Draft Update of the 2021-2022 Frederick County Primary and Interstate
Road Improvement Plans
-The Primary and Interstate Road Improvement
Plans Establish Priorities for Improvements to the Primary and Interstate Road
Networks within Frederick County. Comments from the Transportation
Committee will be Forwarded to the Planning Commission and Board of
Supervisors. Ultimately, the Priorities Adopted by the Board of Supervisors will
be Forwarded to the Commonwealth Transportation Board for consideration.
The Virginia Department of Transportation and the Board of Supervisors
for the County of Frederick, Virginia, in Accordance with Section 33.2-
331
of the Code of Virginia, will Conduct a Joint Public Hearing. The
Purpose of this Public Hearing is to Receive Public Comment on the
Proposed Six Year Plan for Secondary Roads for Fiscal Years 2022
Through 2027 in Frederick County and on the Secondary System
Construction Budget for Fiscal Year 2022.
Copies of the Proposed Plan
and Budget May be Reviewed at the Edinburg Office of the Virginia
Department of Transportation, Located at 14031 OldValley Pike, Edinburg,
Virginia or at the Frederick County Offices Located at 107 North Kent Street,
Winchester, Virginia. All Projects in the Secondary Road Improvement Plan

Chairman DeHaven called the meeting to order at 5:30p.m.
CLOSED SESSION
Vice Chairman Wells moved that the Board of Supervisors of Frederick County enter a
closed sessionpursuant to Virginia Code Sec. 2.2 -3711(A)(1) for discussion or consideration
of prospective candidates for and terms and conditions of employment as Interim County
Administrator and as County Administrator, and pursuant to Virginia Code Sec. 2.2-
3711(A)(29) for discussion of the award of a public contract involving the expenditure of public
funds, specifically regarding the award of a contract for consulting services related to the
retention of a County Administrator, where discussion in an open session would adversely
affect the bargaining position or negotiating strategy of the public body. Supervisor McCarthy
seconded the motion which carried on a voice vote.

from open meeting requirements by Virginia law were discussed in the closed meeting to which
this certification applies, and (ii) only such public business matters as were identified in the motion
convening the closed meeting were heard, discussed, or considered by the Board. Supervisor

WHEREAS, the Frederick County Board of Supervisors recognizes that the County's employees are a
most important resource; and on September 9, 1992, the Board of Supervisors approved a resolution
which established the Employee of the Month award and candidates for the award may be nominated by
any County employee; and
WHEREAS, the Board of Supervisors upon recommendation by the Human Resources Committee selects
one employee from those nominated; and
WHEREAS, Jennifer Fost has been the 4-H Secretary and Receptionist for the Frederick County
Extension Office for 25 years and is an exceptional employee who is very committed to the Extension
community and to the people of Frederick County; and
WHEREAS, Jennifer is known for providing excellent support and service to Extension staff, 4-H
volunteers, 4-H youth members, and the general public as well as for her cheerful personality, efficient
and resourceful customer service, considerate nature, attention to detail, and loyalty; and
WHEREAS, during the last five months Jennifer has mastered and successfully implemented the new 4-H
Online registration/enrollment system, working closely with the state 4-H office to implement the new
program provided by Virginia Tech, and, with very little instruction, used her excellent problem solving
skills to make the system as user friendly as possible, and this was all accomplished while working with
our community providing assistance by helping citizens enroll themselves, their family, or their club,
and make project selections; and
WHEREAS, by demonstrating dedication to her job, Frederick 4-H, Virginia Cooperative Extension, and
the residents of Frederick County as she ensured the VCE-Frederick office was consistently available by
phone, appointment, or drop-off throughout the entire COVID pandemic Jennifer exemplifies what it
means to be a stellar employee; and
NOW, THEREFORE BE IT RESOLVED by the Frederick County Board of Supervisors this 28th day of
April 2021, that Jennifer Fost is hereby recognized as the Frederick County Employee of the Month for
April 2021; and
BE IT FURTHER RESOLVED that the Board of Supervisors extends gratitude to Jennifer for her
outstanding performance and dedicated service and wishes her continued success in future endeavors; and

