GRANTING THE EXTENSION OF WATER SERVICE OUTSIDE OF THE
SWSA TO SERVE AN EXISTING RESIDENCE AT 344 GUN CLUB ROAD
WHEREAS, Mr. Ronald Howser, property owner, wishes to connect his existing
two bedroom residence at 344. Gun Club Road, identified by Property Identification
Number 44 -A -197, to the public water system; and,
WHEREAS, The Frederick County Sanitation Authority (FCSA) has maintained
a water line on the subject property, and provided water service to 13 residences adjacent
to the subject property, since prior to 1992; and,
WHEREAS, The request for extension of water service would only serve the
existing two bedroom residence located at 344 Gun Club Road; and,
WHEREAS, This extension of water service outside of the SWSA request was
sponsored and presented to the Board of Supervisors by the Stonewall Magisterial
District Supervisor on this day; and,
NOW, THEREFORE, BE IT ORDAINED that the Board of Supervisors
authorizes the extension of water service outside of the SWSA to serve the existing
residence at 344 Gun Club Road.

SUBJECT: Request to Eztend Water Service Outside of the SWSA
Howser Property, 344 Gun Club Road, Stephenson

Staff has received a request to enable an existing residence to -gain access to a public
water line located within their front yard. The residence is located outside of the Sewer
and Water Service Area (SWSA) and is, therefore, by policy not permitted to access this
public water. If the Board deems that the uniqueness of this property, its existing
residence and the fact that its Neighbors already have access to public water, warrants
access to the public water, then an exception to the SWSA policy would be appropriate.
Details on the subject property and the existing water line in the subdivision are provided
below. A resolution authorizing access to the water line is attached for your
consideration.
SACi�GRO�eJND INFORMATION
Subject Property Details
Mr. Ronald Howser has submitted a letter to the County seeking permission to connect to
the public water line that is located in the front yard of his property. (Public sewer is not
available to this area of the County.) The property is located at 344 Gun Club Road, in
the Stonewall Magisterial District, zoned RA Rural Areas, and is further identified by
Property Identification Number 44 -A -197. The property is approximately 0.5 acre in
size, and contains a two bedroom single family residence constructed in 1956 (based on
Commissioner of the Revenue records). The property is presently utilizing a private well
as its water source. The property uses a private health system, which regulates the
number of bedrooms permitted on the property.
Ezisting Public Water Service along Gun Club Road
The Howser property is the northern -most residential property in a series of residential
lots/homes that are connected to the existing water line. In reviewing Frederick County
Sanitation Authority (FCSA) records, 13 residences in this section of Gun Club Road are
connected to the water line. While most of the residences were constructed in the 1950s,
some of these residences are from the 1930s and others from the 1970s.

Memorandum to the Board of Supervisors
RE: Request of an Existing Residence to Access Public Water
FCSA has informed staff that the existing water line was constructed prior to 1992 to
provide for potable water to this group of residences. (The actual date of installation is
not readily known, but water service records indicate service as far back as 1992.) The
water line was installed along the eastern side of Gun Club Road from its intersection
with Jordan Springs Road, and traveled north on Gun Club Road to a terminus on the
subject property (344 Gun Club Road). The property owners were presented the option
to connect to the line when it was installed; however, at that time, the owner of 344 Gun
Club Road opted not to participate in the water connection.
Sever and Water Service Area (SWSA)
The subject property is located outside of the SWSA. SWSA policy does not support
access to public water and sewer for properties located outside of the service area.
Changes to the SWSA Boundary (including exceptions)
The County has a procedure in place to consider changes to the County's Comprehensive
Policy Plan; this process is known as the CPPA (Comprehensive Policy Plan
Amendment) process. SWSA changes, and/or exceptions, are by design changes to the
Comprehensive Policy Plan and, therefore, should adhere to the CPPA process. This
process utilizes an established annual review period with applications due by June 15t of
each year. The process does enable a Board of Supervisor member to sponsor an
amendment outside of the annual review process should the Board member deem the
amendment unique and warranting immediate consideration.
This request for the extension of water service outside of the SWSA has been sponsored
by Supervisor Dehaven. Tiffs sponsorship enables the amendment to be considered
outside of the annual review process.
Conclusion
Since 344 Gun Club Road is located outside of the SWSA, an exception to the SWSA
policy is necessary prior to FCSA enabling water service to be installed. Water service,
installation of the necessary lateral line, and tap fee would be the responsibility of the
property owner. Should the Board of Supervisors determine that the existing residence at
344 Gun Club Road be granted access to the public water system, an exception to the
SWSA policy would be necessary. Such an exception to the SWSA policy would only
apply to the existing two bedroom residence.
