BOARD OF SUPERVISORS
RESOLUTION
FISCAL YEAR 2021-2022 BUDGET AMENDMENT
WHEREAS, the U.S. Congress passed and the President recently signed the American Rescue
Plan Act (ARPA) of 2021; and
WHEREAS, localities were allocated funding from the ARPA through multiple sources, but
primarily from the Coronavirus State and Local Fiscal Recovery Funds (CSLFRF) allocations which
the United States Treasury allocated to localities based on population; and
WHEREAS, CSLFRF funds may be used for qualifying expenses to cover costs to a) respond to
the public health emergency or its negative economic impacts; b) respond to workers
performing essential work during the COVID-19 public health emergency; c) provision of
government services to the extent of the reduction in revenue due to the COVID-19 public
health emergency; and d) make necessary investments in water, sewer, or broadband
infrastructure.
WHEREAS,the County will receive funds in two tranches, with 50% provided in May 2021 and
the balance delivered 12 months later; and
WHEREAS, funds must be used to cover costs incurred by the recipient between March 3, 2021,
and December 31, 2024, and funds must be expended by December 31, 2026.; and
WHEREAS, Pursuant to Title 15.2, Chapter 25, Section 15.2-2507 of the Code of Virginia, 1950 as
amended, the appropriate advertisements and public hearings have been conducted;
NOW,THEREFORE, BE IT RESOLVED, by the Board of Supervisors that the FY 2021-2022 Budget
be Amended to Reflect:
ARPA Fund Supplemental Appropriation in the Amount of$17,348,003. This amount
represents American Rescue Plan Act (ARPA) of 2021 Coronavirus State and Local Fiscal
Recovery Funds (CSLFRF) allocated by the United States Department of the Treasury to
provide emergency funding to support the immediate pandemic response and its
economic impacts.
BE IT FURTHER RESOLVED, estimates of revenues and appropriations are approved at the fund
level, and appropriations designated for this special revenue fund will not lapse at the end of
the fiscal year, but shall remain appropriated until the completion of the project or until the
Board of Supervisors, by appropriate resolution, changes or eliminates the appropriation.
BE IT FURTHER RESOLVED, ABPA Fund appropriation shall include funds transferred to other
funds for classification purposes.

Re: Amendment to the 2021-2022 Fiscal Year Budget to Reflect a ABPA Fund
Supplemental Appropriation
At its July 2021 Finance Committee meeting, the Committee recommended that
a public hearing be held to discuss an Amendment to the 2021-2022 Fiscal Year Budget
to Reflect a ARPA Fund Supplemental Appropriation in the Amount of $17,348,003. This
amount represents American Rescue Plan Act (ARPA) of 2021 Coronavirus State and
Local Fiscal Recovery Funds (CSLFRF) allocated by the United States Department of the
Treasury to provide emergency funding to support the immediate pandemic response
and its economic impacts.
The following page is an updated summary of information regarding the AICPA
funds and possible uses.
In August, the Board approved the public hearing for October 13, 2021. In order
to use the funds, a budget amendment is necessary. Following the public hearing, it is
recommended that the Board adopt the attached draft resolution.

• Note: $4.2 million of the radios are eligible using the `replace lost public safety revenue'
category(calculation established by US Treasury representing what could have been
expected to occur in the absence of the pandemic based on 3 prior fiscal years), Staff is
working on gathering justifications and seeking guidance on the eligibility under an
additional category for the use of more funds.

ELIGIBLE USE OF FUNDS
Recipients may use these funds to:
• Support public health expenditures, by,for example,funding COVID-14 mitigation
efforts, medical expenses, behavioral healthcare, and certain public health and safety
staff
• Address negative economic impacts caused by the public health emergency, including
economic harms to workers, households,small businesses, impacted industries,and the
public sector
• Replace lost public sector revenue, using this funding to provide government services
to the extent of the reduction in revenue experienced due to the pandemic.
—FREDERICK COUNTY=$4.2 million—Treasury's Interim Final Rule establishes a
methodology that each recipient uses to calculate a reduction in revenue representing
what could have been expected to occur in the absence of the pandemic. The calculation
is based upon the actual annual revenue growth over 3 full fiscal years prior to the public
health emergency.
• Provide premium pay for essential workers, offering additional support to those who
have and will bear the greatest health risks because of their service in critical
infrastructure sectors—up to$13 per hour(not to exceed $25k). Can retro back to
January 2020. Telecommuters not eligible—all other County staff eligible (employees of
the jurisdiction designated by executive as essential). —How would the County
determine who is essential?— Note: The General Assembly has approved a$3k bonus to
Sheriff&Jail comp board positions. Must be implemented by 11/30/21.
• Invest in water, sewer,and broadband infrastructure, making necessary investments to
improve access to clean drinking water,support vital wastewater and stormwater
infrastructure, and to expand access to broadband internet.
Within these overall categories, recipients have broad flexibility to decide how best to use this
funding to meet the needs of their communities.
GUIDING PRINCIPLES
• Temporary Nature of ARPA Funds. ARPA funds are non-recurring so their use should be
applied primarily to non-recurring expenditures.
o Avoid creating new programs.
o Consider on-going operating costs for infrastructure projects.
• ARPA partnering efforts.
o Be cognizant of state-level ARPA efforts, especially regarding infrastructure,
potential enhancements of state funding resources, and existing or new state
law requirements.

