July 7 2010 Work Session with Planning Commission Minutes001 A Work Session of the Frederick County Board of Supervisors was held on Monday, July 7, 2010, at 12:00 P.M., in the Board of Supervisors' Meeting Room, County Administration Building, 107 North Kent Street, Winchester, Virginia. BOARD MEMBERS PRESENT Chairman Richard C. Shickle; Charles S. DeHaven, Jr.; Gary W. Dove; Gene E. Fisher; and Christopher E. Collins. BOARD MEMBERS ABSENT Vice - Chairman Bill M. Ewing and Gary A. Lofton. OTHERS PRESENT: Planning Commission members Charles Triplett, George Kriz, Gregory Unger, H. Paige Manuel, Christopher Mohn, Gary Oates, Brian Madagan, Kevin Crosen, June Wilmot, and Lawrence Ambrogi; Comprehensive Plan and Programs Committee members Jim Golladay, and Robert Morris; John R. Riley, Jr., County Administrator; Jay E. Tibbs, Deputy County Administrator; Eric Lawrence, Director of Planning and Development; Michael Ruddy, Deputy Director of Planning; Senior Planner Candice Perkins, and Kris Tierney, Assistant County Administrator. Chairman Shickle called the meeting to order and turned the presentation over to Director Lawrence. Director Lawrence welcomed everyone to the meeting and briefly reviewed the work session agenda. He then turned the presentation over to Planning Commission Chairman June Wilmot for a brief update on the status of the Comprehensive Policy Plan update. Commission Chairman Wilmot advised that 41 people worked on the plan as part of the various working groups. Drafts of the plan will be reviewed in August. A public input meeting will be held in September. The goal for adoption will be December 2010. She concluded by saying she would like to have members of the Board of Supervisors work with the various Planning Commission working groups to see if they are on the right track. CPPA #01 -10 — TASKERWOODS /ALLDEN, LLC Deputy Planning Director Michael Ruddy appeared before the Board regarding this item. He advised the Comprehensive Plans and Programs Committee looked at this proposal in two parts. First was a Sewer and Water Service Area (SWSA) expansion for the northern part of the Minute Book Number 36 Board of Supervisors Work Session with Planning Commission of 07/07/10 (2010 Comprehensive Policy Plan Amendment (Tasker Woods /Allden, LLC); & 2010 Northeast Frederick Land Use Plan Update); & Water Service in the Stephenson Area) 110 property containing 2.41 acres. The second was an expansion of the Urban Development Area (UDA) for the southern part of the property containing 6.26 acres. The property is located in the Shawnee Magisterial District. He went on to say the UDA and SWSA expansions would accommodate residential and commercial uses. Deputy Director Ruddy stated the committee recommended no further study of the northern expansion of the SWSA, but did recommend further study of the southern proposal. They felt the southern expansion was appropriate if it could protect the existing environmental features. Patrick Sowers, Patton Harris Rust & Associates, appeared before the Board and Commission on behalf of the applicant. He noted the TaskerWoods project was made part of the Comprehensive Plan in 2005. In 2009, the owner met with Patton Harris Rust & Associates because he was concerned about the existing parcel being divided by environmental features. His concerns ranged from access to commercial uses developing within the wetlands area. He went on to say the owner was also seeking apartment type uses because he felt there was a need for apartment units. Mr. Sowers noted the applicant would need the expansion of the UDA to allow a rezoning application to be submitted to allow the proposed uses. With regard to the apartment uses, Mr. Sowers stated they would work well with the environmental features because the parking could be concentrated within the center of the development surrounded by the buildings. With regard to the proposed commercial uses, access via Macedonia Church Road would be accommodated under VDOT regulations. He advised the proposed comprehensive plan amendment would not result in an increase in the number of residential units and there would be no additional commercial over what has already been proposed. Commissioner Kriz advised the committee did not have enough information on the northern part, thus the recommendation not to study it further. He went on to say the residents wanted to keep residential uses versus commercial. Mr. Morris stated if the church would have some input into this proposal and they found it favorable then the committee could view it as favorable. Supervisor DeHaven stated the land use plan calls for commercial in that area and he believed that was the right use there. He went on to say it was better to discuss this issue now before people make decisions. He suggested this amendment be run through the process. Chairman Shickle concurred with Supervisor DeHaven. Minute Book Number 36 Board of Supervisors Work Session with Planning Commission of 07/07/10 (2010 Comprehensive Policy Plan Amendment (Tasker Woods /Allden, LLC); & 2010 Northeast Frederick Land Use Plan Update); & Water Service in the Stephenson Area) 003 Supervisor Fisher stated he was in favor of looking at both areas for a number of reasons. Deputy Director Ruddy advised staff would put this on the Board's July 28, 2010 agenda to move forward for more study. 2010 NELUP NORTHEAST FREDERICK LAND USE PLAN; 2010 UPDATE — DISCUSSION Deputy Planning Director Michael Ruddy appeared before the Board regarding this item. He noted the Planning Commission was supportive of the 2010 update of the Northeast Frederick Land Use Plan and recommended approval. He advised some map work needed to be finalized to reflect the transportation modeling. On April 20, 2010 a public meeting was held at the Stonewall Elementary School and the updated plan was generally well supported. He concluded by noting the plan has been modified to reflect transportation issues in that area. Chairman Shickle stated he would like to see the map legends sharpened because he had difficulty matching the legend with the colors on the map. Supervisor DeHaven noted this was the first time the maps showed a color associated with RA (Rural Areas). He stated this might cause some confusion, but he was okay with it if it was okay with everyone else. Mr. Morris stated he would like to see the O -M Office and Manufacturing Park District shown as a bubble because it is an overlay district. Supervisor DeHaven stated he was supportive of what we were trying to accomplish, as long as there was some flexibility in the interpretation. Deputy Director Ruddy briefly reviewed the transportation map. Chairman Shickle stated the transportation map was the hardest to read and critique. He went on to say it was hard to recognize any changes, etc. He suggested staff place numbers on a map that correspond to a legend, which reflects changes. Director Lawrence advised that staff would put together one map that showed all changes, including roads, land use, etc. Deputy Director Ruddy reviewed the community facilities map. He noted the Frederick County Sanitation Authority was involved in the SWSA and they could serve the existing land uses. He went on to say the land use plan, as proposed, gives them the ability to build infrastructure in a logical way. Chairman Shickle suggested the April 20, 2010 map be identified as a land use plan map. Planning Director Eric Lawrence advised staff would clean up the maps incorporating the comments received and would bring it back to the Board for discussion and direction. WATER SERVICE IN THE STEPHENSON AREA Planning Director Eric Lawrence appeared before the Board regarding this item. He advised this past fall, staff received a request to enable an existing residence of the Stephenson area to gain access to a public water line located within their front yard. The residence was located outside of the Sewer and Water Service Area (SWSA) and was, therefore, by policy, not permitted to access this public water. Many of the property's adjacent neighbors, while also outside the SWSA, did have water service. The Board of Supervisors, on November 18, 2009, ultimately granted the residence access to water service. It was noted that other properties exist that utilize public water service but are located outside of the SWSA. The Board suggested staff establish a list of those properties. To date, 344 parcels located outside of the SWSA have water taps. He advised staff was working with the Frederick County Sanitation Authority to get service addresses for those parcels.