The Board discussed the efforts to change the name of Lord Fairfax Community College,
thecosts associated with a name change, and the possibilityof the County withholding fundsfrom

revisions to the approved Generalized Development Plan (GDP) and text associated with Rezoning
#02-03 which rezoned parcel 53-A-68 to the B2 (General Business) and MS (Medical Support)
Districts with proffers. She said the site consists of 37.5424+/-acres zoned B2 (General Business)
District and 51.8675+/-acres zoned MS (Medical Support) District and the approved GDP labeled
individual land bays with specific uses. She said the Applicant proposes to remove the uses shown
on the proffered GDP to allow for potential alternative development and is also proposing to remove
proffer 3 from the landscape design features which required a landscaped roundabout.
Ty Lawson, representing the Applicant, confirmed the earlier remarks from Eds Coleman
regarding an agreement having been reached between the Applicant and the neighboringproperty
owners.

Supervisor Dunn noted the budget work session scheduled for May 12 saying he would like
the matter of funding insurance premiums for volunteer fire companies to be discussed.
Supervisor Dunn noted the Juneteenth holiday saying that it commemorates a Texas
holiday rather than the actual datewhen slaves in Virginia were freed.

ITEMS FOR BOARD ACTION:
5-Other: The Unified Planning Work Program (UPWP) draft was given out to the Committee.
The draft contains the request for the Phase II of the Route 522 and Valley Mill Road
realignment. Also, Commonwealth Transportation Board (CTB) will be meeting in April. Staff
attended that virtual meeting. The committee instructed staff to create a resolution for Board
consideration and that resolution is attached.
ITEMS FOR INFORMATION ONLY:
1-Route 522 Realignment Area Study Update: Staff updated the Committee on the Phase I final
draft of the Route 522 realignment report that included, alternatives, preferred alternatives,
and next steps with the current Phase I. The Winchester Airport (WRA) and FAA have been
involved throughout the process. Alternative 1 would completely avoid the Winchester Airport
property but have very short distancing from the interchange. Alternative 2 gives adequate
spacing on Route 50 to aid congestion reduction with a shorter project length and is largely in
keeping with the 2035 Comprehensive Plan alignment. Also, this Alternative would only slightly
encroach on Winchester Regional Airport property. Alternative designates Coverstone Drive as
the route for the realignment but likely creates cut through trips on other connecting facilities
such as Prince Frederick Drive for drivers seeking interchange access. Alternative 2 is the
preferred by Staff and project team. The next step is Phase II that will be with the MPO,
Consultant Staff, Airport Impact Report for review/approval by the WRA and FAA,
planning/recommendations for access management from Prince Frederick Drive to Exit 313.
Phase II is to be completed in the next fiscal year.
2- Interstate, Primary, and Secondary Road Plan Update: Staff gave a brief overview of the
draft of Interstate, Primary and Secondary Road Plan. The Interstate and Primary Plans were
updated last September while the Secondary Plan was not able to be updated due to COVID
impacts on transportation revenue to be updated. The current draft has the County back on
the normal schedule. The Interstate and Primary Plans are unchanged from last year while the
Secondary plan has been updated to reflect projects that have been completed and, in some

instances, have the advertisement dates of the projects that have been adjusted for the later
years of the hard surface program. The Committee discussed to modify the Primary
Improvement Plan rankings of the priority of 1A (exit 310 to Route 522), 1B (Route 11 to Route
7, 1C (Route 7 to Route 50) and 1D (Route 50 to Route 522) with the Route 37 Bypass phases
and adding a Route 7 slip ramp as a priority. Staff recently received a request from the
residents on Germany Road to be considered for the Non-Hardsurfaced road improvement
projects. After discussion, the Committee recommended waiting to add it to the list once
more information is available. This item will be on the Board’s agenda for a public hearing.
Upon a motion by, Mr. Charles S. DeHaven, Jr. seconded by Mr. Gary Oates the Committee
recommended to forward as modified the Interstate, Primary and Secondary Improvement
Road Plans to the Board for recommendation of approval.
3-Comprehensive Plan Update: The item was bypassed for the May meeting.
4-County Project Updates: Crossover Boulevard aka Tevis Street Extension/Airport Road/I-81
Bridge: The Bridge over I-81 is largely complete at this point, while work continues to the
roundabout. There is significant work taking place at the intersection of Crossover Blvd. and
Route 522. The loop detectors have been installed for the signal upgrades and paving is
expected to take place at the intersection within the next few weeks. Once the paving is
completed, markings will be updated. The project is on schedule.
Renaissance Drive: The final design plans have been submitted to VDOT. CSX plans are in
process of being submitted this week.

