A W orksessionlMeeting ofthe Frederick County Board of Supervisors and Winchester City Council was held on September 13, 2000, at 6:00 P.M., in the Board of Supervisors' Meeting Room, County Administration Building, 107 North Kent Street, Winchester, Virginia. PRESENT Chairman Richard C. Shickle; Vice Chairman Charles W. Orndoff, Sr.; W. Harrington Smith, Jr.; Robert M. Sager; and Sidney A. Reyes. ABSENT Margaret B. Douglas - Out of Town. PRESENT President Charles T. Gaynor; J. Stephen Bauserman; Jeffrey B. Buettner; Glen P. Burke; Timothy S. Coyne; Michaell. DeFazio; Carolyn T. Griffin; Alexander R. Iden; Elizabeth A. Minor; Michael E. Noel; and John B. Schroth. ABSENT Mayor Larry T. Omps, and Theodora L. Rezba. Worksession held between Board and City Council from 6:00 P.M. until 8:00 P.M. at which time they adjourned. The following resolution was approved by the two joint bodies: KIDS VOTING OF THE NORTHERN SHENANDOAH VALLEY BOARD OF SUPERVISORS RESOLUTION (#006-00) - APPROVED Upon motion made by Supervisor Reyes, seconded by Councilman Griffin, and approved unanimously, the following resolution was approved: WHEREAS, the signatories below wish to recognize that Kids Voting of the Northern Shenandoah Valley is an organization dedicated to developing life long voters among students of the Northern Shenandoah Valley; and WHEREAS, the signatories recognize that over the past year, Kids Voting of the Northern Shenandoah Valley, chaired by Dr. William Shendow, of the Marsh Institute, Shenandoah University, provided curriculum support material to teachers in the Frederick County school system; and WHEREAS, the signatories also recognizes that the Kids Voting of the Northern Shenandoah Valley provided over 200 volunteers which enabled nearly 1,500 area students to experience the thrill of voting at polling precincts during recent local elections; and WHEREAS, the signatories wish to make it publicly known that this joint body of elected officials gives its full support to local kids voting efforts in the upcoming November and future elections. NOW, THEREFORE, BE IT RESOLVED, that thc Common Council of thc City of Minute Book Number 27 Joint Worksesslon/Meeting - Board of Supervisors and City Council- 09/13/00 43 Winchester and the Board of Supervisors for the County of Frederick, Virginia, do hereby proclaim the Kids Voting ofthe Northern Shenandoah Valley a valuable asset towards youth development in the community. ADOPTED this 13th day of September 2000. MEETING ADJOURNED WITH CITY COUNCIL The Board of Supervisors conducted the following business at this time: PUBLIC HEARING - RESOLUTION (#007-00) TO VACATE A ROAD PREVIOUSLY DEDICATED TO THE COUNTY AND DESIGNATED AS CAPITOL LANE EXTENDING FROM SHAWNEE DRIVE IN THE BACK CREEK MAGISTERIAL DISTRICT. APPROXIMATELY 749 FEET. 6 INCHES ON THE PROPERTY OF TREX COMPANY. L.L.C. SAID ROAD IS FURTHER IDENTIFIED IN ADEED OF DEDICATION WHICH IS FOUND AND RECORDED IN THE LAND RECORDS OF FREDERICK COUNTY IN DEED BOOK 907. AT PAGE 1034 - APPROVED County Administrator Riley presented this request to the Board. There was no public input. Upon motion made by Supervisor Smith, seconded by Supervisor Reyes, the following resolution was approved by the following recorded vote: Richard C. Shickle - Aye Charles W. Orndoff, Sr. - Aye W. Harrington Smith, Jr. - Aye Robert M. Sager - Aye Margaret B. Douglas - Absent Sidney A. Reyes - Aye WHEREAS, the County of Frederick ("County") is empowered to vacate streets and alleys in the County pursuant to, and in, conformance with provisions of the Code of Virginia, 1950, Section 15.2-2006, et.seq., as amended; and WHEREAS, the County intends to vacate a street known as Capitol Lane extending south from the intersection with Shawnee Drive extending a distance of approximately 749 feet, 6 inches from the intersection with Shawnee Drive. Being the same property previously dedicated to Frederick County. Said Deed of Dedication can be found and is recorded in the Land Records of Frederick County at Deed Book 907, Page 1034, which intention was advertised according to law, and the land proprietors affected by said action were notified; and WHEREAS, the Board at its meeting did determine that it was appropriate to vacate said street; and NOW, THEREFORE, BE IT RESOLVED, that a street known as Capitol Lane extending south from the intersection with Shawnee Drive extending a distance of approximately 749 feet, 6 inches from the intersection with Shawnee Drive. Being the same property previously dedicated to Frederick County. Said Deed of Dedication can be found and is recorded in the Land Records of Frederick County at Deed Book 907, Page 1034 be and hereby is vacated. BE IT FURTHER RESOLVED, that the Clerk of the Board of Supervisors is hereby directed to place a certified copy of the resolution of record with the deed records in the Clerk's Office of the Circuit Court for the County of Frederick; and BE IT FURTHER RESOL VED, that the strip hereby vacated is hereby conveyed to Trex Minute Book Number 27 Joint Worksession/Meeting - Board of Supervisors and City Council- 09/13/00 04L;. Company, LLC for valuable consideration plus the costs of the vacation ofthe portion ofthe street; and BE IT FURTHER RESOLVED, that this resolution shall not take effect until such time as the purchaser has delivered to the County the consideration set out in this resolution. The County Administrator is hereby authorized and directed to execute all documents necessary to carry out the purposes of this resolution. ADOPTED this 13th day of September 2000. APPROPRIATION OF GRANT FUNDS AND AUTHORIZATION TO EXECUTE ISTEA AGREEMENT FOR KBA BATTLEFIELD PURCHASE RESOLUTION (#008-00) - APPROVED County Administrator Riley presented this request to the Board. Upon motion made by Supervisor Sager, seconded by Supervisor Orndoff, the following resolution was approved: WHEREAS, Frederick County and the City of Winchester successfully applied for $1,490,000 in Federal ISTEA and TEA-21 funds to be applied toward the purchase of the Charles Hardy Grim property in an effort to preserve and protect a significant portion of the Battlefield of 1 st and 2nd Kernstown; and WHEREAS, Frederick County is the fiscal agent for $350,000 in Land and Water Conservation monies granted by the National Park Service and matched with $350,000 from the Commonwealth of Virginia Department of Conservation and Recreation to be applied toward the purchase; NOW, THEREFORE, BE IT RESOLVED, that the Frederick County Board of Supervisors authorizes the appropriation of$850,000 to cover the portion of the above-mentioned funds not yet appropriated; and BE IT FURTHER RESOLVED, that Frederick County Board of Supervisors authorizes the Chairman to enter into a revised contractual agreement with the City of Winchester and the Virginia Department ofTransportation which reflects the current $1 ,490,000 total ofISTEAlTEA-21 funds being awarded.
