Chairman DeHaven called the meeting to over at bM p.m. 91.60110590M Vice Chairman Wells moved that the Board of Supervisors of Frederick County enter a closed session pursuant to Virginia Code Section 2.2-3711(A)(19) and 2.2-3711(A)(3), for discussion of plans to protect public safety as it relates to specific eybersecurity threats or vulnerabilities and briefings by staff members and legal counsel concerning actions taker} to respond to such matters or a related threat to public safety, discussion of information subject to the exclusion in subdivision 2 of Section 2.2-3 05.2, where discussion in an open meeting would jeopardize the safety of any person or County information technology systems, and for consultation with legal counsel regarding a legal matter requiring the provision of legal advice by such counsel, all specifically regarding recent activity involving County information technology systems; pursuant Minytg Sp9h 45 Soard of Supervisors Closed Sessian + Regular Meeting of June 10, 2020 County of Frederick Virlinio 393 to Virginia Code Section 2.2-3711(A)(8), for consultation with legal counsel regarding a legal matter requiring the provision of legal advice by such counsel, specifically regarding a dispute with a vendor regarding the procurement of a specialized motor vehicle designed for use for public safety purposes; and pursuant to Virginia Code Section 2.2-3711(A)(1), for personnel matters, specifically the annual evaluations of the County Administrator and the County Attorney. Supervisor Slaughter seconded the motion which carried on a voice vote. At 6:41 p.m., the Board members being assembled within the designated meeting place in the presence of members of the public and the media desiring to attend, the meeting was reconvened on motion of Vice Chairman Wells, seconded by Supervisor Dunn and carrying on a voice vote. Vice Chairman Wells moved that the Board of Supervisors of Frederick County certify that, to the best of each member's knowledge, (1) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting to which this certification applies, and (H) only such public business matters as were identified in the motion convening the closed meeting were heard, discussed, or considered by the Board. EXTENSION OF DECLARATION OF LOCAL EMERGENCY FOR COVID -19 PANDEMIC — DENIED At the request of Supervisor Graber, the Extension of Declaration of Local Emergency for Minute Book 45 Board of Supervisors Closed Session & Regular Meeting o f f une 10, 2020 County of Frederick, Virginia we Covid-19 Pandemic was removed from the Consent Agenda. Supervisor Graber moved that the Board not extend the declaration of emergency for the Covid-19 pandemic saying it was overreach to extend the local emergency through the end of the year as proposed and that it was time for things to return to normal. Supervisor Dunn seconded the motion adding that the declaration was causing more problems than it was worth. Supervisor Fisher inquired if not having a local emergency in effect would limit the County's ability to receive funding assistance. County Administrator Tierney noted the local declaration does not impose any limitation on business and only keeps the County eligible to receive state reimbursement. He noted the federal Coronavirus Relief Act Funds are available for expenses through the end of the year which is why staff proposed the same time period for extending the declaration of local emergency, Supervisor Graber said the declaration gives the County Administrator the ability to make decisions bypassing the Board of Supervisors. Supervisor McCarthy and Mr. Tierney discussed the Coronavirus relief funds already received and the possibility of traditional emergency funding as another option. Supervisor McCarthy said he supported the motion and that if the need arose, a new local emergency could be declared. The motion carried on a recorded vote as follows; Blaine P. Dunn Aye Gene E. Wilkins, III, Minute Book 45 Board of Supervisors Closed Session di Regular Meeting of June 10, 2020 County of Frederick, Virginia each to a three-year term beginning 8/31/20. The motion, seconded by Supervisor Dunn, carried on a voice vote. PROPOSED AMENDMENT TO FY 20.21 BUDGET- DENIED Supervisor Dunn cited concerns about expected County revenues in light of the pandemic and moved to withhold $4.8 million from the adopted FY 20-21 budget until the Board has determined expected revenues are available. He said the reduction would give the County and the Schools each the same funding as the current year and could be increased once revenues are assured. Supervisor McCarthy seconded the motlon saying it makes sense to hold off spending for now. Vice Chairman Wells said the reduction does not have to be done now and can be done later if necessary. Supervisor Gaber said it is wise to give staff direction on the budget because certain things are on hold until revenues are known. Supervisor Dunn said the action needs to happen now because in July the Schools are allotted their budgeted funds and if there is a revenue shortfall, only the County will bear the loss. BOARD LIAISON REPORTS - None Minute Book 45 Board of Supervisors Closed Session & Regular Meeting of June 10, 2020 County of Frederick, Virginia CITIZEN COMMENTS Eli 'Nick' Lauderdale, Gainesboro District, spoke in reference to his road being scheduled for paving this fiscal year, BOARD OF SUPERVISORS COMMENTS Supervisor Dunn noted the protests occurring across the country saying that locally the protest was civil. Supervisor Dunn referenced the Governor of Virginia saying the pandemic lockdown needs to stop and asked the Governor to reconsider his position. On Monday, May 18, 2020, a special meeting was held by the Shawneeland Sanitary District Advisory Committee (SSDAC) to discuss the FY 2021 budget. Attachment 1 in the agenda packet is a summary of the meeting including documentation from SSDAC recommending budget 2A which is attachment 2 in the agenda packet. Therefore, committee member Strawsnyder made a motion to recommend approving budget option 2A. The motion was seconded by Supervisor Wells. The committee unanimously approved the motion. ITEM FOR INFORMATION ONLY 1-Discuss reimbursement request for Animal Shelter As stated in the agenda packet attachment 3, the Animal Shelter requests that funds in the line item 10-4305-3002-00, Professional Services -Engineering and Design totaling $15,341.00 be placed back into the 1034 donation fund. Minute Book 45 Board of Supervisors Closed Session & Regular Meeting of June 10, 2020 County of Frederick, Virginia "I 2-Update current solid waste impacts from Covid-19 As shown in attachment 4 of the agenda packet, we have seen a 20% increase in solid waste disposal by citizens due to many people being home and cleaning up around their property. 3-Update on current Public Works projects a. Albin Convenience Center Replacement — Currently, work is on -going at the SFW — old bus shop located off Indian Hollow Road. We anticipate completion in July 2020. b. Crossover Boulevard Road Project — Currently, the contractors continue to construct the road and bridge. They have begun placing concrete on the bridge deck. It is anticipated that the bridge will be completed by late summer. The road project is ahead of schedule, The anticipated completion date is September 10, 2021. c. Landfill MSW cell development— Our contractor continues to excavate soil and rock material from our next 10-acre MSW Landfill cell. We anticipate constructing the liner system in 2022. 4-Sunnyside Plaza updates Due to on -going Covid-19 budget cuts, the design for additional office space at the recently acquired Sunnyside Plaza is on hold. As a follow up for additional information regarding option #4, our consultant, OWPR did some preliminary work and cost estimates showing site development with no parking deck. Attached are slides showing some layouts and cost estimates for option #4 using Sunnyside Plaza and some options using the old Aylor Middle School as a possible office space. (Attachment 2) It was agreed that further discussion and design work for the use of Sunnyside Plaza will be put on hold for several months or longer until the county can assess the state of the economy and budget due to the on -going pandemic.