had their economic development scores depressed by the scale of the top scoring application for economic
development in the state, leading to an inaccurate reflection of the value of these projects in that scoring category;

RECOMMENDATION
After several months of gathering additional information, examining issues raised by
members of the Board, reviewing an updated proposal, and negotiating with the two selected
vendors, staff is recommending EF Johnson as the selected vendor and proposal.
Staff is seeking the following actions from the Board of Supervisors:
1.Authorization as follows:
to issue a Notice of Intent to award a contract to EF Johnson for a
new public safety radio system
for the County Administrator to execute a contract with EF
Johnson for a not to exceed amount of $20,007,471, pending final
legal review
for a project contingency budget with a not to exceed amount of
$1,500,000.
2.Authorization for the County Administrator to execute a contract with
Mission Critical Partners, LLC, for project management support for a not
to exceed amount of $530,000, pending legal review.

FUNDING OPTIONS
With regard to funding this purchase, there are options available to the Board. There is
currently $17 million in the County’s Capital Fund. A portion or all of this fund could be
put towards the purchase of this project. It is anticipated that the fund will increase
following year end. Given the timeline for this project is approximately 30 months, it is
conceivable that the Board could pay cash for the initial system.
However, if the Board wishes to retain some of the Capital Fund to address additional
needs, there are financing options available through the Virginia Resources Authority. Staff
contacted representatives from VRA to gather information on their most recent bond
financing:

15-Year Term – 1.70%
20-Year Term – 2.15%
Should the Board choose to finance a portion of this project, staff would recommend, at a
minimum, using $5.1 million of the capital fund to purchase the subscriber units, which have
a useful life of 7-9 years. The remainder of the project, $14.9 million, could be financed
through the Virginia Resources Authority.
A decision regarding funding does not need to be decided at this meeting, but staff would
look for direction from the Board at its May 26, 2021 meeting.
BACKGROUND
On November 13, 2019, the Board authorized the development of a request for proposals
(RFP) for a new public safety radio system. The Communications Committee and Mission
Critical Partners (MCP) began development of an RFP document in early 2020. The RFP
specified that the new radio and paging system must provide coverage at 95 percent within
the boundary of Frederick County with 95 percent reliability.
RFP responses were received on June 16, 2020. The County received proposals from the
following vendors: Motorola, L3Harris, EF Johnson, and Bay Electronics. The responses
were distributed to the evaluation committee, which was the Communications Committee.
The committee consisted of 10 members comprised of three representatives from the
Sheriff’s Department, three from Fire & Rescue, two from Public Safety Communications,
and two volunteer company representatives.
A review workshop was held on August 11, 2020 with the evaluation committee and MCP.
During that workshop, the committee considered such items as: system architecture, site and
microwave plans, radio frequency coverage, pricing, coverage deficiency concerns, and 15-
year cost of ownership. At the conclusion of that workshop, based upon each proposal’s
score, two vendors were selected to move forward for oral presentations. The selected

vendors were Motorola and EF Johnson.
Oral presentations were held on August 19 & 20, 2020. Three proposals were considered:
EF Johnson, Motorola Primary, and Motorola Alternate. Per the Code of Virginia, under an
RFP process, a locality must select and negotiate with two qualified vendors. The two
highest scoring vendors were Motorola and EF Johnson.
Following the oral presentations, a negotiation team was established for the County. The
team was made up of a representative from each of the following: Sheriff’s Department,
Fire & Rescue, Public Safety Communications, County Administration, and Finance
(Purchasing) and representatives from MCP. Three negotiation sessions were held. The
goal of the negotiations was to determine the best overall solution for the County. During
negotiations, the team considered the following: system design, risk, initial and long-term
costs plus other factors.
Following the negotiation process and after several clarification inquiries, staff
recommended EF Johnson as the desired vendor and proposal.
This recommendation was presented to the Board of Supervisors at its November 5, 2020
work session. A second work session was held on November 23, 2020 at which time, board
members inquired about an extended warranty and maintenance beyond 15 years, as well as
a second software upgrade for the system. EF Johnson has provided the requested
information.
At the conclusion of the November 23, 2020 work session, the majority consensus of the
Board was to move this matter forward for action at the Board’s December 9, 2020 meeting.
At the December 9, 2020 meeting, the Board unanimously voted to direct staff to examine
the issues discussed in the closed session held earlier that evening and to continue
negotiations with the selected vendors: EF Johnson and Motorola.
Staff followed the Board’s direction and examined the issues raised and continued
negotiations with the two vendors.
On January 20, 2021, the evaluation committee met and discussed the issues and questions
raised at the December 9, 2020 closed meeting. The evaluation committee tasked the
negotiation team with seeking answers to the questions received from the Board, as well as
provided some additional questions for the negotiation team to answer.
Following the January meeting, members of the negotiation team began working with the
vendors to obtain answers to the questions raised and continued discussions with each
regarding pricing, discounts, incentives, etc.
The negotiation team received updated information from Motorola in the form of an
amended proposal dated February 23, 2021. Following receipt and review of this proposal,
members of the negotiation team and representatives from Mission Critical Partners

