December 09, 1946X10 At the Regular meeting of the Board of Supervisors of Frederick County, Virginia, held in the Supervisors Room over the Clerk's Office on Monday December, 9th, 1946. P- R- E- S -E -N -T C. M. Rosenberger, Chairman, G. W. Lemley, H. M. Fout, William Carpenter and H. C. Light. The minutes of the last meetins held on the IIth day of November, 1946 were read and approved. FURNACE - HEATING Upon motion of G. W. Lemley and seconded by William Carpenter, it was unanimously decided and ordered that Mervel W. Adams be employed to furnish and install a New furnace in the basement of the Court House. SALE - FREDERICK COUNTY POOR FARM Upon motion the following Resolution was unanimously adopted. RESOLUTION OF BOARD OF SUPERVISORS OF FREDERICK COUNTY, ADOP'T'ED AT ITS REGULAR .MEETING HELD ON DECEMBER 9 1946. WHEREAS, the Board of Supervisors of Frederick County.y. Virginia, by a resolution adopted on July 9, 1945 at a regular meeting of the Board, approved and directed the sale of the Frederick County Poor Farm, consisting of two tracts of land, with inprovements, to -wit: (A) A certain tract or parcel of land situate in the County of Frederick, near the Round Hill, consisting of two lots, Lot No. I containing approximately 204 acres, I rood and 33 poles, and Lot No. 2 containing approximately I17 acres and 28 perches; the whole thereof containing 321 acres, 2 roods and 2I perches, more or less. The said property was acquired by the Overseers of the Poor of Frederick County and Corporation of Winchester by deed bearing date January 15, 1820, from Fleet Smith and Jane Smith, his wife, of record in Deed Book 43, page 266, in the office of the Clerk of the Circuit Court of Frederick County, Virginia. (B) A certain tract or parcel of land lying in Frederick County, Virginia, containing 52 -I/2 acres, more or less, which property was conveyed to the Overseers of the Poor of Frederick County and the Corporation of Winchester by deed from William Daniels bearing date December I828 and of record in Deed Book 54, page 429, in the office of the Clerk of the Circuit Court of Frederick County, Virginia. Frar.] WHEREAS, the Judge of the Circuit of Frederick County, Virginia, entered and order on October 5 1945,of record in Chancery Order Book 35, at page 52, approving the sale of said property by the Board of Supervisors; and WHEREAS, since the adoption of the foregoing resolution and the entry of said order, the Board of Supervisors and the Common Council of the City of Winchester, Virginia, owner of a one -half interest in said property, procured a survey of said two tracts of land, which survey showed that said tracts of land are more accurately described as follows] to -wit: Tract A containing 280 acres and 39 square poles, and Tract B containing 74 acres, 3 roods, and IO square poles; and WHEREAS, the Board of Supervisors of Frederick County and the Common Council for the City of Winchester caused said property to be advertised for sale, once a week, for four (4) successive weeks, in the Winchester Evening Star, a J AL (newspaper having a general circulation in the City of Winchester and Frederick County, land PIHEREAS, Tract A was sold at public auction, in front of i the Frederick County Court Hots e, in Winchester, Virginia, on November 30, 2946 to Boyd IV. Unger,,the highest bidder, for the sum of $17,000; and WHEREAS, Tract B was sold at public auction, in front of the Frederick County Court House, in Winchester, Virginia, on November 30, 1946, to Edward 1W. Cather, the highest bidder, for the sum of $I,900. NOW, THEREFORE, BE IT RESOLVED: (I) That the prices offered at public sale for the pur- Ichase of said properties represent the true and fair market value of said properties, and that it is to the best interest of Frederick County to accept the said offers of purchase. (2) That the sales of said properties be and the same are hereby ratified, approved and confirmed. (3) That a report of said sale be made to the Circuit Court of Frederick County, Virginia, and that said Court be petitioned to approve and ratify said sales. (4) That, upon the approval and ratification of said sales by the Judge of the Circuit Court of Frederick County, the Board of Supervisors cause to be executed and delivered to the purchasers of said properties general warranty deeds conveying all of its right, title and interest in and to said properties, and that the purchase price, as it is received, be paid into the County Treasury as provided by Section 2723 of the 1942 Code of Virginia. (5) That said deeds be executed by C. M. Rosenberger, Chairman of the Board of Supervisors, and the Seal of the County affixed thereto and be attested by the Clerk of said Board. (6) That all bills and expenses properly incurred in con- nection with the sale of said properties, including the survey of the property, advertis of sale, examination of title, auctioneer, and execution of deeds, be paid. ( SCHOOL BUILDING FUND Upon motion and duly seconded it is ordered that the Treasurer transfer the amount of Special School Levy (60'cents per one hundred dollars valuation), to a special School Building Fund. BILLS APPROVED Accounts totaling $ 2,297.16 were approved and ordered to be paid from the General County Fund by warrants numbers 9856- to 9893 inclusive and Livestock Claims and F. W. Pingleys salary totaling $70.22 were approved and ordered to be paid from the Dog Fund by warrants numbers 855 to 859 inclusive. It is ordered that the Board do now adjourn. ,Chairman
