June 23 2021 Special Meeting Minutes 407 MINUTES SPECIAL. MEETING FREDERICK COUNTY BOARD OF SUPERVISORS WEDNESDAY, JUNE 23,2021 6:00 P.M.AND 7:00 P.M. BOARD ROOM, COUNTY ADMINISTRATION BUILDING 107 NORTH KENT STREET, WINCHESTER, VIRGINIA ATTENDEES Board of Supervisors: Charles S, DeHaven, Jr., Chairman; Robert W. Wells, Vice Chairman; Blaine P. Dunn; Shawn L. Graber; Judith McCann-Slaughter;Jo Douglas McCarthy; and David D. Stegmaier were present. Staff present: Kris C. Tierney, County Administrator; Jay E. Tibbs, Deputy County Administrator; Roderick B. Williams, County Attorney; Karen Vacchio, Public Information Officer; Steve Majchrzak, Fire Chief; Lenny Millholland, Sheriff; Missi Neal, Purchasing Manager; Scott Varner, Director of Information Technologies; and Ann W, Phillips, Deputy Clerk to the Board of Supervisors, CALL TO ORDER Chairman DeHaven called the meeting to order at 6:00 p.m, INVOCATION Vice Chairman Wells delivered the invocation. PLEDGE OF ALLEGIANCE Vice Chairman Wells led the Pledge of Allegiance. ADOPTION OF AGENDA—APPROVED Upon motion of Supervisor Slaughter,seconded by Supervisor McCarthy, the agenda was adopted on a voice vote, CLOSED SESSION Vice Chairman Wells moved that the Board of Supervisors of Frederick County enter a Minute Book 46 Board of Supervisors Special Meeting of June 13,1011 County of Frederick, Virginia 408 closed session pursuant to Virginia Code Section 2.2-3711(A)(7)and (8),for consultation with legal counsel and briefings by staff pertaining to a litigation matter, QHarris Technologies,_Inc. v. County of Frederick, et N. , currently pending in the Frederick County Circuit Court, where such consultation or briefing in open meeting would adversely affect the negotiating or litigating posture of the public body, and for consultation with legal counsel employed or retained by the public body regarding a specific legal matter, relating to the procurement of a public safety radio system, and requiring the provision of legal advice by such counsel,. Supervisor McCarthy seconded the motion which carried on a voice vote, At 6:37 p.m.,the Board members being assembled within the designated meeting place in the presence of members of the public and the media desiring to attend, the meeting was reconvened on motion of Vice Chairman Wells, seconded by Supervisor McCarthy and carrying on a voice vote. Vice Chairman Wells moved that the Board of Supervisors of Frederick County certify that, to the best of each member's knowledge, (i) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting to which this certification applies, and (ii) only such public business matters as were identified in the motion convening the closed meeting were heard, discussed, or considered by the Board. RECONVENE Chairman DeHaven reconvened the meeting at 7:00 p.m. SELECTION OF A CONSULTANT FIRM TO MANAGE THE PUBLIC RADIO SYSTEM IMPLEMENTATION— POSTPONED TO JULY 14 2021 Deputy County Administrator Tibbs provided background information saying the negotiating Minute Book 46 Board of Supervisors Special Meeting of fune 23, 2021 County of Frederick, Virginia 409 committee and Board member liaisons recommended Tusa Consulting as the desired consultant for the implementation and project management firm for the Public Safety Radio Project, He said staff was seeking Board action to authorize the County Administrator to execute a contract with Tusa Consulting for project management support for a not to exceed amount of$416,130, pending final legal review, Supervisor Dunn, Mr, Tibbs, and Dean Hart of Tusa Consulting discussed the pricing specifications of the Tusa proposal. Supervisor Graber moved to postpone the selection of a consultant until the July 14, 2021, meeting of the Board of Supervisors, Supervisor Dunn seconded the motion. Supervisors McCarthy, Dunn, and Graber discussed their preference for delaying the selection in light of current litigation. Chairman DeHaven noted that a consultant will be needed regardless of how litigation proceeds. The motion to postpone selection of the consultant carried on a recorded vote as follows; Blaine P.