conducted a number of conference calls to include calls with Motorola to clarify pricing, risk,
etc. per their new proposal. The committee met with Motorola on March 1, 2021 to review
their amended proposal. During discussions, Motorola clarified that 95% reliability and
12dB/20dB coverage can, in fact, be met with less than 12 towers, thus reducing their tower
count from 12, per their previous proposal, to 11 in their most recent revision. A system
redesign was submitted for review by Motorola, including new tower locations.
The negotiation team met with representatives from EF Johnson on April 22, 2021 to go
over their offering and to clarify pricing, etc.
A second meeting was held with Motorola on April 26, 2021 to clarify their pricing.
Following the April 26, 2021 meeting, the negotiation team reviewed the pricing as verified
by both vendors and prepared the following comparison chart:

Using the scoring formulas utilized in both the evaluation and interviews, staff updated the
vendors’ scores based upon the price clarification. At the conclusion of that exercise, EF
Johnson received the highest scores for Initial Capital Costs, 15-Year Costs, and 20-Year
Costs.

Agricultural District Advisory Committee, Planning Commission, and the Board of
Supervisors to assist them in making a decision on this application. It may also be useful to
other interested in this matter.

PROPOSAL:This is a request from Walter Nelson and Barbara Snapp Nelson to add a portion
of one parcel,totaling 27.26+/- acres, to the South Frederick Agricultural and ForestalDistrict.
This property is identified by Property Identification Number (PIN): 61-A-46A. This parcel
currently totals 72+/- acres due to a lot consolidation, 27.26+/-acres of this consolidated parcel
is not in theDistrict.
LOCATION AND SIZE: This District is generally located along Cedar Creek Grade (Route
622), Middle Road (Route 628), Marlboro Road (Route 631) and Hites Road (Route 625) in the
Back Creek Magisterial District. The parcel requested to be added is located north west of Cedar
Creek Grade, on West Oaks Lane. This request for the addition of 27.26+/- acres would increase
the South Frederick Agricultural and Forestal District from 6,894.42+/- acres to 6,921.68+/-
acres.
EXECUTIVE SUMMARY & STAFF CONCLUSION FOR THE 05/12/21 BOARD OF
SUPERVISORS MEETING:
The South Frederick Agricultural and Forestal District was established in 1980. The most recent
renewal of this district occurred on September 9, 2020 for a period of five years. Currently the
district contains 6,894.42+/- acres; this request for the addition of 27.26+/- acres would increase
the South Frederick Agricultural and ForestalDistrict to 6,921.68+/- acres.
Section 15.2-4310 of the Code of Virginia, 1950, as amended, provides property owners with the
ability to request additions to an existing Agricultural and Forestal District through the process
designated by the local governing body. This request meets the intent of the Code of Virginia
and has been evaluated in conjunction with the 2035 Comprehensive Plan. This addition
provides an opportunity for the agribusiness community to conduct long range planning efforts
for the management of their operations, while providing a reserve of agricultural land through
the year 2025. The Agricultural District Advisory Committee (ADAC) unanimously
recommended approval of the 27.26+/-acre addition at their meeting on March 31, 2021.
The Planning Commission unanimously recommended approval of the 27.26+/-acre
addition at their meeting on April 21, 2021.
Following a public hearing, Board of Supervisors action on this application would be appropriate.

