HomeMy WebLinkAbout068-21 (GreenSpringAg&ForestalDistrictAddition) ADDITION Action: PLANNING COMMISSION: January 20, 2021 Recommended Approval BOARD OF SUPERVISORS: February 10, 2021 Approved ADDITRON TO THE GREEN SPRING AGRICULTURAL & FORESTAL DISTRICT WHEREAS, Frederick County received a request to include eight parcels of land totaling 90.86± acres into the Green Spring Agricultural &Forestal District; these parcels are identified by Property Identification Numbers(PINS)22-A-49,22-A-47,22-A-46,22-A-45,21-3-23,21-3-22,21- 3-21, 2-A-49,22-A-47,22-A-46,22-A-45,21-3-23,21-3-22,21- 3-21, and 21-3-20. This District is located in the Gainesboro Magisterial District along Glaize Orchard Road (Route 682)to the south and Green Spring Road (Route 671) to the east; and WHEREAS,The Agricultural District Advisory Committee(ADAC)discussed this request at their meeting on December 15, 2020 and recommended approval; and WHEREAS,the Planning Commission held a public hearing for this request at their meeting on January 20,2021 and recormnended approval; and WHEREAS,the Board of Supervisors held a public hearing for this request at their regularly scheduled meeting on February 10, 2021; and WHEREAS, the Frederick County Board of Supervisors finds the addition of Property IdentificationNuxnbers(PINS)22-A-49,22-A-47,22-A-46,22-A-45,21-3-23,21-3-22,21-3-21,and 21-3-20,totaling 90.86±acres into the Green Spring Agricultural&Forestal District contributes to the conservation and preservation of agricultural and forestal land in Frederick County; NOW,THEREFORE,BE IT ORDAINED by the Frederick County Board of Supervisors as follows: The Frederick County Board of Supervisors hereby includes Property Identification Numbers(PINs) 22-A-49,22-A-47,22-A-46,22-A-45,21-3-23,21-3-22,21-3-21,and 21-3-20,totaling 90.86±acres into the Green Spring Agricultural & Forestal District, with an expiration and renewal date of September 9, 2025. This addition increases the size of the Green Spring Agricultural & Forestal District to 476.49 -/- acres. This Agricultural & Forestal District is as described on the attached map. Cheran, Zoning Administrator RE: 2020-2025 Green Spring Agricultural and Forestal District Request to Add Property Identification Numbers (PINs): 22-A-49, 22-A-47, 22- A-46, 22-A-45,21-3-23, 21.-3-22, 21-3-21, and 21-3-20 Martha Wolfe DATE: January 25, 2021 Please find attached an application from Martha Wolfe, dated November 5, 2020, seeking to add eight parcels, totaling 90.86+/- acres to the Green Spring Agricultural and Forestal District. The Green Spring Agricultural and Forestal District was established in 2014 and was renewed for a period of five years on September 9, 2020. Currently, the district contains 385.63+/- acres. If approved,this addition would increase the District to 476.49+/- acres. Section 15.2-4314 of the Code of Virginia, 1950, as amended,provides property owners with the ability to request to add land to the Agricultural and Forestal District through a public process via the local governing body. The Agricultural District Advisory Committee (ADAC) considered this request at their meeting on December 15, 2020. The ADAC unanimously recommended approval of the additions to the Green Spring Agricultural and Forestal District. The Planning Commission unanimously recommended approval of the additions at their meeting on January 20, 2021. This request is presented to the Board of Supervisors for public hearing. Staff is seeking a decision from the Board of Supervisors on this request to add eight parcels totaling 90.86+/- acres to the Green Spring Agricultural and Forestal District. Cheran, Zoning Administrator This report is prepared by the Frederick County Planning Staff to provide information to the Planning Commission and the Board of Supervisors to assist them in making a decision on this application. It may also be useful to other interested in this matter. Reviewed Action Agricultural District Advisory Committee: 12/15/20 Recommended Approval Planning Commission: 01/20/21 Recommended Approval Board of Supervisors: 02/10/21 fending PROPOSAL: A request to add eight parcels totaling 90.86+/-to the Green Spring Agricultural and Forestal District. LOCATION AND SIZE: This District is located within the Gainesboro Magisterial District and currently contains 385.63+/- acres within