Chairman DeHaven called the meeting to order at 7:00 p.m.

Vice Chairman Wells led the Pledge of Allegiance.
ADOPTION OF AGENDA—APPROVED
Supervisor Slaughter moved for approval of the agenda as presented and Supervisor Dunn
seconded the motion.
Supervisor McCarthy moved to amend the motion to remove item 10 under Finance
Committee Business and refer it back to the Finance Committee for further review. The motion to

CITIZEN COMMENTS
Evan Wyatt of Greenway Engineering noted the consent agenda item titled `Resolution
Affirming Denial of CPPA 01-21 Russell & Smith Properties.' He said the applicant had not been
permitted to make a presentation to the Planning Commission or Board of Supervisors and he
asked the Board to reconsider denial of the application.
Tim Bonds, Stonewall District, referenced the regional broadband grant application item
on the agenda and said broadband expansion was greatly needed in his neighborhood.
Theo Theologis, Stonewall District, spoke in support of expanding broadband in his district.

Supervisor Slaughter moved for adoption of the consent agenda as presented. The motion
was seconded by Vice Chairman Wells.
Vice Chairman Wells moved to remove the item titled `Resolution Affirming Denial of CPPA
01-21 Russell & Smith Properties' from the consent agenda. The motion was seconded by
Supervisor Dunn and carried on a voice vote.

Upon motion of Supervisor Dunn, seconded by Supervisor McCarthy, Eric Lawrence and
Jay Tibbs were reappointed as a Frederick County Representatives to the Northern Shenandoah
Valley Regional Commission and Wyatt Pearson was reappointed as an Alternate Representative
each for a three-year term ending September 30, 2024. The motion carried on a voice vote.

REGIONAL BROADBAND INITIATIVE AND CONSIDERATION OF PHASE II -
APPROVED
Jimmy Carr of All Points Broadband presented updated information regarding the
regional broadband initiative and VATI grant application in conjunction with the Northern
Shenandoah Valley Regional Commission.
The Board and Mr. Carr discussed the All Points pricing schedule, the definition of
unserved locations, supply chain issues, and the proposed timeframe for construction and service
delivery.
Supervisor McCarthy moved for adoption of the resolution Approving Participation in
VATI Grant Application Related to the Regional Broadband MOU Submitted by NSVRC and All
Points Broadband. Supervisor Slaughter seconded the motion which carried on a recorded vote

Approving Participation in VATI Grant Application Related
to the Regional Broadband MOU Submitted by
NSVRC and All Points Broadband
WHEREAS, achieving universal broadband availability for Frederick County(the"County") is a priority
of the County's Board of Supervisors("Board"); and
WHEREAS,the County is a party to that certain non-binding Phase One Memorandum of Understanding
dated as of June 30,2021 (the"Regional Broadband MOU")entered into by and between Dominion
Energy Virginia,All Points Broadband Partners,LLC("All Points"), Shenandoah Valley Electric
Cooperative,Rappahannock Electric Cooperative,the County and certain other Participating Localities;
and
WHEREAS,the County desires to continue into Phase II of the Initiative as described in the Regional
Broadband MOU; and
WHEREAS,the County desires to seek grant funding to support broadband deployment within the
County through the 2022 Virginia Telecommunication Initiative("VATI")as part of the regional
initiative in collaboration with the Northern Shenandoah Valley Regional Commission("NSVRC").
THEREFORE,BE IT RESOLVED that the County elects to continue into Phase 11 of the Initiative
described in the Regional Broadband MOU; and
BE IT FURTHER RESOLVED that the County elects to participate in the VATI application related to
the Regional Broadband MOU to be submitted by NSVRC and All Points on behalf of the County and

other Participating Localities(the"Regional Application"); and
BE IT FURTHER RESOLVED that the County's local match commitment to be reflected in the Regional
Application shall be eight million, six hundred fifty thousand dollars($8,650,000),which local match
commitment shall be contingent on receipt of an award of VATI funds; and
BE IT FINALLY RESOLVED that the County Administrator is authorized to take such fllrther acts in
support of the Regional Application as may be appropriate and consistent with these resolutions.