REVIEW EVALUATIONS:
AGRICULTURAL & FORESTAL SIGNIFICANCE: The agricultural operations in the
District are 90 percent orchardand cropharvesting, and 10 percent open space/woodlands. The
land within the District is predominantly rural in nature.
LAND USE: All parcels within the District contain agriculturalor residential land uses.
COMPREHENSIVE PLAN: The 2035Comprehensive Plan of Frederick Countyprovides
guidance when considering land use actions. The District is outside the Urban Development
Area (UDA) and Sewer and Water Service Area (SWSA) and is not part of any land use plan or
study by the County. The current land use should remain in its present land use with orchards,
agricultural, and residential.
The intent of the Rural Areas is to maintain agriculture as a significant portion of the County’s
economy and to maintain the rural character of areas outside of the Urban Development Area.
The Comprehensive Plan can accomplish this by promoting the inclusion of additional land in
Agricultural and Forestal Districts. The Comprehensive Plan Supports the renewal of the District
for it provides an opportunity for the agribusiness community to conduct long range planning
efforts for the management of their operations, while providing a reserve of agricultural land
through the year 2025.
LAKES/PONDS/STREAMS: The District liesprimarily within the Opequon Creek and
Stephens Run drainage area. The District will further assist with managing the quality of the
County’s water resources.
TOPOGRAPHY: The District generally variesfrom rolling hills to ridges to the north, west,
south and east. This District lies within Opequon Creek watershed and water is available from
ponds, wells and springs.
PRIME AGRICULTURE SOIL: Thelargest amount of prime agricultural soils located within
the District is Frederick-Poplimento.

This is a public hearing item to consider the update of the 2021 – 2022 Interstate, Primary, and
Secondary Road Improvement Plans.
Summary of Changes:
Updates to the priorities which are being recommended are for the reasons of consistency
between the plans and for continuity and support of the Board’s SmartScale applications.
Interstate Plan Updates are as follows:
1.There are no changes to the Interstate Plan at this time
Primary Plan Updates are as follows:
1.Reorder the priorities of the phases of Route 37 to prioritize need over constructability.
2.Add the slip ramps from Lenoir Drive to Route 37.
Secondary Plan Updates are as follows:
1.Update Major road improvements list to reflect current activities.
2.Update Advertisement years for projects on the scheduled list. No new projects were
added to the scheduled list.
The Transportation Committee reviewed this item on April 26, 2021 and has recommended
approval to the Board of Supervisors. The Planning Commission reviewed this item on May 5,
2021 and has recommended approval. VDOT will be present as well. Staff is seeking an action
from the Board of Supervisors on the plans.

IMPROVEMENT PLAN
WHEREAS, the Frederick County Transportation Committee recommended approval of this plan on
April 26, 2021; and,
WHEREAS, the Frederick County Planning Commission held a public hearing and recommended
approval of this plan at their meeting on May 5, 2021; and,
WHEREAS, the Frederick County Board of Supervisors had previously agreed to assist in the
preparation of this plan in accordance with the Virginia Department of Transportation’s policies and
procedures and participated in a public hearing on the proposed Plan, after being duly advertised so that
all citizens of the County had the opportunity to participate in said hearing and to make comments and
recommendations concerning the proposed Plan and Priority List; and,
WHEREAS, a representative of the Virginia Department of Transportation appeared before the Board
during the public hearing and recommended approval of the 2021 – 2022 Interstate Road Improvement
Plan and the Construction Priority List; and,
WHEREAS, the Frederick County Board of Supervisors support the priorities of the interstate road
improvement projects for programming by the Commonwealth Transportation Board and the Virginia
Department of Transportation;
NOW, THEREFORE, BE IT RESOLVED by the Frederick County Board of Supervisors as follows:
The 2021-2022 Interstate Road Improvement Plan appears to be in the best interest of the citizen of
Frederick County and the Interstate Road System in Frederick County; and therefore, the Frederick

