,pursuant to Code of Virginia Section
15.2-2316.6 et seq.
5. Batteries,for the purposes of mass storage of electricity that will eventually be transferred to the
grid,shall not be used on the properties subject to this CUP.
6. Access to the site shall be limited to three(3)entrances from Woods Mill Road(Route 660), so to
provide one(1)entrance to each solar array land bay.One(1)entrance from Pine Road(Route 66 1)
to be used only during the period of construction shall also per permitted.Approval of the final site
entrance locations from Woods Mill Road is subject to review and approval by the Virginia
Department of Transportation at time of site plan.
7. Pile-driving of poles for solar arrays shall be limited to 8:00 a.m. to 5:00 p.m. Monday through
Friday.All other construction activities are permitted 7:00 a.m.to 7:00 p.m.Monday through Friday
and 7:00 a.m. to 5:00 p.m. on Saturday. No construction activities are permitted on Sundays or
federal holidays.
8. Any expansion or modification of this land use will require the approval of a new CUP.

BOARD OF SUPERVISORS COMMENTS
Vice Chairman McCarthy referenced the consensus of the Board at the previous meeting to withhold
$22 million from the school operating fund saying that enormous progress has been made in talks with School
Board members, and he no longer supports the withholding of these funds.
Supervisor Dunn discussed the competing interests for taxpayer monies. He said he has talked with
school staff and that withholding $22 million is not the answer to the problem.
Supervisor Ludwig reiterated his desire for transparency in budgeting. He said School Board
members and Board members have agreed on a template for a line-item budget that will allow the Board to
prioritize needs across the County.

ADOPTION OF FISCAL YEAR 2022-2023 BUDGET—APPROVED
Supervisor Slaughter moved for adoption of the proposed budget resolution with the restoration of
the $22 million to the school operating fund as advertised for the public hearing. Supervisor Wells seconded
the motion.

Vice Chairman McCarthy said he could not support the motion because he sees other needs such
as transportation that should be addressed.
Supervisor Slaughter said the School Board had passed the budget request with a 6-1 vote.
Supervisor Wells said passing the budget as advertised is the right thing to do.
Supervisor Dunn noted competing needs and the fact the funding in this budget includes funding for
needed firefighters.
Supervisor Slaughter implored the Board members to support the motion.
Vice Chairman McCarthy said the alternative budget scenario "C" does not include any cuts for the
schools and will offer funds toward other needs.

BE IT FURTHER RESOLVED that appropriations are hereby authorized for the central stores fund,special
welfare fund, comprehensive services fund, county health insurance fund, school health insurance fund, length of
service fund, special grant awards fund, employee benefits fund, maintenance insurance fund, development
project/transportation fund,ARPA fund,sales tax fund,commonwealth sales tax fund,unemployment compensation
fund,Forfeited Assets Program,Four-For-Life Funds,Fire Programs,and Economic Incentive funds equal to the total
cash balance on hand at July 1, 2022, plus the total amount of receipts for the fiscal year 2022-2023. The County
Capital Fund and Fire Company Capital appropriation will include the current year appropriation plus any unused

BE IT FURTHER RESOLVED that funding for all outstanding encumbrances at June 30, 2022, are re-

2021-2022 fiscal year.
BE IT FURTHER RESOLVED that the construction fund projects are appropriated as a carryforward in the
amount that equals the approved original project cost,less expenditures and encumbrances through June 30,2022.

TRANSPORTATION COMMITTEE REPORT to the BOARD OF SUPERVISORS
Monday, March 28, 2022

