043-22 (AbundantLifeChurchSWSAExpansion) w RESOLUTION Action: BOARD OF SUPERVISORS: January 26, 2022 Approved RESOLUTION AUTHORIZING THE FREDERICK WATER TO PROVIDE WATER AND SEWER SERVICE OUTSIDE OF THE SEWER AND WATER SERVICE AREA FOR ABUNDANT LIFE CHURCH (PINS: 44-A-202, 44-A-203, 44-A-20413 44-A-205) WHEREAS,Frederick County has received a request from Abundant Life Church to authorize Frederick Water to serve four parcels with public water and sewer. The properties are located along old Charlestown Road and identified by Property Identification Numbers 44-A-202, 44- A-203, 44-A-204 and 44-A-205, in Stonewall Magisterial District; and WHEREAS, this extension of water and sewer service would only serve Numbers 44-A-202, 44-A-203, 44-A-204 and 44-A-205 to facilitate the development of a new church facility; and NOW, THEREFORE, BE IT RESOLVED, that the Frederick County Board of Supervisors approves the extension of water and sewer service outside of the Sewer and Water Service Area for Abundant Life Church for Property Identification Numbers 44-A-202, 44-A-203, 44-A-204 and 44-A-205 and does hereby authorize Frederick water to serve these properties to serve a future church facility. The subject properties are located at 751-761 Old Charlestown Road and the parcel surrounding the existing dwelling; the site totals approximately six acres (PINS 44-A-202, 203, 204, 205). It is the policy of Frederick County that only properties within the Sewer and Water Service Area (SWSA) may connect to public water and sewer. The SWSA in this area runs along the south side of Old Charlestown Road, and while the site in question is adjacent to the SWSA, it is located on the northern side of Old Charlestown Road which is outside the limits of the boundary. Due to the property being outside the SWSA, a special exception from the Board of Supervisors is needed to allow for Frederick Water to serve the properties. The subject properties are zoned RA (Rural Areas) and the Comprehensive Plan depicts these properties remaining rural in nature. The Applicant proposes to construct a church on the site, which is a permitted use in the RA Zoning District. Should an exception not be granted for the site, it would be necessary to utilize a well and an onsite sewage disposal system (drainfield). Currently, water is available via an existing water main along Old Charlestown Road. The subject site is located across Old Charlestown Road from the future park adjacent to the Jordan Springs Elementary School. Sewer service would necessitate an extension from the Snowden Bridge development, through the future park site. Since this exception is not seeking to expand the boundary of the SWSA, this request could be decided by the Board of Supervisors without a public hearing or amendment to the Comprehensive Plan. The Frederick County Parks and Recreation parcel lies on the south side of Old Charlestown Road. I have attached a location map. On behalf of the Church, we request that the Frederick County Board of Supervisors consider granting an exception to the Sewer Water Service Area (SWSA) limits to allow Abundant Life Church to access Frederick Water sewer and water lines in the area. While onsite water and sewer facilities could be developed at the Church property, the geology in that area is very poor with regards to public well development and onsite sewage disposal. Frederick Water currently owns an existing 10"water main within the Old Charlestown Road right of way. A recent hydrant test near the proposed church location shows very good pressure and flow, with the capacity to serve the Church use. I have attached a memorandum from Frederick Water acknowledging their desire to serve the Church use. Additionally, gravity sewer service is available within the nearby Snowden Bridge subdivision. To access that sewer, the Church would need to negotiate with the Frederick County Parks and Recreation Board for an easement fo cross the FCPR parcel, along ifs perimeter boundary, and connect to existing gravity sewer in Splendor Garden Way. Abundant Life Church understands that the FCPR easement process is separate from this SWSA exception request. We have been informed by Jon Turkel that once the Master Plan for the Snowden Bridge Park is approved by the Board of Supervisors, they can consider a request for a sewer easement that the Church would convey to Frederick Water.See attached email. Dear Mr. Mislowsky: Per your request of October 8, 2021, Frederick Water has reviewed its system in regard to providing service. The subject parcels are currently not in the water and sanitary area served by Frederick Water. As such, Frederick Water is not permitted to serve these parcels at this time. Should an exception to the Sewer and Water Service Area be granted by the Frederick County Board of Supervisors, the following would apply: Based on the location of the parcels both water service and sanitary sewer service are available in the general vicinity. Sanitary sewer treatment capacity at the wastewater treatment plant is also presently available. Adequate water supply and pressure should be readily available for the proposed Church building. Both water and sanitary sewer facilities will require extensions to meet the specific needs of the proposed use. These extensions will be at the Owner's expense. Further review will be conducted at the time of site plan submittal. Frederick Water will provide specific guidance on the optimal connection point for sewer service in the near future for your use and planning.