Proposal
This is proposed text amendment to Chapter 165 – Zoning Ordinance to modify the definition (§165-
101.02) for “opaque fence” to allow a chain link fence with plastic slats to satisfy the screening
requirements for certain types of buffers and outdoor storage areas. The proposed amendment also
modifies §165-201.10 (Outdoor storage and process) removing the prohibition for chain link fencing
with slats for screening of outdoor storage areas, and modifies §165-203.02 (Buffer and screening
requirements) to further specify the type of fencing allowed only for road efficiency buffers.
Background & (Current) Zoning Ordinance Standard:
This request for a Zoning Ordinance text amendment was initiated by a business owner through their
Board of Supervisors representative to allow chain link fence with slats to fulfill the opaque fence
requirements for a full screen Category B Type zoning district buffer and screening for outdoor storage.
The Zoning Ordinance definition (§165-101.02) for an opaque fence specifies: “a fence that is
constructed to visually obscure structures, outdoor storage areas, and other uses. A chain link fence
constitute an opaque fence.” The opaque fence requirement is also referenced in
with slats shall not
other sections of the Zoning Ordinance including:
§165-201.10 Outdoor storage and processing.
§165-203.02 Buffer and screening requirements.
§165-204.11 Landfills, junkyards, trash disposal and inoperable vehicles (dumpster enclosures).

In satisfying the requirements for an opaque fence in the above sections, a 6-foot (FT) tall board-on-
board fence, hedge, wall, or a berm is typically required. However, a chain link fence with an opaque
vinyl tarp attached to it has also been allowed to satisfy the “opaque fence” requirement for outdoor
storage areas located in business and industrial districts. For outdoor storage areas in business and
industrial districts, chain link is typically the preferred type of fence for security.
For zoning district buffers and residential separation buffers, an opaque element is required to screen
differing land-uses and housing types on adjoining properties. The elements fulfilling the requirements

for a “full screen” buffer are landscape plantings, plus a 6-FT tall opaque wall, fence, hedge, or berm.
The full screen components were expanded in 2019 through a text amendment approved by the Board
of Supervisors, to allow an additional two (2) rows of evergreen trees that are six feet tall at time of
planting in lieu of an opaque fence. Chain link with opaque vinyl tarping has not been allowed as a
screening element for zoning district or residential separation buffers.
DRRC & Planning Commission Summary
The Development Review and Regulations Committee (DRRC) discussed this item at their regular
meetings on January 28, February 25, and March 25, 2021. The primary discussion by the Committee
focused on maintenance of chain link fence with slats versus other fence materials (board-on-board),
aesthetics, and what requirements should apply to slats (such material, opacity, color, and type). The
DRRC generally supported the use of chain link fence with plastic slats for outdoor storage and
buffers/screening where double-walled winged slats, with a minimum opacity (privacy factor) of 90%,
and limiting the colors of the slats to green, black, brown or tan. The Committee in their support for
the text amendment, felt that the intent of the opaque fence requirement, to “visually obscure structures,
outdoor storage areas, and other uses,” was still being met with this change. Following DRRC
discussion regarding visual impact on March 25, the DRRC also supported prohibiting chain link
fencing with slats for the opaque element of road efficiency buffers (§165-203.02(E)) which are
intended to provide protection for residential structures from any street classified as a collector road
or higher while still providing an attractive view of the residential neighborhoods from major
roadways. Two (2) members of the Committee objected to sending the item forward for further
discussion by the Planning Commission.
The Planning Commission discussed this item on April 21, 2021 and offered no comments.

§165-201.10 Outdoor storage and processing.
The outdoor storage or processing of products, equipment or raw materials is allowed in the business and
industrial districts or in association with business uses allowed in any other zoning district only if the
outdoor storage is directly associated with the primary uses of the property.
A.In such cases, the outdoor storage or processing shall be completely screened from the view of
road and street right-of-way and from surrounding properties by a six-foot-tall opaque fence,
wall, berm or evergreen screen. In no case shall chain-link fencing with slats be utilized for
screening.

