RAIL PRESERVATION APPLICATION
WINCHESTER & WESTERN RAILROAD
RESOLUTION
WHEREAS, the WINCHESTER & WESTERN RR desires to file an application
with the VIRGINIA DEPARTMENT OF RAIL AND PUBLIC TRANSPORTATION for the
projects; and
WHEREAS, the WINCHESTER & WESTERN RAILROAD has identified
projects are estimated to cost $1,177,676.00; and
WHEREAS, the General Assembly, through enactment of the Rail Preservation
Program, provides for funding for certain improvements and procurement of railways in
the Commonwealth of Virginia; and
WHEREAS, the WINCHESTER & WESTERN RR is an important element of the
WINCHESTER/FREDERICK COUNTY transportation system; and
WHEREAS, the WINCHESTER & WESTERN RR is instrumental in the economic
development of the WINCHESTER/FREDERICK COUNTY area, and provides relief to
the highway system by transporting freight, and provides an alternate means of
transporting commodities; and
WHEREAS, THE COUNTY OF FREDERICK supports the project and the
retention of rail service; and
WHEREAS, the COMMONWEALTH TRANSPORTATION BOARD has
established procedures for all allocation and distribution of the funds provided.
NOW, THEREFORE, BE IT RESOLVED that THE COUNTY OF FREDERICK
does hereby request the VIRGINIA DEPARTMENT OF RAIL AND PUBLIC
TRANSPORTATION to give priority consideration to the projects proposed by the
WINCHESTER & WESTERN RR totaling $1,177,676.00 in FREDERICK COUNTY.
At a Regular Meeting of the Board of Supervisors for the County of Frederick,
Virginia, held on February 11, 2009, upon motion made by Gary W. Dove and seconded
by Bill M. Ewing, the above resolution was approved by the following recorded vote:

The WINCHESTER & WESTERN Railroad, serving Winchester and Frederick County as a common
carrier public utility, has made application to the Commonwealth of Virginia Department of Rail & Public
Transportation for Financial Assistance for Rehabilitation of certain local rail lines, requesting $1,177,676.00 to
improve both public safety and the physical condition of the railroad. The Winchester and Western Railroad will
fund the matching portion of this project. No County money is requested.
The proposed improvements will take place in the County; therefore, the Department has requested a
Resolution from the governing body, indicating their support of the project(s). A proposed Resolution, in the format
suggested by DOT personnel, is forwarded as Enclosure 1. The original letter of application provides additional
information: a copy is attached as Enclosure. 2.
The WINCHESTER & WESTERN Railroad respectfully requests introduction and approval of this RAIL
PRESERVATION APPLICATION Resolution at your earliest opportunity. Questions may be directed to our
Winchester office, to the undersigned, who will also be available, if required, at your next Council Meeting.

Dear Mr. Badger,
The purpose of this letter is to forward and respectfully request favorable consideration for our application for
financial assistance utilizing Rail Preservation Program funds that are available for the 2010 fiscal year. The
proposed scope of work is as set forth in the attached pages. This work continues the program designed to upgrade
the Winchester & Western Railroad Company Virginia Division to Class I standards: therefore, the previous
justification and evaluation documents remain in effect.
The W &W, which employs 21 people on the Virginia Division, handled 7375 carloads of freight over our shortline
in 2008. We expect 7000 carloads in 2009. The Virginia Division of the Winchester and Western operates 53.12
miles of trackage between Gore, VA and Williamsport, MD. Of this total, 26.76 miles are in the Commonwealth of
Virginia
1 hereby certify that the Winchester & Western Railroad Company (W &W) is a Common carrier; that funds are
available and will be provided for by the W &W if this application is approved and funded by the Commonwealth:
that the W &W provides continuous maintenance, and assumes liability for the tracks and facilities involved; and that
the W &W guarantees the right -of -way for the project(s) identified. Work will commence upon approval or March 1,
2010, whichever is later.
Only Frederick County VA is impacted by these proposed projects and a resolution of support is on the agenda for
the next meeting of the Board of Supervisors of Frederick County. A draft resolution is enclosed. A properly
certified copy of this resolution will be forwarded as soon as it is received.
SWAM goals established for this project will be met.

2010 VIRGINIA RAIL PRESERVATION FUNDS APPLICATION
PROJECT DESCRIPTION
Replace 1.5 miles of 100# rail on the Winchester & Western's most used section of track
in Virginia. Heavier rail (115# or greater) will be installed, with rails welded together,
thereby eliminating problematic bolted joints. Surfacing, ballast installation a
distributing will be performed on this section.
