W>iIEREAS, the Frederick County Planning Department has been directed to prepare
modifications to Chapter 165, Zoning to add Tractor Truck and Tractor Truck Trailer Parking
as conditional uses in the B3 (Industrial Transition), Ml (Light Industrial) and M2 (Industrial
General) Zoning Districts and to add supplementary use regulations for the use.
WIIEREAS, The Develapanent Review and Regulations Committee (DRRC) recomx�rkended
approval of this amendment on February 25, 2010; and
WIIEREAS, the planning Commission discussed the draft ordinance on March 17, 2010 and
recommended that a public hearing be held; and
WHEREAS, the Frederick County Board of Supervisors �mds that in the public necessity,
convenience, general welfare, and good zoning practice, directs the Frederick County
planning Commission hold a public hearing regarding an amendment to Chapter 16�, Zozzing
to add Tractor Truck and Tractor Truck Trailer Parking as conditional uses in the B3
(Industrial Transition }, M1 (Light Industrial) and M2 (Industrial General) Zoning Districts
and to add supplementary use regulations for the use.

Staff has received a request to include tractor truck and tractor truck parking as a use in the Ml
(L�iglit Ind+�striai) and ]�S2 (Industrial General) Zoning Districts. Specif cally what is being
requested is to allow a parking area to store trucks and trailers for an extended period oftirne as a
primary use. The pay -king areas would possibly include a guard facility, but no other buildings or
uses. Currently, this is not an allowed pria�aary use and can only be done in c;oniunction anal
accessorylsecondary to a permitted primary use (such as znar�ufacturing/drstributio� warehousing
with a parking area or, the san7e property to store their trucks and trailers).
The item was presented to the Development Review and Regulations Corrimiitee (URRG} at
their nZeeting on 1"ebruary 25, 2010. The DR.RC had an extensive discussion on the proposed use
and recommended the following. the use be permitted as a primary use only rhrough the
approval of a Conditional Use PerJnit; the use added to the B3; revised surface iziaterial
requirements (paving far Truck parking and gravel for trailer storage} provision that no
inoperable'trucksftrailers be allowed; modified. Iandscaping language; and provision that allows
the Board of supervisors to include additional conditions. ��ith those changes, the DR.RC
recommended that the ordinance amendment be forwarded to the Planili_rlg Cornmi.ssion for
discussion.
The ordinance a.FZ%endment aitached to this memorandum v�auld only allow truck and trailer
parking as a primary use in the B3 (Industrial :Transition }, MI (Light Industrial) and M2
(Industrial � General} Zoning Districts with a Conditional Use Perzi�it (CUP }. The CUP option
was included because the I7RRC felt thaf this woula allow.the Bc�ax`d of Supervisors to permit the
use in appropriate locations and root erode desirable industrial �.ocations, and v;�ould als�a allow the
revocation of the use if fihe site was being u.5ed imprrperly. Su�plcmentary izse regulations in the
form of required conditions for the CUI' have 'also -been incl�ided. These conditions regulate
surface material, inoperable trucksitrailers, prohibition of inairitenanee and gas facilities and
landscaping.
The PlanrilFlg Cq%1rrilSSfon discussed this iteu� at their It�arc'.� 1 1, 2010 meeting. Con�?n1SS�cn
members expressed concern over the permanent storage of trailers, the storage of uiuicensed
trailers and cargo containers_ It was also discussed that a tim�.frame should be implemented for
the proposed use (b0 -g0 days of storage maximum} so that the use would riot becorrae a
