PLEDGE OF ALLEGIANCE Supervisor Ludwig led the Pledge of Allegiance. ADOPTION OF AGENDA-APPROVED The proposed agenda was adopted as presented on a voice vote following a motion by Supervisor Slaughter, seconded by Supervisor Dunn. Supervisor Dunn noted that while there are differing opinions on the budget, all are working together for the good of the community. + + + + + + + + + + + + + + APPOINTMENTS TO BOARDS, COMMITTEES, AND COMMISSIONS JUSTIN KERNS APPOINTED TO PLANNING COMMISSION AS STONEWALL DISTRICT REPRESENTATIVE-APPROVED Supervisor Slaughter moved to appoint Justin Kerns to fill an unexpired term ending 1/22/2026 on the Planning Commission representing the Stonewall District. DeHaven, Jr. Aye Judith McCann-Slaughter Aye + + + + + + + + + + + + + + PUBLIC HEARINGS (NON-PLANNING ISSUES) FISCAL YEAR 2022-2023 BUDGET The County Administrator presented an overview of the proposed FY 22-23 budget. Chairman DeHaven opened the public hearing. The speakers were as follows: Lauren Cummings of the Northern Shenandoah Valley Substance Abuse Coalition noted recent activities of the Coalition and thanked the Board for its financial support. Timothy Coyne of the Public Defenders Office requested the Board supplement the funding for his office to allow salaries comparable to those in the office of the Commonwealth's Attorney. Jennifer Locke of Blue Ridge Legal Services explained the need for the non-profit's legal services for non-criminal legal matters involving low-income citizens. She said they are requesting funding of$4591 this year. Jimmy Roberts of the Shenandoah Area Agency on Aging thanked the Board for supporting the Agency noting they are requesting the same funding as last year with no increase. Elizabeth Sager, Shawnee District, called for civil behavior in meetings of the Board and School Board. Kristen Hepner, Shawnee District, spoke in support of approval of funding for the Schools in the full amount requested. Mike Faison, Gainesboro District, said he represented the local chapter of the NAACP and spoke in support of approval of funding for the Schools in the full amount requested. Lora Jarrell, Opequon District, asked the Board to put aside politics and spoke in support of approval of funding for the Schools in the full amount requested. John Wright, Red Bud District, said he is President of the Frederick County Professional Fire Fighters Association. He discussed emergency call volume and staffing shortages and requested the Board to fund the eight new positions requested by the Fire Chief. Bryan Smith, Gainesboro District, said he represented the Virginia Police Benevolent Association Minute Book 47 Board of Supervisors Regular Meeting of March 23, 2022 County of Frederick, Virginia 329 and recommend the Board implement all findings of the recent salary survey conducted by the County. Shelia Heishman, Opequon District, spoke in support of approval of funding for the Schools in the full amount requested. Steven Cuthrell, Red Bud District, spoke about the need for school choice and competition and suggested a temporary budget cut while the Schools fix issues and release information that the Board of Supervisors has requested. Patrick Anderson, Shawnee District, said he supported full funding for the schools, public safety, and parks and recreation. He asked that political theater come to an end and said the County has the wealth to fund the needs of the County. Leigh Ann Sweeney said she was representing the Health Department and urged the Board to fund the Department's financial request. Jason Tresidder, Shawnee District, said the tax rates have remained low and the Board has been able to fund the schools in the past. He urged the Board to find a way to fund the schools now. Allyson Thomas of the Lord Fairfax Soil and Water Conservation District reviewed some activities of the organization and thanked the Board for its support. Amy Williams, Opequon District, spoke in support of approval of funding for the Schools in the full amount requested. Gayle Ferreira, Shawnee District, said funding the Schools as requested could be reckless if the requests are not proven as needed. Ciera Ray, Shawnee District, spoke in support of approval of funding for the Schools in the full amount requested. Brian Nuri, Opequon District, spoke in opposition to school choice saying it will segregate the wealthy from the poor in the County. Sonia Marfatia-Goode, Back Creek District, said the Schools have presented a needs-based budget and that the Board can fund its proposed budget including the Schools' request with no tax increase needed. Terrel Goode, Back Creek District, spoke in support of approval of funding for the Schools in the full amount requested noting his concern that the Board is not prioritizing the right things. Jodi Yeggy, Red Bud District, spoke in support of approval of funding for the Schools in the full amount requested saying the County is not in a financial crisis and should be using the surplus funds for the benefit of the citizens. Shaniqua Williams, Shawnee District,spoke on behalf of the Frederick County Education Association Minute Book 47 Board of Supervisors Regular Meeting of March 23, 2022 County of Frederick, Virginia 330 in support of approval of funding for the Schools in the full amount requested. Brandi Hammond, Shawnee District, spoke in support of approval of funding for the Schools in the full amount saying that there is a variety of students who need different