CALL TO ORDER Chairman DeHaven called the meeting to order at 5:30 p.m. Planning Commission Chairman Kevin Kenney called the meeting to order at 5:30 p.m. Minute Book 47 Board of Supervisors-PlanningCommission Joint Work Session of September 1, 2021 County of Frederick, Virginia 73 DISCUSSION ITEMS 1. Presentation by Shentel on Broadband Expansion Offerings Interim County Administrator Mary Beth Price introduced Chris Kyle of Shentel who made a presentation on Shentel's broadband expansion offerings in relation to the upcoming Virginia Telecommunication Initiative (VATI) grant submission deadline. 2. Comprehensive Plan Amendment (CPPA)#01-21 for the Russell-Smith Properties Christopher Mohn recused himself from the discussion. Assistant Planning Director Candice Perkins reviewed the request to expand the boundary of the UDA,the SWSA, and change the land use designation for five parcels of land that total 89.49 acres. She said the properties are located adjacent to Justes Drive, Rosa Lane, and Laurelwood Drive, and east of Front Royal Pike (Route 522 South), are currently zoned RA (Rural Areas) District and are utilized for agricultural and residential purposes. She continued saying the Senseny/Eastern Frederick Land Use Plan shows these properties as part of the future Papermill Urban Center, and the Applicant is seeking to change the land use designation from urban center to residential at a density of up to six units per acre. Ms. Perkins said the Comprehensive Plans and Programs Committee (CPPC) discussed this request at their July 12, 2021, meeting and cited concerns about the impacts on schools, transportation, infrastructure needs, and traffic. The CPPC, noting their concerns, sent the amendment forward for further discussion at the joint work session. The Board and Planning Commission discussed the application and the concerns expressed by the Committee. By consensus, it was agreed there was no interest in moving the application forward. 3. Proposed Work Plan for the Department of Planning & Development Planning Director Wyatt Pearson reviewed the Department's work plan including the following: Transportation Projects; Transfer of Development Rights; and Small Area and Joint Land Use Plans of the Comprehensive Plan. Supervisor Slaughter suggested a review of the size of the Planning Commission as part of the work plan. Minute Book 47 Board of Supervisors-PlanningCommission Joint Work Session of September 1, 2021 County of Frederick, Virginia 74 By consensus, the Board agreed with the Director Pearson's proposal and the addition of an evaluation of the size of the Planning Commission to best serve the needs of Frederick County. Board of Supervisors Enters Closed Session At 6:40 p.m., Vice Chairman Wells moved that the Board of Supervisors of Frederick County enter a closed session pursuant to Virginia Code Section § 2.2-3711(A)(5) for discussion concerning a prospective business or industry where no previous announcement has been made of the business'or industry's interest in locating in the community. Supervisor McCarthy seconded the motion which carried on a voice vote. The Board reassembled in the first-floor conference room in closed session. Planning Commission Adjournment to Regular Meeting On motion of Commissioner Manuel, seconded by Commissioner Morrison, the Planning Commission work session was adjourned on a voice vote. Board of Supervisors Reconvene in Open Session At 7:04 p.m., the Board members being assembled within the first-floor conference room in the presence of members of the public and the media desiring to attend, the meeting was reconvened on motion of Vice Chairman Wells, seconded by Supervisor McCarthy, and carrying on a voice vote. Vice Chairman Wells moved that the Board of Supervisors of Frederick County certify that, to the best of each member's knowledge, (i) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting to which this certification applies, and (ii) only such public business matters as were identified in the motion convening the closed meeting were heard, discussed, or considered by the Board.
