017-12RESOLUTION REGARDING CLAIMS ASSERTED BY CURRENT AND FORMER SHERIFF'S DEPUTIES WHEREAS, the Board has received, pursuant to the provisions of Virginia Code § § 15.2 -1243 et seq., notices of claims (the "Claims "), dated July 10, 2012, asserted by 63 current and former Sheriff's Deputies (the "Claimants "); and WHEREAS, the Claimants assert they are entitled to certain compensation, damages, and attorneys' fees, pursuant to the provisions of Virginia Code §§ 9.1 -700 et seq, and the provisions of the federal Fair Labor Standards Act ( "FLSA "), specifically, 29 U.S.C. § 207(o); and WHEREAS, County staff, including the County Attorney and the County's retained counsel, have reviewed the form and substance of the Claims and have investigated the factual and legal bases for the Claims and have advised the Board regarding the same; and WHEREAS, the County has previously offered payments to Sheriff's Deputies, other than the Claimants, regarding matters involving the provisions of Virginia Code §§ 9.1 -700 et seq., in exchange for releases of the County and the Sheriff from any claims as to such matters; and WHEREAS, over one half of the Sheriff's Deputies, other than the Claimants, have agreed to the payments offered by the County, in exchange for releases of the County and the Sheriff; and WHEREAS, based upon the foregoing, the Board finds that approval of the Claims at the present time, without both the County and the Sheriff being released from the Claims, would not be appropriate; and WHEREAS, however, the Board remains committed to the resolution of any matters involving compensation received by the Claimants. NOW, THEREFORE, BE IT RESOLVED, that the Board denies the Claims, without prejudice to the re- presentation of the Claims to the Board in the future; and BE IT FURTHER RESOLVED, that the Board authorizes the County Administrator, the County Attorney, such other appropriate County staff, and/or the County's retained counsel to offer to the Claimants, in settlement of their Claims, a payment in the collective amount of $73,389.59, with individual amounts by Claimant set out in the attachment hereto, provided that: (1) each individual Claimant shall execute a release of any and all claims, against the County, the Board of Supervisors, the Sheriff, and/or any and all of their agents, officers, and employees, arising out of the same transactions and occurrences set forth in the Claims; and (2) as the Claims made assertions under the FLEA, each such release shall be subject to the approval of the United States District Court for the Western District of Virginia, in the pending litigation titled Baber v. County of Frederick Virginia Case Number 5:12 -ev- 00037- MFU -JGW; and BE IT FURTHER RESOLVED, that the foregoing offer is for settlement purposes only, does not constitute an admission by the County as to any particular conduct, and this resolution and the fact of its approval shall not be admissible in any litigation or other proceeding. Williams County Attorney DATE: September 21, 2012 RE: Sheriffs Deputies' Administrative Claims — Disposition A group of Sheriff's Deputies, through their counsel, has submitted administrative claims seeking recovery for certain so- called "gap pay" amounts and for matters concerning the federal Fair Labor Standards Act. A representative copy of one of the claim letters is attached for your reference. Counsel submitted 63 of these letters in total. The letters are each identical, other than the name of the particular Deputy on whose behalf each is submitted. A list of the names of the 63 individuals is attached for your reference. Our Client has brought to our attention that the County has wrongly calculated overtime wages due to this Sheriff Deputy, Our client is not in possession of the records needed to provide an exact amount of the claim being asserted herein. The County, however, has access to these records and is, therefore, aware of the exact amount of overtime hours worked, hourly pay rate earned, and the exact dollar amount of wages sought by this claim. Scott Baber is claiming all unpaid wages for hours worked between April 1, 2009 and April 16, 2012 that fall within either of the below two categories: 1) Overtime compensation (e.g. — half the Deputy's hourly rate) for all hours worked per 28 day pay - period over the Deputy's regularly scheduled hours of 160 hours and under the 171 federal overtime threshold, as required to be paid by Va. Code § 9.1 -700, et seq.; and 2) Overtime compensation for any "comp- time" hours (e.g.- hours worked over those regularly scheduled which are carried forward to future pay periods) earned but not paid or credited as overtime hours (e.g. - time and a half), as required by 29 U.S.C. § 207(o). For any amounts determined to be owed as back -wages (for violation of either of the above two categories), the County also owes the Deputy an equal amount as "liquidated damages" and the Deputy's attorney fees incurred in pursuing these claims.
