The Board will enter a closed session pursuant to Virginia Code Section 2.2-3711(A)(7)
and (8), for consultation with legal counsel and briefings by staff pertaining to a litigation
matter, L3Harris Technologies, Inc. v. County of Frederick, et al. , currently pending in
the Frederick County Circuit Court, where such consultation or briefing in open meeting
would adversely affect the negotiating or litigating posture of the public body, and for
consultation with legal counsel employed or retained by the public body regarding a
specific legal matter, relating to the procurement of a public safety radio system, and
requiring the provision of legal advice by such counsel.

SUBJECT: Public Safety Radio Implementation& Project Management
On May 12, 2021, the Board authorized the issuance of a Notice of Intent to Award a contract to
EF Johnson for the new public safety radio system. A second component to that action was the
approval of a contract for project management services. After some discussion, the Board
directed staff to seek other consulting firms to serve as the Implementation and Project
Management consultant for the public safety radio project. Given the urgent nature of this
project, staff, per the Board's direction, began searching for cooperative contracts the County
could ride in an effort to procure professional services for implementation and project
management for the P25 Public Safety Radio System project.
Three consulting firms, CTA Consulting, Federal Engineering, and Tusa Consulting were invited
to participate in interviews. In preparation for the interview, each consulting firm was provided
copies of the original Request for Proposals, estimated timeline, the County's statement of needs
and consultant's scope of work, and the most up-to-date negotiated documents between EF
Johnson and the County for review and preparation for their respective Qualifications and
Capabilities interviews. Interviews were held on June 7 and 10, 2021.
Following the interview process and after completing reference inquiries, the negotiating
committee and Board member liaisons recommend Tusa Consulting as the desired consultant for
the implementation and project management firm for the Public Safety Radio Project.
Staff is seeking Board action to authorize the County Administrator to execute a contract with
Tusa Consulting for project management support for a not to exceed amount of $416,130,
pending final legal review.