two (2) parcels managed by two (2) property owners. It is generally located along Glaize Orchard Road (Route 682) to the south and Green Spring Road (Route 671) to the east. This request for the addition of 90.86+1- acres would increase the Green Spring Agricultural and Forestal District to 476.49+/-acres. EXECUTIVE SUMMARY& STAFF CONCLUSION FOR THE 02/10/21 BOARD OF SUPERVISORS MEETING: This is a request to the Board of Supervisors to increase the Green Spring Agricultural and Forestal District. Chapter 43, Section 15.2-4300 of the Code of Virginia., 1950, as amended, requires that these Districts be reviewed by the local government every five years after establishment. The Green Spring Agricultural and Forestal District during the last renewal consisted of 385.63+/- acres. This proposed District request meets the intent of Chapter 43, Section 15.2-433 of the Code of Virginia, 1950, as amended, and has been evaluated in conjunction with the 2035 Comprehensive flan. This addition provides an opportunity for the agribusiness community to conduct long range planning efforts for the management of their operations, while providing a reserve of agricultural land through the year 2025. The 2020-2025 Green Spring Agricultural and Forestal District currently consist of 385.63+/- acres. This request of 90.86+/- acres would increase the Green Spring Agricultural and Forestal District to 476.49+/- acres. The Agricultural District Advisory Committee(ADAC) unanimously recommended approval of the 90.863+/-acres to the 2020-2025 Green Spring Agricultural and Forestal District at their meeting on December 15, 2020. The Planning Commission unanimously recommended approval of the 90.863+/-acres to the 2020-2025 Green Spring Agricultural and Forestal District at their meeting on January 20,2021. Following a public hearing, Board of Supervisors action on this application would be appropriate. Page 2 Green Spring Agricultural and Forestal District Addition January 29, 2021 REVIEW EVALUATIONS: LOCATION AND SIZE: This District is located within the Gainesboro Magisterial District and currently contains 385.63+/- acres within two (2) parcels managed by two (2) property owners. It is generally located along Glaize Orchard Road (Route 682) to the south and Green Spring Road (Route 671) to the east. This request for the addition of 90.$6+/- acres would increase the Green Spring Agricultural and Forestal District to 476.49+/-acres. AGRICULTURAL & FORESTAL SIGNIFICANCE: The agricultural operation in the District is 40 percent agriculture (livestock, and crop harvesting) and 60 percent open space/woodlands. The area within the District is rural in nature. LAND USE: All parcels within the District are agricultural, vacant, and woodland. COMPREHENSIVE PLAN: The 2035 Comprehensive Plan of Frederick County provides guidance when considering land use actions. The location of this proposed District lies outside the Urban Development Area (UDA) and Sewer and Water Service Area(SWSA) and is not part of any land use plan or study by the County. The land use within this District of 385.63+/- acres is vacant. This current land use should remain in its present land use of pristine condition with land use of vacant and woodland. The intent of the Rural Areas is to maintain agriculture as a significant portion of the County's economy and to maintain the rural character of areas outside of the Urban Development Area. The Comprehensive Plan can accomplish this by promoting the inclusion of additional land in Agricultural and Forestal Districts. The Comprehensive Plan Supports the renewal of the District for it provides an opportunity for the agribusiness community to conduct long range planning efforts for the management of their operations, while providing a reserve of agricultural land through the year 2025. LAKES/PONDS/STREAMS: The District lies within the Green Springs and Babbs Run drainage areas. These two bodies of water are tributaries to Back Creek. This District will further assist with managing the quality of County's water resources. TOPOGRAPHY: The District generally varies from rolling hills to ridges to the south, west, and north. Flat and gentle rolling hills are to the east. This District lies within the Green Springs and Babbs Run drainage area and water is available from ponds, wells and springs.