o Consider regional initiatives, including partnering with other ARPA recipients,
such as schools,transportation agencies and local economic development
authorities. Be sure to understand what they are planning and augment their
efforts; alternatively, creating cooperative spending plans to enhance the
structural financial condition of your community.
• Considerations
o Use other dedicated grants and programs first whenever possible and save
ARPA funds for priorities not eligible for other federal and state assistance
programs.
o Whenever possible, expenditures related to the ARPA funding should be spread
over the qualifying period (through December 31, 2024)to enhance budgetary
and financial stability.
a Adequate time should be taken to carefully consider all alternatives for the
prudent use of ARPA funding prior to committing the resources to ensure the
best use of the temporary funding.
• Notes
o Per GFOA: Rating agencies will evaluate a government's use of the ARPA funds
in formulating its credit opinion.
o Funds cannot be deposited into any pension fund.
o May not be used as non-Federal Match for other Federal Programs.
o Treasury guidance is still "interim". Collected public comment through July 15,
awaiting issuance of"final"guidance.
o Procurement rules rely on Federal Uniform Guidance—Davis Bacon does apply
to projects over$10 million.
o Interest earnings are not reportable and are not required to be used for COVID
related expenses.
o County responsible for subrecipient monitoring if funds are transferred to a
non-profit, an authority, or another government entity.
QUESTIONS/THOUGHTS/DECISIONS TO BE MADE
• Leverage all "pots"of funds—state and federal—wait forfederal infrastructure bill to
shakeout before making any commitments with County ARP funds. Also wait for State
to decide what they are doing with their ARP funds—maybe additional opportunities
for funding to come to the County.
• Avoid duplication of efforts by communicating/coordinating with towns,City, and
schools (if there are any).
• Broadband is an eligible use of ARP funds (in addition to State VATI grant). Frederick
County partnership with All Points is$8 million—depending on State VATI grant award.

• Determine if radio project is ARP eligible—Staff is working on gathering justifications
and seeking guidance on the eligibility of EMS radio system. Requests for determination
have been made to Governor's Office,Wexton, Kaine.
o $4.2 million lost revenue replacement calculation can be used for radios.
• Forma steering committee for decisions on funds? Who should be involved—staff,
Finance Committee, BOS, citizen member? What are the roles of members?
• Choose a couple large projects vs. multiple smaller use of funds? This would decrease
the burden on staff and eliminate the need to hire outside assistance.

• Need a budget amendment (which requires public hearing)to appropriate funds.

the amount of$50,000. This amount represents a carry forward of unspent FY21 funds for the
design and bid development for the relocation of the Voter Registrar's Office to Sunnyside
Plaza. See attached memo,p.4.
3. (S)The Deputy County Administrator requests a General Fund supplemental appropriation in
the amount of$2,460. This amount represents a carry forward of unspent FY21 funds for
equipment ordered in March, but not received until July. See attached memo, p.4.

appropriation in the amount of$1,260.90. This amount represents funds from the PLAY Fund

6. The WRA Director requests an Airport Operating Fund supplemental appropriation in the
amount of$59,000. This amount represents anticipated American Rescue Pian Act(ARPA)
funds awarded directly to the airport from the FAA. See attached memo, p.10-14. The
committee recommends approval.
7. (j)The Finance Director requests a General Fund supplemental appropriation in the amount
of$305,549.13. This amount represents a carry forward of unspent FY21 proffer funds for the
Clearbrook Volunteer Fire Company's building renovations that are currently in process.

a public hearing for the appropriation of funds in October.