ATTENDEES:
Committee Members Present: Judith McCann-Slaughter, Chairman (Voting), Charles
DeHaven,Jr. (Voting), Kevin Kenney(Voting), Shontya Washington (Voting), Gary Oates
(Voting) and Lewis Boyer (Liaison Stephens City).
Committee Members Absent: Shawn Graber(Voting)
Staff Present: Assistant Director-Transportation John Bishop, and Kathy Smith,
Secretary.
ITEMS FOR INFORMATION ONLY:
1-Scoring Update for Unscheduled Non-Hardsurface Road Improvement: Staff gave a brief
overview on the updated scoring for the Non-Hardsurface roads that have been submitted for
paving requests. Currently, 19 roads are on the list. The Boards policy, prior to update of the
Secondary Road Improvement Plan,when there is an anticipation of sufficient funds to promote
roads from the scheduled to the unscheduled list. Staff noted the following are new roads added
to the list in which petitions have been received New Hope Road (Rt. 699) from Timber Ridge
School to North Frederick Pike (Rt. 522) and Mount Williams Lane (Rt. 612). The Committee
approved the updated list as this is the ranking that will be used in the coming update to the
Secondary Road Improvement Plan.
2-VDOT Request-Committee Concurrence on Siler Road Detour: VDOT has requested
Concurrence from the Committee to require a detour rather than maintaining through traffic
when the Siler Road Bridge superstructure is replaced. The detour would be approximately 4
miles for approximately 6 months. This option, while inconvenient to the local residents, will
reduce project cost by approximately$500,000.00 and reduce overall construction time. After,
discussion all the Committee members was in Concurrence of the request to move forward.
3-County Project Updates: Crossover Boulevard aka Tevis Street Extension/Airport Road/1-81
Bridge:The project is complete.The Final paperwork has been delivered to VDOT. Some of the
signal equipment is still outstanding to be replaced with what is on loan from VDOT.
Renaissance Drive: Staff is working through the agreement and real estate process with CSX.
This process is currently running long as there is coordination taking place between internal CSX
division and their design review consultant. Staff continues to push for resolution and the ability
to move on to bid.
4-Other: Staff has received correspondence from Senator Warner's office on the competitive
grant program. Staff will be looking into what is needed for the application process. Also,
Committee member Kevin Kenny made a recommendation for the Committee to investigate

Frederick County Middle School and the Gainesboro Elementary School traffic and the safety
issues in that area of Route 522 North. It was suggested to use proffer money to correct the
situation in a timely manner. Staff will update the Committee once more information is available.

1-Discuss the bid results/funding for Sunnyside Plaza-Renovation for Voter Registrar.
Staff provided an update on the subject project. We recently received bids for the renovation project
and the apparent low bid was received from KEE Construction, in the amount of$467,996.00.The total
project cost includes the construction bid, contingency, IT equipment and furniture, furnishings, and
minor expenses for a total cost of$625,000.00.
Jay Tibbs, Deputy County Administrator indicated the County proffer funds could be used for the building
renovation totaling $472,954.00. He requested the remaining $152,046.00 be transferred from the
County's capital fund.
A motion was made by committee member Strawsnyder recommending an approval of a total project
budget of $625,000.00 for the renovation of space for the Voter Registrar at Sunnyside Plaza, with
$472,954.00 from proffer funds and $152,046.00 from the County's capital fund. The motion was
seconded by committee member Fisher.The committee unanimously approved the motion.This request
will be forwarded to the Finance committee for further consideration.
2-Public Works Project Update
A. Landfill Cell Development-MSW Landfill Phase 3, Cell A project has been completed except
for minor items.We will move forward with requesting from DEQ for a certificate to occupy
the cell. This 11-acre cell has an estimated life of 12 to 15 years.This part of the project had
a cost of approximately$4 million.
B. We have completed construction of a 30 ft by 60 ft storage building at the Stephenson
Convenience Center. This project cost was approximately$110,000.00.

C. We have submitted a joint water permit to Virginia Marine Resources and Virginia DEQ
related to the future development of Phase 2 of our CDD landfill Permit 591. We anticipate
obtaining this permit within one year.
D. We are currently planning to perform the sinkhole remediation at Shawneeland over the
next few months. Due to rain and snow melt, the lake has risen several feet to cover the
sinkhole over. Once the water levels drop,we will remediate the karst features.
E. We are moving forward with upgrading the Gore convenience site. Project funds were
obtained from the capital budget, and we anticipate completing this project by late summer
of 2022.This project has a budget of$750,000.00.
F. The Renaissance Drive, Phase 2 road project is still on hold. We are awaiting comments and
permits from CSX railroad.We are unsure of when this process will be completed.
