A Worksession of the Frederick County Board of Supervisors was held on Tuesday, May 11,
2006, at 12: 15 P.M" in the Board of Supervisors' Meeting Room, County Administration Building,
107 North Kent Street, Winchester, Virginia.
BOARD MEMBERS PRESENT
Chairman Richard C. Shickle; Vice-Chairman Bill M. Ewing; Charles S. DeHaven, Jr.; Gary
W. Dove; Gene E. Fisher; Philip A. Lemieux; and Barbara E. Van Osten.
OTHERS PRESENT
Planning Commissioners: June Wilmot; Roger Thomas; John Light; Chris Mohn; Gregory
Kerr; Robert Morris; Gary Oates; and George Kriz; and members of the public: Claus Bader; J.P.
Carr; and Lynda Hyre.
CALL TO ORDER
Chairman Shickle called the work session to order. He then turned the presentation over to
Transportation Planner John Bishop.
Planner Bishop advised the purpose of this meeting was to provide a description and work
through the nuts and bolts of a transportation impact fee program, should the Board choose to
implement one. He advised the County was enabled to create such a committee pursuant to 9915-2-
2317 through 15.2-2327 of the Code of Virginia, 1950, as amended. Under the provisions of this
legislation, localities that arc enabled may, by ordinance, impose impact fees for new development.
Planner Bishop then reviewed the basic structure and requirements for such a program:
1. A Transportation Impact Fees Committee must be appointed prior to ordinance adoption.
Staff recommended using the Current Transportation Committee due to this committee's
familiarity with the work and the fact this committee already meets the membership
requirements.
2. One or more Impact Fee Service Areas must be delineated within the County. Staff
would attempt to focus on the rural areas of the County.
3. The County must develop and adopt a transportation plan. This plan must be adopted
as part of the Comprehensive Plan and the Capital Improvements Program.
A draft ordinance was included as part of the staff report for this meeting. Should the Board wish
to implement such a program, Planner Bishop provided the following implementation schedule:
1. Designate a Transportation Impact Fee Committee.
2. Designate Impact Fee Service Areas. This part of the process requires a public hearing.

3. Develop a transportation plan to identify the needs created by projected development of
parcels within the Impact Service Area(s). This plan must show the projected costs for
projects to be paid for under this program. Further, this plan must be adopted as part of
the Comprehensive Plan and Capital Improvements Program. (This step requires public
hearings.)
4. Develop a fee schedule.
5. Adopt the ordinance with impact fee service area map and fee schedules included.
6. The plan must be updated every two years.
Chairman Shickle asked if the collection of the impact fee would be at the issuance of a
certificate of occupancy, which was similar to Stafford County.
Planner Bishop responded this process would be the same.
Chairman Shickle asked about the appeals process, particularly why Stafford County
changed its appeals process to include an appeals board rather than utilizing the Board of
Supervisors.
Planner Bishop advised he would research the reason for that change.
Supervisor Lemieux stated that he wanted homeowner/home buyers to be aware they have
to pay these impact fees.
Supervisor Fisher asked if flexibility could be maintained regarding the Board's ability to
accept off-site road improvement proffers versus impact fees.
Planner Bishop stated the transportation fees collected would have to be put into an account
specifically for improvements in the designated area.
County Administrator John R. Riley, Jr. asked staff to use Warrior Drive to determine the
costs/benefits of this program.
Chairman Shickle asked what the downside would be of going through these steps.
Administrator Riley responded it would be a good exercise to undertake whether or not the
Board implemented the plan.
Chairman Shickle agreed the exercise would be beneficial, but felt it might be more
beneficial to have the transportation plan first.
Administrator Riley recommended the Board create the Committee, using the existing
Transportation Committee, and charge them with formulating a plan to include the different areas
ofthe county.

Chairman Shickle polled the Board members.
Supervisor Van Osten was okay with moving forward with this proposal.
Vice Chairman Ewing was okay with moving forward.
Supervisor DeHaven was okay with moving forward.
Supervisor Fisher was okay with moving forward.
Supervisor Dove felt the Board needed to pursue this tool.
Planning Commission Chair June Wilmot stated she would like to see the County be very
strategic and she did not think they should give up a potential tool because it might be too onerous.
There being no further business, the meeting was adjourned at I :30 P.M.