Buffers and Landscaping
§165-203.02 Buffer and screening requirements.
It is the intent of the regulations of this section to encourage proper design of a site in order to protect
adjacent existing uses and to protect proposed uses within the site. Certain types of uses must be buffered
from other types in order to ensure a desirable living environment. Additionally, appropriate distances
must be maintained between commercial, industrial and residential uses and roads.
E.Road efficiency buffers. The purpose of these requirements is to provide protection for residential
structures from any street classified as a collector road or higher while still providing an attractive
view of the residential neighborhoods from major roadways. It is not the intent of these

At the Board of Supervisors meeting on April 14, 2021, staff was directed to prepare an amendment
to the Zoning Ordinance to add “Agricultural Supply Cooperatives” as a conditional use in the RA
(Rural Areas) Zoning District. Staff has prepared a text amendment for three areas of the Zoning
Ordinance. These include: 1) a new definition for Agricultural Supply Cooperatives, 2)
supplemental use regulations pertaining to this use, and 3) the inclusion of Agricultural Supply
Cooperatives as a conditional use in the RA District.
The Development Review and Regulations (DRRC) discussed this item at their meeting on April
22, 2021. The DRRC agreed with the text amendment with minor modifications and forwarded it
to the Planning Commission for discussion. The Planning Commission discussed this item at their
May 5, 2021 meeting; the Commission endorsed the amendment as drafted and sent it forward to
the Board of Supervisors for discussion.

Planning & Zoning:
A) Master Development Plan Requirement
A Master Development Plan is required prior to the development of this property.
Before an MDP can be approved, it must be reviewed by all relevant review agencies
and presented to the Planning Commission, Board of Supervisors for information.
Approval may only be granted if the MDP conforms to all requirements of the Frederick
County Zoning and Subdivision Ordinances. The purpose of a MDP is to promote
orderly and planned development of the property within Frederick County that suits the
characteristics of the land, is harmonious with adjoining property and is in the best
interest of the general public.
B) Site History
The properties subject to the MDP were part of Rezoning (REZ) application #13-06,
approved on November 8, 2006 with proffers. The approved proffer statement allows
up to 285 dwelling units (excluding garden apartment units which are prohibited). The
MDP conforms generally with the approved proffer statement and Generalized
Development Plan (GDP) approved with the rezoning.
C) Site Suitability & Project Scope
Comprehensive Plan:
The 2035 Comprehensive Plan is an official public document that serves as the
Community's guide for making decisions regarding development, preservation, public
facilities and other key components of community life. The primary goal of this Plan is
to protect and improve the living environment within Frederick County. It is in essence
a composition of policies used to plan for the future physical development of Frederick
County. The Area Plans contained in Appendix I of the 2035 Comprehensive Plan, are
the primary implementation tool and will be instrumental to the future planning efforts
of the County.
Land Use Compatibility:
The parcels comprising this MDP, Senseny Village,
Urban Development Area (UDA) and Sewer and Water Service Area (SWSA). The
UDA defines the general area in which more intensive forms of residential development
will occur. In addition, the Senseny Village property is located within the
Senseny/Eastern Frederick Urban Area Plan and planned for residential uses. The

current RP (Residential Performance) District zoning or the properties confirms with
the 2035 Comprehensive Plan.
Site Access and Transportation:
Access to the site, as shown on Sheet 5 of the MDP, will be provided from Senseny
Road (Route 657) via Rossum Lane (Route 736) and from Royce Drive (future public
road) from Glenridge Drive (Route 865) through the Glenmont Village subdivision. The
MDP notes improvements to Senseny Road at Rossum Lane intersection and a traffic
calming element (the designer proposes a traffic calming
approved by VDOT at time of subdivision design plan) where Rossum Lane enters the
Senseny Village development and along Royce Drive where the proposed new public
road approaches the Glenmont Village community. Internal public and private streets
with sidewalks provide circulation throughout the project.
The southeast corner of the project (PIN #65-A-
Bypass right-of-The approved proffer statement (REZ #13-06)
dedicates right-of-way in conformance with the October 1992 Frederick County Route
37 Functional Alignment Alternative C. Future Route 37 alignment, as presently
proposed by VDOT (2016), is also depicted for reference. Should this future alignment
come to fruition, it may have a significant impact on the proposed townhome units in
this section of Senseny Village.
Zoning Ordinance:
The site is in conformance with the applicable Zoning Ordinance standards for the RP
(Residential Performance) Zoning District. The MDP also addresses the required
buffers/screening, landscaping elements, recreation unit amenities, open space, and
pedestrian accommodations required by Code. A Subdivision Design Plan (SDP) will
need to be submitted to, reviewed by, and approved by Frederick County prior to
construction.
PLANNING COMMISSION SUMMARY FOR 04/21/21 MEETING:
The Planning Commission received a presentation on the Senseny Village Master Development
Plan at their April 21, 2021 and offered no comments.