SUPERVISOR GRABER REQUESTS DISCUSSION: FY22 FUNDING OF LORD
FAIRFAX COMMUNITY COLLEGE
Supervisor Graber said he had planned to request a reduction in funding given to Lord
Fairfax Community College, but that because of the very recent filing of a lawsuit in Shenandoah
County he will postpone his discussion and request until the judge has ruled on the pending lawsuit.

RESOLUTION AFFIRMING DENIAL OF CPPA 01-21 RUSSELL &SMITH
PROPERTIES—APPROVAL
Candice Perkins, Assistant Director of Planning and Development, reviewed the
application for CPPA 01-21, noting that at the recent work session, the Board indicated no interest
in forwarding the application for further study.
Supervisor McCarthy and Evan Wyatt, representing the Applicant discussed the use of
Transfer of Development Rights, and the merit of further study of the application. Supervisor Graber
and Mr. Wyatt discussed density in the urban development and residential zones.
Supervisor Dunn moved to forward the application for further study to allow the applicant
to make a presentation to the Board. Supervisor Stegmaier seconded the motions which failed on

RESOLUTION TO DENY COMPREHENSIVE PLAN AMENDMENT REQUEST#01-21 FOR
RUSSELL-SMITH PROPERTIES
WHEREAS,Frederick County received a request to amend the 2035 Comprehensive Plan to expand the
boundary of the Urban Development Area,the Sewer and Water Service Area,and change the land use
designation from urban center to residential for five parcels of land totals 89.49 acres. The properties are
located adjacent to Justes Drive,Rosa Lane,and Laurelwood Drive,and east of Front Royal Pike(Route
522 South);and
WHEREAS,this request was discussed by the Comprehensive Plans and Programs Committee at their
July 12,2021 meeting;and
WHEREAS,this request was discussed by the Board of Supervisors and the Planning Commission at
joint work-session on September 1,2021 and consensus was to not approve the request for further
consideration.
NOW,THEREFORE,BE IT RESOLVED by the Frederick County Board of Supervisors that CPPA#01-
21 for Russell-Smith Properties is denied for further study.

FINANCE COMMITTEE
Supervisor Slaughter moved for approval of the following: The Department of Social
Services requests a General Fund supplemental appropriation in the amount of $25,000. This
amount represents a carry forward of unspent FY21 funds for the purchase of a vehicle that was
ordered in April 2021, but due to supply chain delays will not be delivered until September 2021;
The Public Works Director requests a General Fund supplemental appropriation in the amount of
$9,717.22. This amount represents a carry forward of unspent FY21 funds from the Flemming
Trust for the spay/neuter program; The Public Works Director requests a General Fund
supplemental appropriation in the amount of $1,346.80. This amount represents court ordered
restitution received in FY21; The Public Works Director requests a General Fund supplemental

appropriation in the amount of $10,000. This amount represents funds from the Flemming Trust
that are reserved for the spay/neuter program; The Sheriff requests a General Fund supplemental

funds for vehicle equipment; The Sheriff requests a General Fund supplemental appropriation in
the amount of $74,121. This amount represents a carry forward of donations and insurance
reimbursement received in prior years for the construction of a building to hold emergency vehicles;
The Sheriff requests a General Fund supplemental appropriation in the amount of$12,080. This
amount represents a carry forward of unspent FY21 funds to purchase hazardous duty wet suits
for the dive team; and The Lake Holiday Country Club requests a Lake Holiday Fund supplemental
appropriation in the amount of $2,500,000. This amount represents prepayment of outstanding
VRA bonds. The prepayment request was approved by the Board of Supervisors on August 11,