paths to success. John Paul McAveney, Shawnee District, provided a handout comparing local funding of school districts. He spoke in support of approval of funding for the Schools in the full amount requested. David Sovine, Red Bud District resident and Superintendent of Frederick County Public Schools, spoke in support of approval of funding for the Schools in the full amount requested, adding that the request for local funds is less than the last year's request. Chairman DeHaven opened the public hearing. + + + + + + + + + + + + + + PLANNING COMMISSION BUSINESS - PUBLIC HEARINGS— None BOARD LIAISON REPORTS Supervisor Wells noted the removal of the aquatics center from the CIP will affect the ability of the Parks and Recreation Department to request proffer funds, approximately$300 per new household, and he would like to see it returned to the CIP along with the fourth high school. Supervisor Dunn said the Fire and Rescue noted there are a couple of areas in the County where emergency vehicles can't access which need to be addressed. He also noted that longer response times west of I-81 need to be addressed. Supervisor Ludwig commented on the recent Planning Commission meeting. CITIZEN COMMENTS Bryan Nuri, Opequon District, commented on the recent actions of Supervisor Graber suggesting that he resign from the Board. Steven Cuthrell, Red Bud District, reviewed school choice options and the reasons they should be considered. Minute Book 47 Board of Supervisors Regular Meeting of March 23, 2022 County of Frederick, Virginia 331 Amy Williams, Opequon District, said that private schools are not required to address students with special needs and should not receive taxpayer funding Tim Regan, Back Creek District, said budgets should cut overhead spending rather than what is actually needed. He noted that emergency service calls are increasing, and the schools need funding. BOARD OF SUPERVISORS COMMENTS Supervisor Graber noted that the budget as proposed does include an increase in taxes with the rise in vehicle values. Supervisor Graber discussed allegations that he does not have invoices for FOIA requests made to the Schools, invoices for gender identity and sexual orientation issues training materials, or attendance sheets for students at Deep Equity programs. He noted a questionnaire answered by School staff listing $56,000 in Title I I funding via a grant that funded Deep Equity materials. He reviewed video of the recent joint meeting of the School Board and Board of Supervisors saying that he was interrupted 16 times and that he did not mouth a profanity during the meeting. Supervisor Wells thanked all those attending and speaking on the budget. He said he supported the budget as advertised and supported fully funding the request of the Schools. INFORMATION ONLY 1. The Director of Information Technology and MIS reviewed the proposed FY2023 budget with the Committee and reviewed several projects of note. a. The Director of Information Technology highlighted a later addition to the requested budget concerning NRADC and critical failures in their virtual environment. The committee concurred that due to the emergent nature of the issues, the request should move forward now. The IT Director will be submitting a request to the Finance Committee on this item. b. Other budget items were discussed i. Learning Management System ii. Replacement IPads for Fire and Rescue iii. Cybersecurity Managed Threat Response iv. Spare switches v. Training environment for Public Safety Software 2. The Director of Information Technology and MIS discussed an upcoming engagement with the Cybersecurity & Infrastructure Security Agency (LISA). The committee did express willingness to re-consider if replacement space was made available. 3. The Buildings and Grounds Committee made a motion recommending staff apply for several AARP Community Challenge grants that could provide funding for the Lakeside Lake fishing pier, Plant Sign program expansion for Clearbook, Sherando, and the Bowman Lake Trail, and additional Warrior Drive Playground features, seconded by Mr. Carter, carried unanimously(5-0). As no matching fund or local dollars are required of this grant opportunity, the Grant Application will be forwarded to the County Administrator for approval prior to submission. 4. FCPS presented a plan of traffic options for Sherando HS to the Building and Grounds Committee. The committee expressed strong reservations regarding the negative impact this iteration of the plan would have on the park and instructed staff and FCPS staff to return with a "win-win" pathways for their consideration. Mr. Sandy made a motion to table the discussion, seconded by Mr. Carter, carried unanimously (5-0). Policy requires action to transfer out of a fringe benefit line item. See attached memo, p.8—11. The committee recommends approval. NO ACTION REQUIRED BY BOARD OF SUPERVISORS: 1. The Public Works Director requests a General Fund supplemental appropriation in the amount of$750,000. This amount represents funds needed for the development of the Gore convenience site. This item has been through the Public Works Committee. Local funds are required. The committee has the option to transfer funds from the County Capital Fund. See attached memo, p. 12—15. The committee concurred to transfer funds from the County Capital Fund. No appropriation required. 2. The IT Director requests a General Fund supplemental appropriation in the amount of $733,943.
