RESOLUTION AUTHORIZING THE FREDERICK WATER TO PROVIDE WATER
AND SEWER SERVICE OUTSIDE OF THE SEWER AND WATER SERVICE AREA
FOR NICK SANTMIER(PIN: 76-2-A)
WHEREAS, Frederick County has received a request from Nick Santmier to authorize
Frederick Water to serve one parcel of land located at 1930 Front Royal Pike, Winchester,
identified by Property Identification Number 76-2-A (2.03 acres), in the Shawnee Magisterial
District; and
WHEREAS, This extension of water and sewer service would only serve Property
Identification Number 76-2-A (2.03 acres); and
NOW, THEREFORE, BE IT RESOLVED, that the Frederick County Board of Supervisors
approves the extension of water and sewer service outside of the Sewer and Water Service Area
for Nick Santinier for Property Identification Nw-nber 76-2-A (2.03 acres) and does hereby
authorize Frederick water to serve this property.

SUBJECT: Request to Extend Water and Sewer Service Outside the Limits of the SWSA
Nick Santmier—1930 Front Royal Pike, Winchester(PIN: 76-2-A)

Frederick County has received a request from Nick Santmier to authorize Frederick Water to
serve one parcel with public water and sewer. The subject property is located at 1930 Front
Royal Pike, Winchester. The 2.03-acre property is zoned BI (Neighborhood Business)
District and is identified by Property Identification Number(PIN): 73-2-A.
It is the policy of Frederick County that only properties within the Sewer and Water Service
Area (SWSA)may connect to public water and sewer. The subject property is adjacent to the
existing limits of the SWSA which is located along its southern property line. Due to the
property being outside the SWSA, a special exception from the Board of Supervisors is
needed to allow for Frederick Water to serve the property.
Since this exception is not seeking to expand the boundary of the SWSA, this request could
be decided by the Board of Supervisors without a public hearing or amendment to the
Comprehensive Plan. The attached resolution, if adopted by the Board of Supervisors,would
authorize Frederick Water to provide water and sewer service to this site.

Dear Frederick County Planning
I am the new owner of property 1930 Front Royal Pike Winchester,VA. My goal for this property it to
obtain water and sewer, in order to open a catering kitchen for my small business. This Property
Currently has no water or sewer on site and is zoned B1. So I am requesting the approval to receive
water and sewer to the property. This property Is located on the very edge of Frederick county's service
area. Frederick County has already run the main water line past my property going along 522. And they
went ahead and placed the water line and sewer in place for my property while the did that section of
construction.
I have already spoken with Frederick County water and sewer and I am aware of all costs associated
with this venture. Frederick county water is also fully aware of my desire and have agreed to service my
property.

I have also had conversations with Josh Ludwig (Shawnee Board Member) and have his full support in
the mater to press forward.
I am aware that we will have additional hurtles to cross as the project proceeds (V-dot, Flood Plains,
Site plans and Code requirements) and I am prepared to take on these hurtles as they come.We are a
small business and are excited to make our place in Winchester.

The property at 1930 Front Royal Pike is well positioned to utilize Frederick Water's water and sewer services once the
Board of Supervisors grants the SWSA(Sewer and Water Service Area) permissions. The water and sewer system has
available capacities to accommodate the request. The property owner spoke with the Frederick Water's engineering
department on January 3, 2022, and the property owner is well versed on his responsibilities to construct the
connections to our water and sewer system— neither Frederick Water nor Frederick County will incur costs as it's the
property owner's responsibility to undertake the necessary improvements to connect to FW's water and sewer
system. Please advise if additional information from Frederick Water is necessary for the Board of Supervisors
consideration of the property owner's request.