Supervisor Slaughter noted the following had been referred back to the Finance Committee
by the motion earlier in the meeting when the agenda was adopted: The Sheriff requests a General
Fund supplemental appropriation in the amount of $38,186. This amount represents a carry
forward of unspent FY21 funds to be used for the purchase of MS Office software.
Supervisor Slaughter moved for approval of the following:The Sheriff requests a General
Fund supplemental appropriation in the amount of $50,001. This amount represents a carry
forward of unspent FY21 funds to be used for the purchase of vehicle routers. Supervisor
McCarthy seconded the motion. Supervisors Dunn, McCarthy, and Graber discussed whether the
request should be referred back to the committee for prioritization among other County needs.
Supervisor McCarthy said in speaking with the Sheriff, he learned that this is a safety need in light
of the state of the current public radio system as the routers allow for communication and GPS
location of the officers. The motion carried on a recorded vote as follows:

of the budget process and be prioritized among all requests for funds. Supervisor Stegmaier said
the Memorandum of Understanding with the Library states that County will support the Library
financially based on usage by County residents. He said the request for funds reflects the County's
usage rate and that funds are needed to support Library staffing. The motion carried on a recorded

PLANNING COMMISSION BUSINESS - PUBLIC HEARINGS
CONDITIONAL USE PERMIT #06-21 FOR KELROCK, LLC -APPROVED
Mark Cheran, Zoning & Subdivision Administrator, reviewed the request for a conditional
Use Permit (CUP) to establish a Sawmill/Planing Mill (Type B) at 161 Woodchuck Lane,
Winchester, in the Back Creek Magisterial District. The subject property is zoned RA(Rural Areas)
Zoning District. Should the Board of Supervisors find this use to be appropriate, the Planning
Commission recommended the following conditions:
1. All review agency comments and requirements shall be complied with at all times.
2. An illustrative sketch plan shall be submitted to and approved by Frederick County and
all improvements completed prior to the establishment of the use.
3. All milling operations shall occur within the existing enclosed structure on the property,
and all outdoor storage shall be screened.
4. All deliveries via tractor trailer shall occur solely from Round Hill Road through PIN 52-
A-267; no tractor trailer deliveries shall occur via Woodchuck Lane.

5. One non-illuminated freestanding monument business sign shall be allowed with this
Conditional Use Permit. Signage shall not exceed twenty (20) square feet in area and ten
(10) feet in height.
6. Hours of operation shall be limited to 7 a.m.to 6 p.m.,six(6)days a week and no Sunday
operation.
7. No more than six (6) employees shall be permitted with this use.
8. Conditional Use Permit #19-04 shall be void upon approval of this Conditional Use
Permit.
9. Any expansion or change of use shall require a new Conditional Use Permit.
Mr. Charen noted the Frederick County Planning Commission did unanimously
recommend approval of CUP#06-21 for Kelrock, LLC submitted to allow for a Sawmill/Planing Mill
(type B).
Supervisor Graber and the Applicant's Representative, Rocky Keplinger, discussed
potential noise concerns. In response to Supervisor McCarthy's inquiry, Mr. Keplinger said he has
discussed his intentions with his neighbors, and they are supportive.

Supervisor Graber moved to approve Conditional Use Permit#06-21 For Kelrock, LLC with
an additional condition of a maximum 50-decibel noise level at the property line. Supervisor
Slaughter seconded the motion.
Supervisor McCarthy moved to amend the motion by removing the added condition of a
50-decibel noise level at the property line. Supervisor Dunn seconded the motion. The Board
members discussed the noise level requirement and the difficulty of changing a conditional use
permit after the fact. The motion to amend by removing the added condition carried on a recorded

1. The Department of Social Services requests a General Fund supplemental appropriation in the
amount of$89,322. This amount represents additional State and Federal funds for IV-E
Prevention Services Program. No local funds required. See attached memo, p.4. The
committee recommends approval.
2. (Q)The Department of Social Services requests a General Fund supplemental appropriation in
the amount of$25,000. This amount represents a carry forward of unspent FY21 funds for the
purchase of a vehicle that was ordered in April 2021, but due to supply chain delays will not be
delivered until September 2021. See attached memo, p.5.
3. (Q)The Public Works Director requests a General Fund supplemental appropriation in the
amount of$9,717.22. This amount represents a carry forward of unspent FY21 funds from the

