July 14 2011 Special Meeting Minutes101 A Special Meeting of the Frederick County Board of Supervisors was held on Thursday, July 14, 2011, at 12:00 P.M., in the Board of Supervisors' Meeting Room, County Administration Building, 107 North Kent Street, Winchester, Virginia. PRESENT Chairman Richard C. Shickle; Vice - Chairman Bill M. Ewing; Christopher E. Collins; Charles S. DeHaven, Jr.; Gary W. Dove; Gene E. Fisher; and Gary A. Lofton. CALL TO ORDER Chairman Shickle called the meeting to order. INVOCATION Supervisor Fisher delivered the invocation. PLEDGE Vice - Chairman Ewing led the Pledge of Allegiance. ADOPTION OF THE AGENDA County Administrator John R. Riley, Jr. advised that he had no additions or changes to the agenda. Upon a motion by Vice - Chairman Ewing, seconded by Supervisor DeHaven, the Board approved the agenda. The above motion was approved by the following recorded vote: Richard C. Shickle Aye Bill M. Lofton Aye COUNTY OFFICIALS 20 COMPREHENSIVE POLICY P LAN — THE PLAN COMPREHENSIVELY ADDRESSES THE FUTURE OF FREDERICK COUNTY FOR ITS CITIZENS. THE PLAN IS GUIDED BY THE VISION STATEMENT AND CORE VALUES CRAFTED AND ADOPTED BY THE FREDERICK COUNTY BOARD OF SUPERVISORS. THE PLAN IS SUPPORTED BY TWO APPENDICES: APPENDIX I, WHICH INCLUDES EACH OF THE COUNTY'S AREA PLANS, AND APPENDIX II, WHICH PROVIDES BACKGROUND ANALYSIS AND STUDIES IN SUPPORT OF THE PLAN. THE PLAN IN ITS ENTIRETY MAY BE VIEWED AT WWW.FREDERICKC_ — (RESOLUTION #001 -11) - APPROVED Director of Planning and Development Eric Lawrence appeared before the Board regarding this item. He advised the Board, at its June 22, 2011 meeting, considered the 2030 Comprehensive Plan and obtained additional input. The :Board passed a motion to further Minute Book Number 37 Board of Supervisors Special Meeting of 07/14/11 2030 Comprehensive Plan ME , postpone action on the Plan until its September 28, 2011 meeting. He advised this vote to postpone action created a conflict with the Code of Virginia §15.2 -2226, which requires the governing body to act within 90 days of the local Planning Commission's recommendation, which occurred on April 20, 2011. He went on to say the Board has the ability to approve and adopt, amend and adopt, or disapprove the plan and action by the Board would be appropriate at this time. Supervisor Collins moved to rescind the previous motion to postpone, to the September 28, 2011 meeting, action on the proposed 2030 Comprehensive Policy Plan, which was approved by the Frederick County Board of Supervisors at the June 22, 2011 meeting. The motion was seconded by Vice - Chairman Ewing. The above motion was approved by the following recorded vote: Richard C. Shickle Aye Bill M. Ewing Aye Christopher E. Collins Aye Charles S. Lofton Aye Supervisor Collins moved that the Board adopt the 2030 Comprehensive Policy Plan by passing the resolution to adopt the 2030 Comprehensive Policy Plan that is included in the agenda packet for this meeting. The motion was seconded by Supervisor Lofton. RESOLUTION TO ADOPT THE 2030 COMPREHENSIVE PLAN, INCLUDING APPENDIX I AND APPENDIX II WHEREAS, the 2030 Comprehensive Plan, the Plan, a significant and rewarding undertaking throughout the year 2010 and into 2011, was drafted with the assistance of many others, including Working Groups and community partners and stakeholders, as part of a broad and successful public outreach effort; and, WHEREAS, this amendment was reviewed by the Comprehensive Plans and Programs Committee (CPPC), and the Planning Commission during their regularly scheduled meetings; and, WHEREAS, the Comprehensive Plans and Programs Subcommittee (CPPC) recommended approval of this adoption on March 14, 2011; and, WHEREAS, the Frederick County Planning Commission held a public hearing on the proposed 2030 Comprehensive Plan during their regular meeting on April 6, 2011; and, WHEREAS, the Frederick County Planning Commission recommended approval of the proposed 2030 Comprehensive Plan during their regular meeting on April 20, 2011; and, WHEREAS, the Frederick County Board of Supervisors held a public hearing on the proposed 2030 Comprehensive Plan during their regular meeting on April 27, 2011; and, Minute Book Number 37 Board of Supervisors Special Meeting of 07/14/11 2030 Comprehensive Plan 003' WHEREAS, the Frederick County Board of Supervisors further reviewed the Plan during their regular meeting on June 22, 2011, having previously postponed action on the Plan for 60 days to consider the comments received during the public hearing; and, WHEREAS, the Frederick County Board of Supervisors further considered the Plan during their specially scheduled meeting on July 14, 2011; and, WHEREAS, the Frederick County Board of Supervisors finds that the adoption of the 2030 Comprehensive Plan, Appendix I and Appendix II to be in the best interest of the public health, safety, welfare, and future of Frederick County, and in good planning practice; and, NOW, THEREFORE, BE IT RESOLVED by the Frederick County Board of Supervisors that THE 2030 COMPREHENSIVE PLAN, INCLUDING APPENDIX I AND APPENDIX II, is adopted. The 2030 Comprehensive Plan, including Appendix I and Appendix Il, shall be in effect on the date of adoption.