12. The IT Director requests a General Fund supplemental appropriation in the amount of$12,841.
This amount represents salary and fringe funds needed for the remainder of FY22 for the
reclassification of an Administrative Assistant to a Technology Administrative Coordinator. The
position was added to the SAP in July 2021. Local funds are required. See attached memo,
p. 16—20. The committee recommends approval.
13. The Handley Regional Library requests a General Fund supplemental appropriation in the
amount of$32,265. This amount represents increased funding to provide a cost-of-living
adjustment to library staff. Local funds are required. See attached information, p.21. The
committee recommends approval.
14. (Q)The Lake Holiday Country Club requests a Lake Holiday Fund supplemental appropriation in
the amount of$2,500,000. This amount represents prepayment of outstanding VRA bonds.
The prepayment request was approved by the Board of Supervisors on August 11,2021. See

PUBLIC SAFETY COMMITTEE REPORT to the BOARD OF SUPERVISORS
Thursday August 26, 2021

ATTENDEES:
Committee Members Present: Walt Cunningham, Judy McCann-Slaughter,
Helen Lake,Dave Stegmaier, and Chairman Bob Wells. Denny Linaburg was absent.
Staff present: Deputy County Administrator Jay Tibbs, Fire & Rescue Chief
Steve Majchrzak, Director of Public Safety Communications Tamara Perez, County
Attorney Rod Williams, Deputy Director of Emergency Management Chester Lauck,
Sheriff Lenny Millholland, Interim County Administrator Mary Beth Price, and
Lieutenant Tonya Kittoe.
ITEMS FOR INFORMATION ONLY:
1. Request for funding of additional personnel within the Communications
Department (see attached):
The Committee considered a request from Director Perez for an additional 3
Communications Officer positions and 1 Shift Supervisor for the department. With
current staffing levels, the increased call volume,mental health of the employee(s),
increased overtime, lack of personal time off and a work/life balance, dispatchers
are burning out and stepping away from the job. With new training programs in
place for entry level employees, additional training for tenured dispatchers and
continuous job postings, Director Perez hopes to hire and retain qualified
candidates, so the center is not at constant critical staffing levels.
Mr. Cunningham made a motion to approve the addition of 4 new Communications
Department positions and forwarded this request to the Finance Committee for
funding. Mrs. McCann-Slaughter seconded the motion and the Committee
unanimously approved.
2. Sheriff's Department information (see attached):
Sheriff Millholland advised the Public Safety Committee the State Comp Board
awarded his office 4 positions in the civil division (e.g., court services personnel)
out of the 14 officer positions the department is due. He advised the division's
workload dictates the number of positions the Compensation Board will fund a
jurisdiction.

The Sheriff also discussed the possibility of obtaining 2 motorcycle units for the
traffic division. They would cost approximately $22,000 each and the training
could be done for free.
The Sheriff expressed his frustration with the lack of available mental health
facilities/beds in the Commonwealth and the impact the lack of facilities is having
on his department's staff and budget resources.
Lt. Kittoe discussed the staffing shortages currently facing the Sheriff's Office,
citing all the shifts are down at least 5 personnel each. The stringent time frame to
certify an officer is only one year from the initial hiring process, which includes 19
weeks of training at the academy-which only offers classes twice a year-, and 3
months of field training on all shifts. She noted the Sheriff's office struggles with
attracting and retaining qualified candidates.
3. Other business:
Mrs. McCann-Slaughter discussed alarm and noise complaints she had received
from constituents. She noted the complains were from both residential and
commercial properties. County Attorney Williams stated the current noise
ordinance is limited to certain residential zoning districts from 9pm-6am. He noted
there were currently no consequence for re-occurring alarms. Mrs. McCann-
Slaughter suggested forming a committee to consider a possible ordinance with
deterrents such as fines for repeated alarm calls.
Chief Majchrzak echoed the statements made by Lt. Kittoe and Director Perez
regarding the staffing shortages and frustration when hiring candidates. He added
that the 13 current fire recruits are finishing initial training and are set to begin the
EMS phase of their training. He noted graduation would be in November. He
concluded by saying a new recruit class is set to start in January 2022.
